证券业的新变革——网络券商的兴起

国际网络的快速发展，改变着人类的生活方式，亦改变着企业的经营模式。善用此一高新技术以增强竞争力，是现代企业经营必须强化的课题。对证券业这种知识型的产业而言，客户重视服务、效率、准确、安全，并能以更节约方式达到理财的目的，网络上的投资理财更是证券业者必须提供的服务。尤其加入世界贸易组织的进程不远，证券业者必须思考面对国外传统大型投资银行的竞争，把握网际网络这一新科技的特性，在这虚拟的新战场树立中国投资银行经营之典范。

资产证券化 (ABS)作为一种重要的金融衍生工具 ,在国际资本市场上有着巨大的发展潜力。本文在对资产证券化作简要介绍后 ,着重探讨这种金融工具对商业银行和投资银行这两类相对称的金融中介机构的影响 ,并从中展望银行业未来的发展趋势。     

Changing social responsibilities: the role of advocacy organisations in the construction of the Social Support Act in the Netherlands

This paper describes a study on civic participation in legislative processes. In January 2007 a new law on health and social care in the Netherlands was implemented: the Social Support Act (SSA). This law specifically aims at greater civic participation in the implementation of the law, in the provision of health and social care and in the social policy making process. This study focuses on civic participation in policy making, more specifically on civic participation in the legislative process of the Social Support Act. It examines whether national advocacy organisations were successful in their efforts to influence the legislative process and the final construction of the Social Support Act. The main conclusion is that the client and patient organisations were indeed successful in obtaining important changes in the law both through a well informed and professional individual lobby as well as by means of collective action. Yet questions concerning the justification of high expectations for successful local civic participation in the local policy-making process remain.     

A Commentary on the Admission and Retention of Students with Disabilities in Social Work Programs

Abstract

Section 504 of the Rehabilitation Act of 1973 is the federal law upon which the Americans With Disabilities Act (ADA) is built. Both laws are designed to prevent discrimination against students with disabilities. This commentary offers a comparison of section 504 with the ADA. An analysis of the case law under Section 504 is also presented; this analysis provides guidelines that universities and colleges will have to follow under the ADA. The implications of the ADA are offered for social work programs in the areas of admission and retention of students with disabilities.     

我国证券投资基金持股与股价波动的关系——基于动态面板数据模型的实证研究

本文从证券投资基金持股比例与股价波动关系的角度，分析基金的参与对股价波动的影响。本文选取2002—2007年的基金与股票市场相关数据，运用动态面板数据模型分析后发现：一方面，基金持股比例变化对股票价格波动有推波助澜作用：另一方面，基金持股比例受股价波动的影响，基金更偏向于购买股价波动较大的股票。     

美国“情报自由法”浅析——兼与中国《政府信息公开条例》比较

政府信息公开与否是判断政府民主、法治发展水平的一个重要标志。情报自由法在美国行政公开中占有非常重要的地位。我国2008年5月1日即将实施的《中华人民共和国政府信息公开条例》与之相比较，二者产生的背景、公开的方法、公开的内容相似；但是二者的法律位阶、救济手段不同。     

Assessing Potential Human Health Hazards and Benefits from Subtherapeutic Antibiotics in the United States: Tetracyclines as a Case Study

Many scientists, activists, regulators, and politicians have expressed urgent concern that using antibiotics in food animals selects for resistant strains of bacteria that harm human health and bring nearer a “postantibiotic era” of multidrug resistant “super‐bugs.” Proposed political solutions, such as the Preservation of Antibiotics for Medical Treatment Act (PAMTA), would ban entire classes of subtherapeutic antibiotics (STAs) now used for disease prevention and growth promotion in food animals. The proposed bans are not driven by formal quantitative risk assessment (QRA), but by a perceived need for immediate action to prevent potential catastrophe. Similar fears led to STA phase‐outs in Europe a decade ago. However, QRA and empirical data indicate that continued use of STAs in the United States has not harmed human health, and bans in Europe have not helped human health. The fears motivating PAMTA contrast with QRA estimates of vanishingly small risks. As a case study, examining specific tetracycline uses and resistance patterns suggests that there is no significant human health hazard from continued use of tetracycline in food animals. Simple hypothetical calculations suggest an unobservably small risk (between 0 and 1.75E‐11 excess lifetime risk of a tetracycline‐resistant infection), based on the long history of tetracycline use in the United States without resistance‐related treatment failures. QRAs for other STA uses in food animals also find that human health risks are vanishingly small. Whether such QRA calculations will guide risk management policy for animal antibiotics in the United States remains to be seen.     

Addiction Treatment with Deaf and Hard of Hearing People: An Application of the CENAPS Model

ABSTRACT

Alcohol and drug addiction is a significant problem among deaf and hard of hearing people. Looking through a Deaf culture lens, treatment for alcohol and drug addiction is key for providing care for deaf and hard of hearing clients. Using the CENAPS model, an applied cognitive-behavioral therapy program is recommended for addiction treatment. The CENAPS model provides clinicians with tools for stabilizing deaf and hard of hearing clients, supporting their transition to early recovery. Educating the client about the stages of relapse and the stages of recovery, clinicians using this model can better treat and prepare deaf and hard of hearing clients for long-term recovery.

中美轮胎特保案的法律困境及WTO下的贸易政策

中美轮胎特保案是奥巴马政府对中国发起的首例特保调查,受到中美业界的广泛关注。分析特殊保障措施的进口增长、实质损害、因果关系三要件,我们可知：从WTO特保条款分析,对中国轮胎采取特保措施欠缺法律支持;从美国＂421条款＂分析,对中国轮胎采取特保措施虽然有失公允但有其一定原由。在金融危机的背景下和WTO的框架内,轮胎特保案的评述对于我国贸易政策的调整和增长方式的转变有一定的启发意义。
