我国社区矫正工作社会化模式的建构——基于社区矫正工作目标的分析

社区矫正是社会化的刑罚执行方式,但从实践运作看,我国社区矫正的社会化程度依然不够,没有最大效度地达到社区矫正的目标.本文在对社区矫正工作目标进行分析的基础上,提出了我国社区矫正工作的社会化模式:基于责任共担的社区服刑环境建设、基于社会工作方法的个案矫正模式、基于社会人力资源的社会帮教工作.     

1929年新康轮案研究

1929年7月21日，在中国山东海面，日船龙野丸号无故撞沉了中方船只新康轮号。案件发生后，中国有关各方采取积极措施对日交涉。但日方对交涉采取抵制、敷衍态度。日方的态度引起遇难家属和上海社会各界的极大愤慨，并由此在上海地区掀起了一股反日浪潮。新康轮案解决未果，一方面是由于近代以来中国领事裁判权和中国领海管辖权的丧失，使中国丧失了对外国肇事船舶的独立审判权；另一方面则是因为国民政府实力弱小，拿不出切实办法迫使日本邮船会社前来应诉，更无法迫使其对新康轮案进行道歉和赔偿。     

Differences in health-related quality of life among persons living with HIV/AIDS

We sought to identify differences in health-related quality of life (HRQoL) among a sample of HIV positive individuals receiving case management services in northern Florida. Our study consisted of 97 individuals receiving HIV case management that included 56 males (57.7%) and 81 African Americans (83.5%) who were 47.05 years old (SD = 9.33). HRQoL was measured using the HIV/AIDS Targeted-Quality of Life scale (HAT-QOL). Results show significant group differences in HRQoL by race, income, tobacco use, alcohol use, drug use, and CD4 cell count, despite only 43% of this sample being able to recall their most recent CD4 count. Translating these findings to inform practice, HIV care providers need to provide continuing education to patients about their disease status, knowledge, and treatment as it relates to self-care. Also, HIV care providers should be especially cognizant of the impact that tobacco, alcohol, and illicit drug use has on HRQoL for persons living with HIV/AIDS (PLHA) by working to assess social support, identify readiness for change, and make appropriate referrals for treatment.     

Estimation with right‐censored observations under a semi‐Markov model

The semi‐Markov process often provides a better framework than the classical Markov process for the analysis of events with multiple states. The purpose of this paper is twofold. First, we show that in the presence of right censoring, when the right end‐point of the support of the censoring time is strictly less than the right end‐point of the support of the semi‐Markov kernel, the transition probability of the semi‐Markov process is nonidentifiable, and the estimators proposed in the literature are inconsistent in general. We derive the set of all attainable values for the transition probability based on the censored data, and we propose a nonparametric inference procedure for the transition probability using this set. Second, the conventional approach to constructing confidence bands is not applicable for the semi‐Markov kernel and the sojourn time distribution. We propose new perturbation resampling methods to construct these confidence bands. Different weights and transformations are explored in the construction. We use simulation to examine our proposals and illustrate them with hospitalization data from a recent cancer survivor study. 把握水体污染公共安全事件诱发过程和阶段是合理预警与应对的前提。以松花江水体污染公共安全事件为例,采用案例研究,归纳分析水体污染公共安全事件诱发过程的六个阶段：常态水体污染阶段,水体污染积累阶段,水体污染警告阶段,水体污染人工干预阶段,水体污染危害潜伏阶段,触发事件阶段。     

A case study of the impact of integrated project governances on PPP project performance

Under the new normal state, the PPP project will play a more and more important role in the social and economic development of China. To improve the performance of PPP project management, it is necessary to implement integrated project governances. Firstly, according to the index system of two kinds of PPP projects governances (Contract Governance and Relationship Governance) and PPP project management performance determined by theoretical analysis, the DDX project is selected as the analysis object. After identifying the case, this paper explains the basic information and preliminary work of the case. Then, the three contents of contract governance, relationship governance and project performance are analyzed comprehensively. Case studies show that all of these two governance modes have positive effects on project management performance. However, due to the lack of information in the case, the validity of the conclusion also needs to be verified again.     

《苏报》案与治外法权

《苏报》案是中国资产阶级民主革命准备时期发生的一个重大历史事件 ,发生于租界的《苏报》案与治外法权有非常密切的关系。帝国主义列强为了维护在中国所攫取的治外法权 ,对清政府实行了多方面的限制。清政府为了达到迫害资产阶级革命思想家的目的 ,竟在自己的国土上同自己的子民打了一场由外国人充当裁决者的荒唐官司 ,其腐朽无能的本质暴露无遗。治外法权是对中国主权的严重侵害 ,但在《苏报》案中 ,却在客观上起到了一定程度上的保护资产阶级革命思想家的作用
