嵌入性与中国社会的伦理场域

中国社会是伦理社会,这是对中国社会性质的一种界定与基本认识。这种认识与界定既是对传统中国的反思,又是对中国现实的把握。现代深深地嵌入在传统之中,中国人直接或间接地受传统伦理的影响和支配。伦理场域是中国人开展社会行动的依托,行动者在伦理场域中占有位置、施展策略、获取资源。因此,伦理场域是理解中国现实国情和中国人行动逻辑的关键。     

教育行动研究与在职外语教师的专业发展

教育行动研究作为一种解决现实课堂教学问题的实践方法和特殊的教师教育方法正受到越来越多的国内外教育研究者的关注。它倡导教师即研究者通过对自己课堂中的教学现象进行考察和研究并从中获取知识,改进教学质量。教育行动研究与教师专业发展密切相关。教育行动研究可以改进教学质量,提高教学水平,帮助在职教师重建知识体系,促使教师向专家型教师转化,是在职外语教师专业发展的可行的、有效的途径。     

Political theater and student organizations in the 1989 Chinese movement: A multivariate analysis of Tiananmen

Social movement research has often been divided between organizational and cultural analyses of collective action. Organizationally oriented theorists have viewed indigenous organizational structure as the critical variable in the emergence of collective action. Political culture and cultural frame theorists have focused instead on the cultural frames that resonate with audiences, mobilizing them to action. But social movements cannot be the result of one or the other of these factors. An analysis of the 1989 Chinese movement illuminates the multivariate aspects of this social movement. This movement was a two-tiered movement with an organized student leadership tier and a mass audience. Enmeshed in university organizations and student networks, the student leaders relied on an organizational structure that had been emerging since the mid-1980s. This organized leadership tier employed cultural symbols and acts to mobilize mass audiences that were beyond the scope of the students' organizational linkages. The political theater of the organized student leaders was complemented by institutional changes that had been occurring over the decade of reform in China and a political opportunity that allowed wide coverage of the students' activities.     

公司并购绩效与公司边界:交易费用的视角

公司并购重组是重新确定公司边界的一种有效机制。本文充分整合产权理论、交易费用经济学、影响成本理论以及公司并购协同效应理论,推导出影响公司边界的若干因素,确定出影响公司并购绩效的主要潜在因素,再在此基础上建立一个分析公司并购绩效与公司边界的综合性理论框架。结果发现,资产专用性、影响成本与公司并购协同效应都将对公司边界的调整和公司并购绩效产生决定性的影响,而且这个影响的大小又取决于治理结构、融资工具以及组织结构等诸多因素。     

基于灰关联约束超效率DEA的重点实验室评估研究——以河北省省级重点实验室为例

目前国内外对重点实验室的评估主要采用专家评价等软评价方法,较少考虑科技投入和科技产出之间的关联关系。在对国内外重点实验室评估方法进行深入研究的基础上,利用灰色关联度分析指标内在的关联性,将其作为限制条件加入超效率DEA评价模型中,构建了基于灰色关联权重约束的超效率DEA评价模型,并应用于河北省省级重点实验室评估的实证分析。研究结果显示,此模型与传统的CCR模型和超效率DEA模型相比,既可以揭示科技投入和科技产出之间的内在联系,又可以保持DEA评价的客观性,与此同时,还可实现不同实验室评估结果的全排序,使得评估结果更加符合实际。     

夫妻一方举债案件中的当事人确定和嗣后救济

“夫妻共同债务”与 “连带债务”在债务发生原因和债务履行上存在差别,对其进行诉讼时,诉讼形式应为固有的必要共同诉讼。当债权人仅起诉名义举债人一方时,可能构成诉讼被告不适格。借鉴德日诉讼要件理论,法院可以对当事人适格问题进行“职权调查”,但所采用的诉讼资料应遵循“辩论主义”。在此基础之上,应明确法院的释明权适用情形,即通过对已经参加诉讼的当事人进行释明来改变诉的不合法状态。若因法院在此审判阶段释明权适用不到位,而最终不合法的诉获得了无法顺利执行的实体判决,债权人想要获得圆满救济仅能依靠再审。     

立案登记制改革:理论基础、运行困境与路径优化

2015年5月1日起中国正式实施立案登记制,将案件受理制度由审查制改为登记制,这符合当事人诉权保障的趋势和需求.立案登记制具备诉权保障的功能,可以多维度地践行诉权保障理念,但同时也带来了实践中的滥诉和法院案件数剧增等现实挑战.司法权的属性决定了司法的有限性,其不能解决所有社会纠纷.当立案登记制给审判实践带来的挑战遭遇司法有限性时,势必出现一定程度的冲突.为了平衡这种冲突,需从以下方面进一步优化立案登记制的改革路径:明确立案过程中登记与审查的关系;制定和实施受案范围的负面清单;健全减少需求供给的配套措施;推进立案环节案件的甄别分流;构建滥诉的惩治与防范机制;减少非司法负担对法官职业化的影响.     

Action,Technology, and the Homogenisation of Place: Why Climate Change is Antithetical to Political Action

According to Hannah Arendt, the concept of ‘political action’ is a fundamental component of the human condition because it encapsulates how the uniqueness of each human being intersects to create unpredictable political initiatives and effects. Recently, despite being one of the most daunting political challenges ever faced by humanity, there has been a noted collective action failure, or inaction, concerning the global threat of anthropogenic climate change. Why? This article seeks to explain this political inaction in a new way: by examining the metaphysical role that technology plays in disclosing the climate as a thinkable and global object. After applying the philosophy of Martin Heidegger to the complex mathematical general circulation models (GCMs) used by the Intergovernmental Panel on Climate Change (IPCC), this article details how the metaphysics underlying GCMs manifests the perceivable world by ‘enframing’ it, or by implicitly representing subjects, objects, and Nature itself, as a predictable, calculable, and orderable relation of static forces. When this metaphysical and mathematical uniformity constructs the climate as a calculable object that is globalised through the IPCC, it is ultimately found to be contradictory to the distinctness and unpredictability necessary for distinct human action to occur. Paradoxically, therefore, political action is argued to be metaphysically antithetical to the technologically enframed science, politics, and discourse, of global climate change itself. The importance of distinct and plural human places, when filtered through GCMs, becomes subsumed by the climate as a homogenous, calculative, and politically inactive, global object.     

Corporate collective action and the market cycle of the cloth industry in Nieuwkerke,Flanders, 1300–1600

This article addresses the connections between corporate collective action and economic development in the pre-industrial Low Countries. It focuses on a micro-historic case study: the textile industry of the village of Nieuwkerke in the county of Flanders. This rural cloth centre witnessed an exceptional industrial expansion between the fourteenth and sixteenth centuries. Following the recent proposition by Bas van Bavel that market economies follow a fixed pattern of development, the chronology of the evolution of Nieuwkerke’s cloth industry can be discussed in terms of three phases. This article argues that the first phase of development (1358–c.1500) was characterized by limited success because of pressure from the city of Ypres. The second phase (c.1500–c.1550) was marked by an industrial boom, predicated upon successful corporate collective action intertwined with the perception of social equality among the village’s cloth entrepreneurs. The third and final phase (from c.1550) was one of stagnation and decline, caused by the breaking down of the collective and concomitant social polarization. The case study thereby closely conforms to van Bavel’s theory about market cycles. Yet, the correlation between economic decline and social polarization should in this case be understood in terms of changing perceptions of inequality, rather than increasingly unequal opportunities.     

A good fit: the contribution of action learning to supervision practice

This paper discusses the value of action learning for social work supervisors. Recent years have seen renewed focus on supervision as a reflective space and some indications that the tide may be turning in regard to the dominance of managerial priorities within the supervision of direct practice. It is less evident that a similar shift is taking place for supervisors themselves and, anecdotally, many describe their own supervision as having a business focus with limited scope for reflective dialogue. While the traditional functions of supervision need to adapt to fit the responsibilities of those in management positions, it remains true that these staff provide a vital containing role within the organisational hierarchy. For that to be sustained, it is important that supervisors have space and structure within which to process the emotional, intellectual and practical challenges of their work. The integration of action learning sets within post-qualifying courses for supervisors has demonstrated a useful dual function. Firstly, they provide an effective model for group supervision, facilitating in-depth reflection on complex practice issues. Secondly, they offer managers a peer supervision forum; a safe place to explore dilemmas and share the vulnerabilities which belong to management roles as well as practice.
