简析船员外派企业的法律性质

欠发达地区农村养老保险中的子女代缴行为：内蒙古个案

通过对内蒙古敖汉旗的调查发现,经济欠发达地区实行新型农村社会养老保险时,存在一个很重要的问题,就是对农民这一重要的缴费主体没有明确和细化。不少中老年农民虽然希望参加新型农村社会养老保险,但是由于其自身经济收入少,用途多,因而没有能力参加,不利于这一制度覆盖面的扩大和保障作用的完全发挥。建议建立子女代缴机制,由子女代父母参加新型农村社会养老保险缴费。     

Persistence and desistance in heavy cannabis use: the role of identity,agency, and life events

Many cannabis users ‘mature out’ of their drug use, and factors of cannabis use cessation have been identified. However, very little in-depth knowledge is available about the mechanisms underlying this phenomenon. Criminological studies have gained interesting insights in desistance from crime, yet these perspectives are rarely used in drug research. This qualitative, three-year longitudinal study explored the processes involved in desistance from frequent cannabis use for young adults. Using a narrative approach, desisters (frequent users who successfully quit their cannabis use) and persisters (frequent users with a persistent desire and unsuccessful attempts to quit) were compared. In the course of the study, desisters mainly exhibited increasing agency and goal setting, established strategies to achieve these goals, and could envision another self. Desistance was generally induced by life events that became turning points. Persisters experienced largely similar events, but lacked goals and strategies and held external factors responsible for their life course and failed quit attempts. Identity change is at the core of desistance from frequent cannabis use, and the meaning-giving to life events and experiences is essential. Agency is a necessary ingredient for desistance, develops over time and through action, and leads to a new drug-free identity with desistance in turn increasing agency.     

缘起缘落： 方志彤与庞德后期儒家经典翻译考

美国现代派诗人埃兹拉·庞德一生推崇中国文化和儒家思想,除了在诗歌中大量引用中国典故,还翻译了《大学》、《中庸》、《论语》、《诗经》等儒学经典。庞德晚年被拘押在华盛顿圣伊丽莎白精神病医院期间同哈佛学者方志彤有频繁的书信往来,分析这些史料可以追溯庞德和方志彤之间围绕儒家经典翻译的探讨和争论,进而驳斥西方学者所谓18、19世纪汉学家的译著为庞德儒家经典翻译唯一依据的观点。庞德晚年的儒学翻译有诸多突破：一是突破了对个人和社会责任的关注;二是突破了“四书”的限制;三是突破了重汉语字形、轻汉语语音的成见。庞德能有这些突破,方志彤功不可没。史料证明,方志彤对庞德后期儒家典籍翻译的帮助和影响超过了半个世纪来学界的估计。     

认知观下预设功能新解与翻译课堂构想

19世纪末,为了更科学地解释语义和逻辑的有关现象,哲学家和逻辑学家创造了一个新术语,这就是“预设”。直至20世纪70年代末,“预设”的有关研究基本局限在静态语句内。认知科学的崛起迅速扩展了研究者的视野,语言学家们开始关注其认知规律及其在认知中的功能。在此背景下,以认知科学和认知语言观为理论框架,探讨了认知文本生成的过程,并据此重新阐述语篇预设的功能。认知观下“预设”的功能新解极大地触发了笔者对目前翻译教学的思考,尝试提出情境式翻译课堂的构想,期望对翻译教学及“预设”理论的充实有些许贡献。     

‘Wishing to go it alone’: the complicated interplay of independence,interdependence and agency

Some individuals with disabilities for whom verbal speech is not reliable use facilitated communication to express thoughts and ideas. While they may require intensive physical support initially, the goal is independent typing. However, this emphasis on fading support and independence bears consideration. We utilize a Disability Studies lens to frame practices around independence and the complicated interplay between interdependence, agency and voice. Based on qualitative analysis of communication training sessions, we present four findings: the complexity of the message versus fading of physical support, the emotional dimensions of independence, the facilitator’s navigation of multiple roles, and the importance of facilitating agency. We also share implications of reframing independence and facilitating agency for the communication training process.     

Gender‐Related Violence and Young People: An Overview of Italian,Irish, Spanish,UK and EU Legislation

Do laws regarding violence against or sexual exploitation of young people recognise gendered and other power dynamics? Cross‐national comparison of legal texts can illustrate the benefits of framing issues of violence/gender/youth in certain ways and offer critical reflection on particular legal frameworks or cultural understandings. This policy review is based on an analysis of select laws regarding gender‐related violence (GRV) as relates to young people in Italy, Ireland, Spain and the UK. Here, GRV is defined as sexist, sexualising or norm‐driven bullying, harassment, discrimination or violence whoever is targeted. It therefore includes gender, sexuality and sex‐gender normativities, as well as violence against women and girls. A tension emerges between granting young people agency and recognising the multiple, intersecting power relations that might limit and shape that agency. This article draws out the implications for the UK in particular, highlighting the absence of preventative measures and the need for a broader approach to combat GRV.     

编撰经济法典的历史回眸

编撰经济法典是指有关经济法部门的经济法律法规的汇合编纂和基本经济法的撰写创制。编撰经济法典缘起于经济法的萌芽,经济法萌芽首先表现为个别法学家经济法思想的产生,而经济法思想也对经济法律法规的制定起了一定的指导作用。随着东西方国家经济法律法规的大量出现,经济法成了一种新兴的世界历史性的法律现象。这引发了经济法典的编撰,促进着经济法的完善,满足着以社会化生产为基础和以资本要素为核心的市场经济的需要。我国在制定和实施经济法、保障社会主义市场经济更好运行上的实践比较深入,我国的经济法理论研究也走在世界前列,因而在编撰经济法典上也可以为天下先,这将对世界法制文明的发展做出更大的贡献。

电子政务在促进法治政府建设中发挥着越来越重要的作用。在我国电子政务建设中,存在着重形式轻内容、政务信息资源管理不力、政府网站公众参与不够等问题。为顺应法治政府建设的需要,应在优化信息资源、培养电子政务信息队伍、加强公共平台建设、完善制度保障、创新应用内容等方面加强电子政务建设。
