论宪法的司法适用及违宪审查

中国宪法作为国家根本大法的地位早已确立,但迄今为止,宪法所具有的“最高法律效力”并未在司法程序中得以实现,司法机关的违宪审查权也未予确立,这与法治和宪政的要求相去甚远。针对此,文章通过揭示宪法实施中的现存障碍,提出了实现我国宪法的司法适用及违宪审查的合理架构。     

冰心和宗教文化

冰心从不隐讳自己同宗教的关系。她对待自己所受洗的基督教虽不重视其仪式,却稔知《圣经》,尊重教义。她总自觉不自觉地将自然神论和自由主义神学融合在一起。她对基督的“爱的人格”尤为钟情;由她自己提出的“爱的哲学”,其核心正在于“爱的人格”。20世纪下半叶,冰心的宗教意识淡出,但她以调和之态对待其他宗教,并视宗教为文化,在国际文化交流中作出杰出贡献。冰心文学的审美,倾向于上帝-自然-艺术三位一体的建构,她相信艺术创造有“神助”之力,由她主张的语体、所呈现的艺术风格,也都烙有《圣经》的投影。     

管理科学与工程学科基金项目资助和SCI论文发表情况分析

系统地统计了2003～2008年国家自然科学基金委员会管理科学部管理科学与工程学科面上项目和青年项目受资助的总体情况,分析了各个子学科类别的资助状况和发表SCI论文情况,同时分析比较了国家"十一五"与"十五"期间的资助项目情况和发表SCI论文数量情况,找出其中存在的问题并对其原因进行了分析.最后,依据国家自然科学基金"十一五"发展战略,提出今后国家自然科学基金资助策略和建议.     

Asymptotic normality of conditional density estimation under truncated,censored and dependent data

Abstract

In this paper, we focus on the left-truncated and right-censored model, and construct the local linear and Nadaraya-Watson type estimators of the conditional density. Under suitable conditions, we establish the asymptotic normality of the proposed estimators when the observations are assumed to be a stationary α-mixing sequence. Finite sample behavior of the estimators is investigated via simulations too.     

Nonparametric kernel estimation of expected shortfall under negatively associated sequences

Abstract

In this article, Bahadur type expansions of a nonparametric kernel estimator for ES under NA sequences are given. The strong consistency and the uniformly asymptotic normality of the estimator are yielded from the Bahadur type expansions, while the convergence rates of the above asymptotic properties are also obtained. Moreover, the expectation, the variance and the mean squared error (MSE) of the estimator are given. Besides, the optimal bandwidth selection of this estimator is discussed. We point out that all above results are based on the NA sequences. Finally, we conduct numerical simulations and compare performances of some ES estimators.     

非典型作品的著作权保护探究

随着新时代社会物质文化的快速发展，人们陆续就音乐喷泉、烟花、插花、武术表演等非典型作品的著作权保护展开讨论，甚至已有部分客体涉及诉讼，这就要求研究者厘清著作权法所规定的“作品”的概念和界定，明确非典型作品的特点与保护意义，才能探寻非典型作品著作权保护的路径。因此，当前应通过法律解释的方法并结合司法审判实例来探究非典型作品著作权的保护路径。     

修复生态环境的量刑适用研究——兼议法释〔2016〕29号第5条的得与失

环境犯罪中犯罪人修复生态环境对于实现刑罚目的和环境保护目的都具有重要意义。但司法解释对修复生态环境在量刑中的适用设立了诸多门槛，以致修复生态环境作为量刑情节的适用率低，不能发挥其应有的功能。犯罪嫌疑人修复生态环境体现其人身危险性和社会危害性在减小，这正是将修复生态环境作为量刑情节适用的理论根据所在。同时，犯罪人修复生态环境在量刑中适用亦是法益恢复理论和刑罚正当性理论发展的需要。为实现刑罚目的与环境保护目的，有必要界清犯罪人修复生态环境概念与内容，放宽修复生态环境的刑罚适用条件，促进修复生态环境发挥其应有的功能。     

START: single‐to‐double arm transition design for phase II clinical trials

Phase II clinical trials designed for evaluating a drug's treatment effect can be either single‐arm or double‐arm. A single‐arm design tests the null hypothesis that the response rate of a new drug is lower than a fixed threshold, whereas a double‐arm scheme takes a more objective comparison of the response rate between the new treatment and the standard of care through randomization. Although the randomized design is the gold standard for efficacy assessment, various situations may arise where a single‐arm pilot study prior to a randomized trial is necessary. To combine the single‐ and double‐arm phases and pool the information together for better decision making, we propose a Single‐To‐double ARm Transition design (START) with switching hypotheses tests, where the first stage compares the new drug's response rate with a minimum required level and imposes a continuation criterion, and the second stage utilizes randomization to determine the treatment's superiority. We develop a software package in R to calibrate the frequentist error rates and perform simulation studies to assess the trial characteristics. Finally, a metastatic pancreatic cancer trial is used for illustrating the decision rules under the proposed START design.     

儿童作为“具体人”的学前教育意蕴及其启示

儿童是人，更是具体的人。纵观具体人的发展历史，其大抵经历了生成、异化、重构、整全、完善等五大阶段，具体表现 为“空洞人”转向“具体人”、“具体人”转向“抽象人”、“抽象人”转向多元“具体人”、多元“具体人”转向两维“具体人”以及两维 “具体人”转向三维“具体人”。可见，“具体人”的发展是一个趋于完整和动态生成的过程，“具体人”的学前教育意蕴理应建立 在“具体人”的内在规定及其嬗变规律上。具体而言，“具体人”的学前教育是契合儿童天性的教育、符合儿童共性的教育、适合 儿童个性的教育。基于此，儿童作为“具体人”对学前教育的启示如下：从种生命维度出发，从新回到身体，激活儿童的生命潜 能；从类生命维度出发，追寻教育理想，唤起美好事物的欲求；从个生命维度出发，回归个人生活，引导个体的自我成长；从三维 一体来看，各美生命之美，锻造充满张力的生命体。
