从菠萝科学奖探析非政府科技奖项的发展轨迹

目前,我国的非政府科技奖是由科学共同体、社会团体、企事业单位、个人等社会力量设立的对取得科技成就者的奖项。文章以首届菠萝科学奖为例,深入探讨我国非政府科技奖励的现状、国际影响及创新实质三个方面,尝试为建立科学合理、具有中国特色的科技评价体系提供借鉴和启示。     

Evaluating patents using damage awards of infringement lawsuits: A case study

As the era of knowledge economics rose, the patent became one kind of knowledge outcome. This study aimed at the basis of the patent law and proposed an integrated evaluator for patent management. The damage award of a patent infringement lawsuit was deemed to be the legal value of the patent. 65 effective samples were extracted from 4289 patent infringement lawsuits retrieved from the U.S. district courts. 17 indicators were summarized to quantitatively describe the dimensions of the patents. Back-Propagation Neural Network was applied to build the patent valuation model, wherein the 17 indicators were the inputs and the damage award was the output. The patent valuation model was validated to be feasible by error analysis. The integrated evaluator for patents was then established by transforming the output of the patent valuation model via the Z-score. The proposed integrated evaluator accommodated to the patent management effectively.     

中韩仲裁立法的比较研究

20 0 2年修订的韩国《仲裁法》强调国际化和自由化 ,大量参考和运用了外国先进立法和国际公约的规定 ,在当事人意思自治、仲裁庭的自裁管辖权、仲裁协议的“书面”形式的解释、仲裁中的财产保全制度及申请撤销仲裁裁决制度方面与中国《仲裁法》有很大的不同 ,其中的某些制度很值得我国仲裁立法借鉴。     

Prizing African literature: creating a literary taste

This paper explores the significant role played by international literary awards in African literary canon formation. It focuses on the Commonwealth Short Story Prize (CWSSP) and the Caine Prize for African Writing (CP) as major award institutions for contemporary African literatures. The paper aims to position these prize competitions in the context of African literary and cultural production by foregrounding the intricate relationship between the text and the award institutions to point at the different roles they each play in the process of canon formation. It argues that canonicity through the award sector is influenced by several factors from the point of production to the presentation of the literary award. The paper uses the word “taste” to refer to the aesthetic qualities of a text as prescribed by the literary award. It then explores the process of this judgement of the aesthetic qualities of the prize texts, exploring factors such as economic and political patronage and its effects in literary taste creation. It concludes that taste in literary production, mediated through the institution of the award industry, is significantly influenced by the economic, political and cultural contexts of production.     

对成人高等教育学士学位授予规范化运作的思考

学位授予制度的建立对成人高等教育的健康发展起到了积极的促进作用,本文针对目前各高校对成人学位授予工作认识不够、掌握标准不一等诸多问题,提出了加强和改进该项工作的具体措施。

Does Quality Still Pay? A Reexamination of the Relationship Between Effective Quality Management and Firm Performance

Because of the changing competitive environment, quality might have lost some of its luster and emphasis in business. The research question we aim to address in this paper is: Does quality still pay in the new competitive environment? Using replication research, we re‐examine the impact of an effective total quality management (TQM) program on a firm's operating performance in the new competitive environment. We use publicly available data for award‐winning firms and adopt several control‐firm‐selection approaches in our event study. Based on data from more than 500 firms, we find that over a 10‐year period—6 years before to 3 years after winning their first quality award—firms in our sample perform significantly better than control groups in various operating performance measures. Not only do award‐winning firms have better results after receiving awards, they also have superior performance records before the award. Our results suggest that quality is still critical to achieving long‐term competitive advantages, and firms who continuously improve their quality continue to reap rewards by way of sales and financial performances exceeding those of their competitors.     

各地人口与计划生育条例奖惩条款的问题研究

《中华人民共和国人口与计划生育法》施行以来,各地修订了原有的人口与计划生育条例,但是在奖励与社会保障对象的界定以及社会抚养费标准的确定、征收办法这两方面还存在问题。对此进行分析并提出相关建议有益于法规的进一步完善。     

我国仲裁裁决的司法审查范围之重构

仲裁的司法监督制度是仲裁监督体系中最为重要的组成部分,也是该体系中最为有效的监督途径。而我国仲裁裁决司法监督机制并没有充分发挥其监督的功能,其中存在的重要问题之一是对仲裁裁决司法审查范围过于宽泛,导致与程序监督模式相悖。因此须重新界定仲裁裁决的审查的范围,这不仅满足了仲裁公正性和终局性的要求,更符合仲裁国际化的趋势。     

职务发明奖酬纠纷解决机制探究

从我国目前司法实践中职务发明专利纠纷来看,因职务发明人或设计人无法从单位获得应得的或者合理的奖励和报酬而引起专利纠纷,严重挫伤了发明人从事发明创造的积极性。基于《专利法》保护发明创造、激励创新之宗旨,发明人或设计人获得奖励和报酬的权利应当受到保护。在《专利法》相关司法解释或者条例中增加相关技术贡献率考量因素、保障发明人享有的信息知情权、引进第三方监督机构等要素,对保护发明人权益、解决职务发明奖酬纠纷、促进我国技术成果的产业化有着重要的作用。
