网络游戏外挂司法犯罪化的刑法规范解读

制售网络游戏外挂行为的司法犯罪化现象越来越普遍,而破坏计算机信息系统安全罪、非法经营罪和侵犯著作权罪是制售网络游戏外挂行为比较固定化的司法定性,但无论从技术的运行特征来看,还是从行为的违法性来分析,制售网络游戏外挂行为很难与现行刑法中某一具体犯罪的构成要件完全相吻合。事实上,网络游戏外挂是一种在未经软件著作权人许可的情况下,对原游戏程序的修改,从而增进游戏功能和效率的行为,而慎重适用刑法规范调整网络游戏外挂现象,既能最大限度实现非刑法制度的规范价值,又能更好地体现刑法保障性规范的谦抑性原则。     

模糊需求下供应链合作博弈的收益分配策略

研究一个由供应商、分销商和零售商组成的三级供应链在模糊需求环境下的合作博弈问题。将市场需求函数中的参数视为三角模糊变量,利用模糊截集理论,建立供应链成员在（S, D, R）型、（S,（D,R））型、（（S,D）,R）型以及（（S,D,R））型等不同情形下的合作博弈模型,并给出模型达到均衡时各参数模糊值的λ水平集。研究结果表明,当供应商、分销商和零售商组成大联盟体时,供应链系统的模糊收益达到最优。为使各成员的模糊收益在大联盟体中均取得改进,采用模糊Shapely值法来分配其模糊收益。最后通过数值算例对模型中的参数进行求解,并给出各成员的具体收益值。

On Myopic Stability Concepts for Hedonic Games

We present a unified look at myopic stability concepts for hedonic games, and discuss the status of the existence problems of stable coalition structures. In particular, we show that contractual strictly core stable coalition structures always exist, and present a sufficient condition for the existence of contractually Nash stable coalition structures on the class of separable games. On the Effect of Risk Aversion in Bimatrix Games

Nash equilibria with identical supports are compared for bimatrix games that are different with respect to the risk aversion of player 2. For equilibria in 2× 2-bimatrix games and for equilibria with efficient supports in coordination games it is established for which cases increased risk aversion of player 2 benefits or hurts player 2.     

On the emptiness of the stability set of order d

We know from Li's theorem (1993) that the stability set of order d may be empty for some preference profiles. However, one may wonder whether such situations are just rare oddities or not. In this paper, we partially answer this question by considering the restrictive case where the number of alternatives is the smallest compatible with an empty stability set. More precisely, we provide an upper bound on the probability for having an empty stability set of order d for the majority game under the Impartial Weak Ordering Culture assumption. This upper bound is already extremely low for small population and tends to zero as the number of individuals goes to infinity.

Five legitimate definitions of correlated equilibrium in games with incomplete information

Aumann's (1987) theorem shows that correlated equilibrium is an expression of Bayesian rationality. We extend this result to games with incomplete information.First, we rely on Harsanyi's (1967) model and represent the underlying multiperson decision problem as a fixed game with imperfect information. We survey four definitions of correlated equilibrium which have appeared in the literature. We show that these definitions are not equivalent to each other. We prove that one of them fits Aumann's framework; the agents normal form correlated equilibrium is an expression of Bayesian rationality in games with incomplete information.We also follow a universal Bayesian approach based on Mertens and Zamir's (1985) construction of the universal beliefs space. Hierarchies of beliefs over independent variables (states of nature) and dependent variables (actions) are then constructed simultaneously. We establish that the universal set of Bayesian solutions satisfies another extension of Aumann's theorem.We get the following corollary: once the types of the players are not fixed by the model, the various definitions of correlated equilibrium previously considered are equivalent.     

On the Owen Set of Transportation Solutions

This paper presents an axiomatic characterization of the Owen set of transportation games. In the characterization we use six properties including consistency (CONS2) and splitting and merging (SM) which are firstly proposed and defined for this setup in the present paper.
