对我国投资银行业发展的思考

国企改革问题是中国经济发展的一大难题 ,投资银行参与企业改造与重组可以在很大程度上解决这一难题 ,为此必须发展我国的投资银行业。本文探讨了我国投资银行业存在的主要问题 ,提出了一些发展对策 ,并指出培养一批中国的投资银行家是发展投资银行业的先决条件。     

基于客户关系对于中资银行开拓海外市场的数学模型分析

在加入WTO后,中国经济得到了更持续高速的发展,中国商业银行体系也得到进一步完善,开拓海外市场成为了中国各商业银行谋求发展和国际化的必然选择。在中国商业银行进军海外市场的过程中,如何构建和管理银行客户间的关系,成为了我国各商业银行突破外国银行业市场壁垒的关键一环。当前正值国际金融风暴席卷全球,为改变中国商业银行体系被动的局面,我国商业银行更应抓住时机大胆开拓海外市场,为我国金融业的国际化进程打下基础。在此通过建立相关数学模型,来证明良好的客户关系对于中资银行开拓海外市场的重要性。     

美国国家银行的宪法学叙事

宪法常常被看做是“全民”的创造,然而从美国宪法的诞生及其政治秩序的演进过程来看,宪法并没有超然于阶级利益之上,也不具有中立性,它不过是利益集团斗争的结果.在经久不息的利益争夺中,货币利益集团始终是至关重要的决定力量.当货币利益集团试图在美国建立一家国家银行时,立即引发了深刻的宪法危机,于是在制宪者之间、在联邦和州之间、在总统和银行之间,都展开了惊心动魄的较量.这场较量主要围绕国家银行的合宪性及其存废、货币主权的归属等问题展开,并对美国政治格局的形成和宪政制度的变迁产生了决定性的影响.     

Measuring Segregation When Units are Small: A Parametric Approach

This article considers the issue of measuring segregation in a population of units that contain few individuals (e.g., establishments, classrooms). When units are small, the usual segregation indices, which are based on sample proportions, are biased. We propose a parametric solution: the probability that an individual within a given unit belongs to the minority is assumed to be distributed as a mixture of Beta distributions. The model can be estimated and indices deduced. Simulations show that this new method performs well compared to existing ones, even in the case of misspecification. An application to residential segregation in France according to parents’ nationalities is then undertaken. This article has online supplementary materials.     

Witness Citizenship: The Place of Villa Grimaldi in Chilean Memory1

The rebuilding of democracy on the former site of a bloody dictatorship continues to be a work in progress in contemporary Chile. Since 1990, the importance of Villa Grimaldi, and other key cultural sites like it, cannot be dismissed as mere sideshows to the “real business” of democratic state‐making.The conversion of a former torture complex to a peace park raises a provocative question both around the function of cultural memory and memorialization: What is the role of a former concentration camp turned memorial park in Chile’s process of democratization? I argue that public memorials like Villa Grimaldi Peace Park can be important complements to the incomplete process of transitional justice in nations that have experienced grave human rights violations. Such sites provide significant forms of sociability, which I call “witness citizenship” (human rights participation, generational transmission, and other forms of civic action) that deepen the reach of democracy, especially in the social spaces where truth commissions and institutional processes have not been able to reach.     

银行卡盗刷案民事责任分析

在现实中银行卡盗刷往往是表现为银行卡并没有离开真正的持卡人,但卡内金额却不翼而飞,由此引发的真正持卡人、银行、犯罪分子之间的纠纷也随之增多。对此类案件,在立法层面没有明确的规定,因此,也给司法审判实践带来了不少问题,出现了"同案不同判"现象。究其原因在于民事责任、举证责任分配等方面出现了问题,故而应从持卡人、银行、犯罪分子三者之间的法律关系入手,从合同法、侵权法、民事诉讼法角度,对三者之间的民事责任承担作出分析。     

法学构建进程中的近代银行法

近代银行立法与研究始于晚清,民国时呈现蓬勃之势,大量银行法译作与专著以及专门的研究团体出现.从法学构成要素来看,近代银行立法较完善,法学研究活动较活跃,政府及民众运用法律调整银行及金融关系意识也越发深入,可以说,近代银行法学趋于形成.但由于缺乏代表性的银行法学著作及法学家,未有系统的法学教育与法学理论,至南京国民政府结束时,近代银行法学终未形成.     

Estimating Risk Assessment Exposure Point Concentrations when the Data Are Not Normal or Lognormal

The U.S. Environmental Protection Agency (EPA) recommends the use of the one-sided 95% upper confidence limit of the arithmetic mean based on either a normal or lognormal distribution for the contaminant (or exposure point) concentration term in the Superfund risk assessment process. When the data are not normal or lognormal this recommended approach may overestimate the exposure point concentration (EPC) and may lead to unecessary cleanup at a hazardous waste site. The EPA concentration term only seems to perform like alternative EPC methods when the data are well fit by a lognormal distribution. Several alternative methods for calculating the EPC are investigated and compared using soil data collected from three hazardous waste sites in Montana, Utah, and Colorado. For data sets that are well fit by a lognormal distribution, values for the Chebychev inequality or the EPA concentration term may be appropriate EPCs. For data sets where the soil concentration data are well fit by gamma distributions, Wong's method may be used for calculating EPCs. The studentized bootstrap-t and Hall's bootstrap-t transformation are recommended for EPC calculation when all distribution fits are poor. If a data set is well fit by a distribution, parametric bootstrap may provide a suitable EPC.
