民商立法若能正确反映市场经济的客观规律和必然条件,构建起和谐的法律体系,必须全面认识和把握市场经济的特质.市场经济即商品经济,它是人类社会不可逾越的经济形态.不同社会历史阶段的市场经济的发展程度不同,但都有着其共同的特质,民商法也即具有相应的共同品格.交换性、多样性、平等性、自愿性、利益性、信用性、知识性、开放性、竞争性和法治性,公开、公正与公平性是市场经济的重要特质和民商法必须具有之品格.     

研究生专业英语教学方法探讨

介绍了研究生专业英语教学的基本要求和目的。结合土木工程系岩土工程、结构工程和工程力学三个专业讲授专业英语的教学实践,阐述了教学过程中所实施的四个要点,教学的方式与方法、考核方法和方式以及教学体会。     

中国国有控股航空运输企业治理结构研究

中国国有航空运输企业进行重组后,形成了以中航、南航、东航集团为首的国有航空运输集团公司,初步建立了国有控股的航空运输企业的现代企业制度。但当前有的国有控股航空运输企业法人治理结构尚不完善,尚未形成清晰的、有约束力的决策机构和执行机构,内部治理制约机制失衡,缺乏严格的风险控制,一些制度流于形式,因管理不善给企业造成了巨额损失。要解决这些问题,必须以深化产权改革为基础,以建立董事委员会为突破口,以健全经营者的激励和约束机制为根本,以创造良好的法人治理的外部环境为保障,以此加快完善国有控股航空运输企业的治理结构。     

关于医疗纠纷法律制度改革的思考

目前我国医疗纠纷法律制度严重滞后,改革呼声日趋高涨。但学界对改什么和如何改的问题缺乏细致深入的研究。本文在对现行医疗纠纷法律制度进行全面评析后,对消除该法内部固有矛盾、改革医疗鉴定体制、完善医疗诉讼程序等方面提出了新的思路与方法。     

The laws of large numbers for Pareto-type random variables with infinite means

In this paper, we consider the laws of large numbers for NSD random variables satisfying Pareto-type distributions with infinite means. Based on the Pareto-Zipf distributions, some weak laws of large numbers for weighted sums of NSD random variables are obtained. Meanwhile, we show that a weak law for Pareto-Zipf distributions cannot be extended to a strong law. Furthermore, based on the two tailed Pareto distribution, a strong law of large numbers for weighed NSD random variables is presented. Our results extend the corresponding earlier ones.     

Defending the Family,Defending the Faith: An Analysis of The Family: A Proclamation to the World,Religious Identity,and the Politics of Same-Sex Marriage in a Mormon Community

In this article, we apply Peter Berger's theory of religion as a social construct to learn how The Church of Jesus Christ of Latter-day Saints (the Mormon Church) advances a heteronormative view of family relationships in the United States using a document titled The Family: A Proclamation to the World. Furthermore, applying cultural studies theory, we examine how believing Mormons negotiate the tension that arises when their secular values compete with those expressed by Church leaders. We argue that, although the Proclamation addresses a number of issues, the Church offers a closed text that emphasizes war narratives in which same-sex marriage is portrayed as a threat to LDS identity and the heteronormative family. This closed text is further legitimized by emphasis on the authority of Church leaders as oracles of God. The study participants largely accept the dominant narrative, and those who reject it, do so with some trepidation.     

Gezi Park and EuroMaidan: social movements at the borders

Both Turkey and Ukraine are located at the external borders of the European Union (EU), and are seen as important partners of the EU, especially in terms of economic relations and strategic partnership. Both countries experienced en masse protest events in 2013: the Gezi Park protests and EuroMaidan, starting, respectively, in May 2013 and November 2013. Although these protests started initially for different reasons – the brutal eviction of a sit-in organized for protecting the trees in Taksim Gezi Park and the Ukrainian government's abandonment of EU trade agreement talks – and seem spatially, temporally and ideologically separate, they both include claims related to a “more just and transparent system”. Such claims are not purely political and are closely linked to a social dimension, especially in terms of local and European space-making. This article aims to understand the importance of Gezi Park and EuroMaidan within the framework of new social movements in terms of space-making and the perception of human rights, democracy, justice, identitarian politics and consensual social relations as Euro-concepts or European ideals.

试论公司契约理论在我国新《公司法》中的体现

公司是由当事人之间的契约组成的,在对公司进行法律规范的时候,应当让契约自由精神贯穿始终。我国2005年新修订的《公司法》蕴涵了公司契约理论,这一理论在我国《公司法》中得以体现具有重要意义。     

立陶宛《能源法》及其对我国能源立法的启示

我国在能源法治建设方面相对滞后,在《能源法》起草过程中广泛借鉴和合理移植国外先进和有益的立法经验已经成为共识。虽然立陶宛在能源和能源资源状况以及能源产业和能源消费结构方面与我国差异明显,但2002年立陶宛《能源法》在处理能源领域基本法与特别法关系以及若干具体制度方面仍然对我国《能源法》的起草具有一定的借鉴意义。
