论土地承包经营权的物权性质及其法律保护——《物权法》出台后对土地承包经营权相关问题的再思考

土地承包经营权物权化会引起许多矛盾和冲突，立法应提供相应的解决方案。要使土地承包经营权制度健康发展，必须进一步完善集体土地所有权制度，必须明确规定土地承包经营权的权能，必须为其提供通畅的救济渠道。另外，针对土地承包经营权不可克服的弊端，法律上应当提供复数的农地经营模式以供农民根据实际情况选择。     

Syndicalisme et délitement du salariat artistique : la CGT et les groupes mobilisés autour du régime de l’intermittence

In a context of strong growth and intense social struggles related to the employment conditions of media industry worker on short-term contracts in France, attention is drawn to the difficulties that the Confédération générale du travail (CGT) has had organizing performers and stage hands in show business (cinema, theater, etc.). This labor union must deal with a large number of young professionals who pay no mind to the rules and norms related to wage-earning and no longer consider them to be a common good. Working in small groups that produce shows, these professionals regard their occupation as a vocation, value the hyperflexibility of their working conditions, pay scant attention to the distinction between employer and employees, and tend to deny the specific characteristics of their jobs and skills while referring, instead, to a blurry set of qualifications.

著作权集体管理这一具有内在优势功能的管理模式在我国一直备受争议,这与其管理中存在的瑕疵有关系,包括管理主体定位不明、管理方式行政管制色彩太浓、管理内容过于单一。因此,在管理主体上以音集协为主,在管理方式上充分实行协商机制,在管理内容上实行科学多元化,这样著作权集体管理的利益平衡的内在功能一定可以发挥出其最大的制度优势。     

浅析海州五大宫调的结构形态和艺术特色

海州五大宫调是流传在江苏海州一带（今连云港市及周边地区）以[软平]、[叠落]、[鹂调]、[波扬]五个曲牌为主要内容的一种古老的民间音乐演唱形式。是明清俗曲在江苏的重要一支,2006年5月被国务院批准进入国家级非物质文化遗产名录。它分为大调和小调两类,在演唱形式上又分为单支和套曲。套曲中的一种为集曲,堪称我国民间音乐的绝唱。它具有自娱自乐、南北交汇和雅俗和谐等鲜明的艺术特色。     

农村集体经济组织的研究回顾与前瞻

既有研究可分两大块:一是关于农业集体化时期农村集体经济组织的历史变迁及其成败得失;二是关于改革开放后农业双层经营体制下农村集体经济组织的改革与完善.尽管现有研究成果丰硕,但亦存在诸如法学视角的分析较为欠缺,未对新时期农村集体经济组织的法律内涵、功能定位和法律形态等加以清晰界定和系统审视等问题.对此,须加强法学视角的研究,在系统审视农村集体经济组织的历史变迁及其法制建设状况的基础上,围绕农村双层经营体制的完善,就农村集体经济组织的法律内涵、功能定位及其法律形态等加以系统思考,提出全局性的改革方案.     

'一业一会'还是'一业多会'？————基于行业协会集体物品供给的比较研究

“一业一会”制度与行业协会最优规模的联合约束限制了行业协会数量以及协会内可以容纳的会员数,从而影响集体物品的供给与消费。但是,取消“一业一会”制度可能引发行业协会运行逻辑的转变,进而导致行业协会最优规模缩小以及选择性供给行业性集体物品,从而加剧行业利益代表的碎片化,弱化行业自律,影响行业协会追求行业整体利益的能力。因此,在取消“一业一会”制度时,应基于行业协会运行逻辑的转变,建构行业协会体系与内部均衡机制,防范行业协会集体物品供给出现异化。

From Wallflowers to Lonely Trees: Divorced Ultra-Orthodox Women in Israel

The issue of divorced women in the Israeli ultra-Orthodox Jewish community represents an important case in the study of divorced women in religious collective cultures. The unique nature of the ultra-Orthodox Israeli community, dealing with questions of segregation and internalization, conservatism and modernity, as well as inequality of women, might contribute to our understanding of divorcees in such cultures. This article sheds light on the internal process that divorced women undergo. Sixty-one phenomenological in-depth interviews were conducted with 4 groups (divorced women, divorced men, daughters of divorced parents, and professionals who deal with divorce with the ultra-Orthodox community). Results show a distinctive process of individuation that these women undertake, reflecting a fundamental tension between their inner individual perceptions and collective cultural norms. Conclusions suggest that divorced women in collective cultures are able to perform antinormative acts and still find a complex, dualistic way to be integral members of their communities.     

Brody always on my mind: the mental mapping of a Jewish city

Once overwhelmingly inhabited by Jews, the Austro-Galician border town of Brody, in present-day Western Ukraine, has retained an important place on Ashkenazi mental maps until today, even though scholarly studies on Brody are scarce. The present article tries to capture the elements that allowed Brody to inscribe itself so successfully in Jewish memory. Therefore, this paper analyses several lieux de mémoire underlining Brody's enduring perception as a town closely related to Jewish issues. These places, however, are not only physical spots in the cityscape, like the ruins of the synagogue and the cemetery, but also images of and texts about Brody. Whether intended or not, pictures and postcards also have an impact on how Brody has been remembered; and so do memory books, be they written in Yiddish, Hebrew, Polish or Ukrainian. This study argues that Brody appears on the mental maps of Eastern European Jewry as an amalgam of physical places, icons and texts linked to a multi-layered and multifaceted urban history
