论新破产法中债权表的异议诉讼——新破产法第58条之解析

破产债权的审查和确认关系到破产企业债权人的根本利益，在这个过程中容易出现纠纷。新破产法就此设置了破产债权表的异议诉讼制度，但是规定得过于抽象。依据相关法条，在债权表的异议诉讼中原告和被告都难以确定。基于此，重点分析了新破产法第58条，并根据破产法一般原理得出结论：债权人对债权表的异议诉讼应以自己为原告、以破产管理人为被告；债务人对债权表的异议诉讼可以转化为债权人的异议诉讼。

A metadata approach to statistical query processing

Concerning the task of integrating census and survey data from different sources as it is carried out by supranational statistical agencies, a formal metadata approach is investigated which supports data integration and table processing simultaneously. To this end, a metadata model is devised such that statistical query processing is accomplished by means of symbolic reasoning on machine-readable, operative metadata. As in databases, statistical queries are stated as formal expressions specifying declaratively what the intended output is; the operations necessary to retrieve appropriate available source data and to aggregate source data into the requested macrodata are derived mechanically. Using simple mathematics, this paper focuses particularly on the metadata model devised to harmonize semantically related data sources as well as the table model providing the principal data structure of the proposed system. Only an outline of the general design of a statistical information system based on the proposed metadata model is given and the state of development is summarized briefly.

On the Use of a Log-Rate Model for Survey-Weighted Categorical Data

For the analysis of survey-weighted categorical data, one recommended method of analysis is a log-rate model. For each cell in a contingency table, the survey weights are averaged across subjects and incorporated into an offset for a loglinear model. Supposedly, one can then proceed with the analysis of unweighted observed cell counts. We provide theoretical and simulation-based evidence to show that the log-rate analysis is not an effective statistical analysis method and should not be used in general. The root of the problem is in its failure to properly account for variability in the individual weights within cells of a contingency table. This results in goodness-of-fit tests that have higher-than-nominal error rates and confidence intervals for odds ratios that have lower-than-nominal coverage.

To assess the efficacy of a treatment, patients are administered a pre-test, the treatment, and a post-test (identical to the pre-test).
