研发过程中知识产权风险的控制

企业知识产权包括商标、专利和著作权等，它是企业重要的无形资产。目前，国内大多数企业还不够重视企业的知识产权保护，尤其是专利保护。在研发过程中的专利申请及保护不及时、不到位，导致企业从项目研发到市场占有的整个过程蒙受巨大风险。从知识产权保护角度，探讨了企业研发过程中有关风险的防范措施。     

美国联邦官僚系统的自主性和政治控制

在美国的多元政治体制下,其联邦官僚系统保持着一定程度的自主性。与之同时,又接受着来自国会、总统和社会利益集团等多种政治主体的影响和控制,形成"一仆二主"乃至"一仆多主"的现象。基于美国的民主原则,美国联邦官僚系统必须回应来自政治系统的意愿和利益要求,接受其监督,同时凭借自身的专业技术能力及其他职业性资源,又保持着相对独立性,呈现出美国政治中特有的政治行政关系结构和特征。     

Optimal control strategies for dividend payments and capital injections in compound Markov binomial risk model with penalties for deficits

We consider the compound Markov binomial risk model. The company controls the amount of dividends paid to the shareholders as well as the capital injections in order to maximize the cumulative expected discounted dividends minus the discounted capital injections and the discounted penalties for deficits prior to ruin. We show that the optimal value function is the unique solution of an HJB equation, and the optimal control strategy is a two-barriers strategy given the current state of the Markov chain. We obtain some properties of the optimal strategy and the optimal condition for ruining the company. We offer a high-efficiency algorithm for obtaining the optimal strategy and the optimal value function. In addition, we also discuss the optimal control problem under a restriction of bounded dividend rates. Numerical results are provided to illustrate the algorithm and the impact of the penalties.

现代社会是权利的社会,也是权利冲突频发的社会。权利之间的冲突缘起于法律规则的模糊性、权利的滥用和权利的交互性。其实质是一种客观存在的事实而非理论预设和逻辑分析的结果。权利冲突可以大致界分为主体间的权利冲突、价值冲突、利益冲突三种类型;权利间的冲突需要借助社会控制模式(个人控制、组织控制、法律控制)并通过价值平衡方法来解决。     

Building up Resilience in a Pharmaceutical Supply Chain through Inventory,Dual Sourcing and Agility Capacity

This paper is inspired by a risk management problem faced by a leading pharmaceutical company. Key operational risk mitigation measures include Risk Mitigation Inventory (RMI), Dual Sourcing and Agility Capacity. We study the relationship between these three measures by modeling the drug manufacturing firm that is exposed to supply chain disruption risk. The firm determines optimal RMI levels for assumed Dual Sourcing and Agility Capacity. We quantify the decrease in RMI levels in the presence of Dual Sourcing and Agility Capacity. Furthermore, using an example, we analyze RMI, Dual Sourcing and Agility Capacity decisions jointly. It turns out that RMI and Agility Capacity can be substitutes as long as no Dual Source is available. Once the Dual Source is available, Agility Capacity and Dual Sourcing appear to be substitutes. We further show that for long disruption times, the optimal Dual Source production rate may decrease in the disruption time. Within our modeling framework, we introduce an operational metric that quantifies Supply Chain Resilience. Supply chain disruptions can have a severe business impact and need to be managed appropriately.     

The effect of cognitive diversity on the illusion of control bias in strategic decisions: An experimental investigation

By integrating cognitive diversity into debiasing literature, this paper contributes towards opening the black box of executive judgment. Based on information processing theory we investigate the role of cognitive diversity in strategic decision making. We apply a vignette-based experimental research design to examine the effect of cognitive diversity in teams on decision maker's illusion of control. The results of these experiments provide evidence for a positive influence of high cognitive diversity for debiasing judgment while similarly indicating no such effect for groups with low cognitive diversity. These findings suggest that group composition aspects can play an important role for improving judgment in decision making teams and open promising new avenues for studying debiasing in behavioral strategy research.     

Multiple comparisons of exponential location parameters with a control based on doubly censored sample under heteroscedasticity

In this article, a one-sample procedure for multiple comparisons of exponential location parameters with a control under heteroscedasticity is proposed. The observations are obtained by doubly censored samples. A one-sided and two-sided confidence intervals are used to perform such multiple comparisons. Statistical tables of critical values and an example of comparing four drugs in treating leukemia are provided.     

The Value of Information in Decision‐Analytic Modeling for Malaria Vector Control in East Africa

Decision analysis tools and mathematical modeling are increasingly emphasized in malaria control programs worldwide to improve resource allocation and address ongoing challenges with sustainability. However, such tools require substantial scientific evidence, which is costly to acquire. The value of information (VOI) has been proposed as a metric for gauging the value of reduced model uncertainty. We apply this concept to an evidenced‐based Malaria Decision Analysis Support Tool (MDAST) designed for application in East Africa. In developing MDAST, substantial gaps in the scientific evidence base were identified regarding insecticide resistance in malaria vector control and the effectiveness of alternative mosquito control approaches, including larviciding. We identify four entomological parameters in the model (two for insecticide resistance and two for larviciding) that involve high levels of uncertainty and to which outputs in MDAST are sensitive. We estimate and compare a VOI for combinations of these parameters in evaluating three policy alternatives relative to a status quo policy. We find having perfect information on the uncertain parameters could improve program net benefits by up to 5–21%, with the highest VOI associated with jointly eliminating uncertainty about reproductive speed of malaria‐transmitting mosquitoes and initial efficacy of larviciding at reducing the emergence of new adult mosquitoes. Future research on parameter uncertainty in decision analysis of malaria control policy should investigate the VOI with respect to other aspects of malaria transmission (such as antimalarial resistance), the costs of reducing uncertainty in these parameters, and the extent to which imperfect information about these parameters can improve payoffs.     

Sociology and the European Court of Human Rights

This article offers a sociological analysis of the jurisprudence of the European Court of Human Rights (ECtHR). Adopting a sociological jurisprudence approach, the article aims to demonstrate the unique and valuable contribution that sociology can make to understanding key aspects of international human rights law. Whilst the article seeks to develop an agenda for critical sociological research on human rights law, it also aims to persuade those charged with the supervision of human rights of the value of sociological analysis. To achieve this, the article focuses on three separate but inter‐related aspects of ECtHR jurisprudence: first, it considers the ECtHR's approach to consensus in its adjudication of human rights complaints; second, it examines the social control implications of the ECtHR's decisions and judgments; and third, it assesses how conceptualizations of social identity are often foundational to the ECtHR's reasoning.     

The Cat and the Cloud: ACT for LGBT Locus of Control,Responsibility, and Acceptance

Advocating acceptance, committed action, and value-guided behavior over experiential avoidance, Acceptance and Commitment Therapy (ACT) may aid lesbian, gay, bisexual and transgender (LGBT) clients affected by hetero/homonormative social pressure. By conceptualizing LGBT paradigms of internal/external control/responsibility (IC-IR; EC-IR; IC-ER; EC-IR), ACT may be adapted to a myriad of multicultural worldviews. This article presents locus of acceptance as the attributed worth of internal/external cues perceived necessary by the client to achieve self-acceptance. Recognizing visibility and isolation as recurrent LGBT issues, locus of acceptances balances identity as individual (internal acceptance) with identity as community (external acceptance).
