The 17-Year-Old Child

SUMMARY

Recently enacted EU-legislation will affect interferences with the sexual life of adolescents across Europe in an intensity so far not known in any of the European states. The “Framework-Directive on combating sexual exploitation of children and child-pornography” will oblige all member States of the European Union to create extensive offences of “child”-pornography and “child”-prostitution, defining as “child” every person up to 18 years of age, without differentiating between five-year-old children and 17-year-old juveniles. These offences go far beyond combating child pornography and child prostitution, thus making a wide variety of adolescent sexual behaviour, hitherto completely legal in the overwhelming majority of jurisdictions in Europe, serious crimes; for instance: sex between 16-year-olds for “remuneration”, which includes invitations to cinema or to a dinner; “lascivious” drawings of a 17-year-old girl possessed by a 15-year-old boy; photographs of a 16 year-old girl in her bikini “lasciviously” exposing her pubic area, taken by her 17-year-old boyfriend on the beach; standard pornography involving younger looking 20-year-old adults or “webcam-sex” between 17-year-old-adolescents; even pictures of one's own adult spouse in “lascivious” poses, if this spouse looks younger than 18. No European jurisdiction so far has such a restrictive law. The massive criminalisation and the equation of adolescents with children caused heavy criticisms among experts but this criticism could not prevent the project from becoming law. This essay provides an analysis of the background, the legislative process and the content of the EU-Framework-Decision.

正义问题是当代政治哲学的核心问题.70年代以来,西方马克思主义者围绕马克思是否谴责资本主义非正义展开了争论.英国新左派、分析马克思主义的主要代表诺曼.杰拉斯是这场争论的一个主要论者.他凭借分析主义的研究方法对马克思主义的正义观和道德观进行了深入系统的研究,用文本证明马克思确实依据超历史的正义原则谴责资本主义非正义,由此构筑起一套马克思主义正义观体系,成为西方马克思主义政治哲学的主要理论代表之一.杰拉斯对马克思正义思想的阐释,对于我们了解和学习分析马克思主义理论家的文本解读方法和思路,反思西方新自由主义政治哲学的局限性,挖掘马克思与正义问题的争论对于我们构建公平正义的社会主义和谐社会具有理论借鉴意义和价值.     

中国能源矿产开采路径与最优开采路径相悖原因

中国能源矿产开采量逐年递增, 与可耗竭资源最优配置理论模型中的最优开采路径相背离。为探究理论与实际相悖的原因, 运用逆向思维的方式, 从中国实际情况出发, 寻求能源矿产供给的影响因素, 试图得出理论最优开采路径与中国实际开采路径相悖的原因, 并运用计量经济学的方法, 进行实证检验。研究结果显示:中国能源矿产供给与价格指数相关性不显著与可耗竭资源最优配置理论假设相悖;中国能源矿产供给尚未到达峰值的事实与可耗竭资源最优配置目标相悖。     

A Case Study Approach to Reducing the Risks of Child Sexual Exploitation (CSE)

ABSTRACT

The risk of child sexual exploitation is a growing concern, both within community and child care settings. Within community services working with vulnerable young people, the risks of exploitation are pervasive and present a constant management problem for professionals. This makes the need for focused educational interventions within such settings all the more vital. This case study aims to describe the assessment, formulation, intervention, and outcomes of a young female considered to be at risk of sexual exploitation. It was hypothesised that, after completion of a psychoeducational group designed to enhance knowledge and skills around child sexual exploitation, positive outcomes would be seen in psychometric assessment, risk-taking behavior, and risk awareness. Results demonstrated no clinically significant change for measures of impulsivity, resourcefulness, or self-reported difficulties. A significant increase was seen for self-reported self-esteem, and all outcomes revealed a positive direction of change. Observational accounts of behavioral and attitudinal change produced more positive results, revealing an increase in prosocial behaviors and a reduction in risk-taking behaviors. Outcomes are discussed in relation to the individual’s history and the residential care environment. Implications for future research and practice are outlined, and the study limitations are considered.     

Not at Home in the Empire

ABSTRACT

The distaste for the work of a colonial official, so clearly expressed in George Orwell's 'Shooting an Elephant', is often seen as reflecting a straightforward liberal commitment to freedom. This interpretation misrepresents both Orwell's standpoint and the character of liberal political reason. As a doctrine of government, liberalism is indeed committed to ruling over, and as far as possible to ruling through, the activities of free individuals. But it has also taken the view that substantial portions of humanity consist of individuals who are not -- or not yet -- capable of acting in a suitably autonomous fashion. This view results in a division of the world into settings in which individuals can normally be trusted to conduct themselves as autonomous rational agents and other settings in which they cannot be trusted to behave in this fashion. Examination of the consequences of this view for the practice of colonial government suggests a different interpretation of Orwell's account: it reflects a cultivated liberal's distaste, on the one hand, for working with and living among people he clearly regarded as inferior and, on the other, for the dirty work of paternalistic rule. A short concluding section considers the post-colonial liberal condition.
