新《刑事诉讼法》中的没收违法所得程序释评

2012年新修订的《刑事诉讼法》增加规定了"犯罪嫌疑人、被告人逃匿、死亡案件违法所得的没收程序",对于符合一定条件的犯罪嫌疑人、被告人逃匿、死亡案件,在不对人定罪的情况下,单独对违法所得予以没收,顺应了我国反腐、反恐的形势需要,完善了这方面的刑事诉讼立法。新刑诉法以四个条文规定了没收所得违法程序,分别为程序的启动、受理及公告、审理及裁定、回转,但新刑诉法对于该程序的案件范围和证据制度等方面需要完善。     

论督促程序与诉讼程序的相互转换

对庭前诉讼程序转督促程序的制度进行分析,对其程序转换的合理性提出质疑,认为目前的制度转换不具备正当性基础,会使后续程序中很多问题无法解决,提出引入法官释明制度对其进行修正;肯定督促程序与诉讼程序的衔接,并就后续制度细节提出完善意见。     

Multistage methodologies for comparing several treatments with a control

We consider the problem of constructing a set of fixed-width simultaneous confidence intervals for the treatment-control differences of means for several independent normal populations with a common unknown variance. Taking c observations from the control population instead of the usual vector-at-a-time approach, purely sequential estimation methodology is developed and asymptotic second-order characteristics are provided. Brief remarks on the accelerated sequential and three-stage methodologies have been added. Next, with the help of simulations, performances of the purely sequential, accelerated sequential and three-stage estimation techniques are compared. Overall, the second-order asymptotics are found to provide useful approximations even for moderate sample sizes.     

检察机关职务犯罪侦查工作模式研究

2013年1月开始正式施行的新刑诉法在证据制度、辩护制度、侦查措施等方面对检察机关的职务犯罪侦查工作提出了更高的要求。故为推动我国检察事业的健康发展,有必要在深入分析新刑诉法相关规定及其对职务犯罪侦查工作影响的基础上,结合新旧刑诉法衔接阶段的自侦实务,做好对检察机关现有工作模式的相应调整。     

由“彭宇案”看裁判诚信与依良心审判——兼谈《民诉法》第13条第1款对法院和法官的适用性

＂彭宇案＂折射了社会的诚信危机和对裁判诚信的期待。《民诉法》第13条第1款诚信原则对法院和法官的＂适用性＂,包括法律宣示意义上的间接适用与裁判援引意义上的直接适用：前者毋庸置疑但不宜滥用,后者看似很美然功能有限。裁判诚信要求依法尽职裁判、禁止突袭裁判和不得滥用自由裁量权;民诉法诚信原则条款对法院和法官具有诚信引导、解决民诉法＂体系违反＂、衡平各方诉讼利益、事后惩戒等功能。裁判诚信的本质,是依照法律和程序,在遵循法律原则适用即衡平方法前提下的依良心审判。     

非正常撤诉--行政诉讼中的法律规避

撤诉是行政诉讼中的一种常见现象,实践中行政诉讼撤诉率居高不下乃是非正常撤诉大量增加所致,而非正常撤诉大量增加是当事人规避行政诉讼高昂诉讼成本的"理性"选择.分析行政诉讼的成本构成及其对当事人撤诉的影响,可以得出这样的结论,要减少非正常撤诉这一法律规避现象,就必须树立新的诉讼观念,改革现行的诉讼制度.     

Mixed Graphical Model Selection Using Holm's Procedure

The problem of selecting a graphical model is considered as a performing simultaneously multiple tests. The control of the overall Type I error on the selected graph is done using the so famous Holm's procedure. We prove that when we use a consistent edge exclusion test the selected graph is asymptotically equal to the true graph with probability at least equal to a fixed level 1 ? α. This method is then used for the selection of mixed concentration graph models by performing the χ²-edge exclusion test. We also apply the method to two classical examples and to simulated data. We compare the overall error of the selected model with the one obtained using the stepwise method. We establish that the control is better when we use the Holm's procedure.     

Application of Multiple Imputation in Analysis of Data from Clinical Trials with Treatment Related Dropouts

This article develops a functional form of the generalized Poisson regression model that parametrically nests the Poisson and the two well known generalized Poisson regression models (GP-1 and GP-2). The proposed model is applied on the Malaysian motor insurance claim count data.     

Operating Characteristics of a Subset Selection Procedure Applied to a Hybrid Randomized Response Model

The operating characteristics (OCs) of a subset ranking and selection procedure are derived for the hybrid randomized response model developed by Jia and McDonald (2009 Jia, F., McDonald, G. (2009). Analyzing hybrid randomized response data with a binomial selection procedure. Commun. Statist. Theor. Meth. 38:784807.[Taylor & Francis Online], [Web of Science ®] , [Google Scholar]). The OCs include the probability of a correct P(CS), the individual selection probability γ_i, and the expected subset size E(S), under the slippage configuration or the equi-spaced configuration. An example comparing failure rates of contraceptive methods is used to illustrate the use of these new results.     

Bonferroni-type Plug-in Procedure Controlling Generalized Familywise Error Rate

Consider the multiple hypotheses testing problem controlling the generalized familywise error rate k-FWER, the probability of at least k false rejections. We propose a plug-in procedure based on the estimation of the number of true null hypotheses. Under the independence assumption of the p-values corresponding to the true null hypotheses, we first introduce the least favorable configuration (LFC) of k-FWER for Bonferroni-type plug-in procedure, then we construct a plug-in k-FWER-controlled procedure based on LFC. For dependent p-values, we establish the asymptotic k-FWER control under some mild conditions. Simulation studies suggest great improvement over generalized Bonferroni test and generalized Holm test.
