土地承包经营权的设立与登记

《物权法》颁布后，我国独特的物权变动立法模式正式确立。《物权法》也首次不区分土地承包经营权的种类而统一规定——在承包合同生效时土地承包经营权设立，这样使得土地承包经营权的物权变动具有特殊之处。通过比较的分析方法发现，由于两种土地承包经营权有着天然的不同之处，其设立的情况也有所不同，所以法律还是需要根据不同的土地承包经营权类型进行不同的法律调整。另外土地承包经营权设立登记的效力在学界也存在着争议，通过案例分析，主张法律应规定赋予土地承包经营权设立登记对抗的效力，同时也应完善细化土地承包经营权的异议登记制度。     

Third-Order Asymptotic Distributions of Classic Test Statistics for One-Parameter Exponential Family Models

ABSTRACT

In this article we derive third-order asymptotic expansions for the non null distribution functions of four classic statistics under a sequence of local alternatives in one-parameter exponential family models. Our results are quite general and cover a wide range of important distributions.     

A Family Therapist's Look Into Interpersonal Neurobiology and the Adolescent Brain: An Interview With Dr Daniel Siegel

Advances in brain research are increasingly having an impact on clinical interventions in all fields of psychotherapy. For adolescent family therapists it is important not only to understand the developing adolescent brain, but also how brain research can influence interventions aimed at interrupting problematic familial interactions. Interpersonal neurobiology and the ideas of Dr Daniel Siegel synthesise the interpersonal with the scientific, offering practical clinical methods of incorporating the research into everyday practice. This article incorporates a verbatim interview with Dr Siegel about the adolescent brain, interpersonal neurobiology and attachment with an outline of key concepts from interpersonal neurobiology including the hand model of the brain, nine functions of the prefrontal cortex, the triangle of wellbeing and eight domains of integration. Clinical applications are suggested using a common presenting problem of escalating conflict between teenagers and their parents.     

A package of four edited books on structural equations modeling

We consider two analytical and a bootstrap bias correction scheme existing in the literature for maximum likelihood estimators (MLEs) in the special case of a particular biparametric exponential family, the estimators being obtained from i.i.d. samples. We assess the performances of the estimators through numerical simulations for three particular cases of the family explored here. We observe that the two analytical proposals display very similar behavior for these distributions and that all proposed estimators are effective in reducing bias and mean square error of the MLEs.     

Evidence-Based Social Work Practice with Mentally Ill Persons who Abuse Alcohol and Other Drugs

Abstract

The current article outlines a comprehensive approach to evidence-based social work practice, and applies it to persons with severe and persistent mental illness who also abuse alcohol and other drugs. Representative empirical literature is summarized within a framework that delineates the three major functions of evidence-based social work practice: assessment, intervention and evaluation. Assessment protocol, which incorporates the use of valid scales to complement the qualitative interview, is based on domain-specific research that outlines relevant psychosocial risk factors, and highlights those that are amenable to change. Intervention strategies are derived from the growing body of controlled research findings, but flexibility in implementation is recommended to accommodate clients' individual needs and the vagaries of daily practice. Naturalistic evaluation methods are used to capitalize on the use of brief, valid process and outcome measures to augment individual qualitative evaluation and to aggregate data for program evaluation. The implications of this integrated evidence-based strategy for social work practice are discussed.     

The American Way

Media consolidation and convergence have increasingly changed the way individuals as both consumers and citizens access, process, and communicate information at the local, national, and global levels. Media industries and institutions influence public perception and occupy our time at work and at home more and more. Media literacy has become recognized as a twenty-first-century skill necessary for civic competence and the development of informed, responsible citizens. Although it has long been established in the curricula of other nations, it is relatively new in the United States. Media literacy is not simply teaching with media—rather, it entails teaching about media. Key frameworks such as the Text, Audience, and Production (TAP) model, which is explained in this article, can be used to help students systematically analyze and evaluate the wide range of media texts they are exposed to on a daily basis. The author discusses how media literacy is also compatible with several of the major strands identified by the National Council for the Social Studies and can be facilitated by the growing range of resources available to teachers.     

依法治国视野下大学生法治意识培养探析

历史的实践表明＂人治＂是腐朽落后的它阻碍人类社会的发展。党的十七大提出了加快建设社会主义法治国家的奋斗目标。我们在贵州高校进行了800人的抽样统计分析。总体上看大学生的法治意识带有明显的不成熟性和矛盾性。为此,高校法治教育应针对存在的问题采取措施,如转变教育观念、改进教学方式、调整教学内容、提高教学水平等,以引导大学生增强法治意识,对依法治国作出应有的回应。     

Parents' perceptions of their children in a context of shared political uncertainty

The study describes the differences and similarities between parents’ feelings and their perception of their children’s feelings in a politically uncertain situation. The study focuses on Israeli families living in Judaea and Samaria (the West Bank) during two periods: the Intifada and the post‐Oslo Agreements years during the first phase of the peace process with the Palestinians. The research combines qualitative and quantitative methods. The results show that most of the feelings evoked by the uncertainty are negative emotions, such as fear, anger, hate, the desire for revenge, and avoidance. These emotions are experienced by parents and, according to the parents’ perceptions, by their children as well. In addition to the correlation between parents’ own experiences and their appraisal of their children’s, the children were perceived as having more negative feelings than the parents. Systemic analysis of the results indicates that the children are often a channel for expression of their parents’ emotions. Based on this finding, suggestions are made regarding intervention with children that takes family processes into account. Some direction for applying the findings of this specific study in other contexts of shared political uncertainty, such as Northern Ireland, are suggested.
