房屋拆迁中的国有土地使用权补偿是我国城镇房屋拆迁中的主要矛盾点之一。通过对司法判例进行实证研究发现,法院判决多数认为原告诉请国有土地使用权补偿于法无据,抑或认为对于国有土地使用权的补偿已随房屋评估作价。房屋拆迁的重点在于“地”,若仅对房屋所有权人进行补偿,而忽视国有土地使用权人,无疑会引发诸多诉讼,乃至于阻碍城镇化进程。因此,在渐进式改革的背景之下,可以开展国有土地使用权补偿的试点,同时应当完善《国有土地上房屋征收与补偿条例》,并将合理补偿原则作为补偿的基本原则,以此为基础建立一套独立于房屋拆迁补偿的国有土地使用权补偿体系。 相似文献

We propose a procedure to identify a lowest dose having greater effect than a threshold dose under the assumption of monotonicity of dose mean response in dose response test. So, we use statistics based on contrasts among sample means and apply a group sequential procedure to our procedure to identify effectively the dose. If we can identify the dose at an early step in the sequential test, since we can terminate the procedure with a few observations, the procedure is useful from an economical point of view. This study used the social cognitive theory of well‐being (SCTW; Lent, 2004 ) to examine the role of career decision self‐efficacy (CDSE), perceived educational barriers, and independent self‐construal on the life satisfaction of 176 Mexican American college women. A 3‐step hierarchical regression analysis indicated that independent self‐construal, CDSE, and fewer perceived educational barriers significantly predicted greater life satisfaction among Mexican American college women above and beyond the influence of socioeconomic status and generational status. These findings are consistent with SCTW and highlight the need for counselors and researchers to be aware of the role that self‐construal, CDSE, and perceived educational barriers can have on Mexican American women's life satisfaction. Implications for practice at the secondary‐school and university levels are discussed. 相似文献

Abstract. We consider the problem of testing parametric assumptions in an inverse regression model with a convolution‐type operator. An L 2 ‐type goodness‐of‐fit test is proposed which compares the distance between a parametric and a non‐parametric estimate of the regression function. Asymptotic normality of the corresponding test statistic is shown under the null hypothesis and under a general non‐parametric alternative with different rates of convergence in both cases. The feasibility of the proposed test is demonstrated by means of a small simulation study. In particular, the power of the test against certain types of alternative is investigated. Finally, an empirical example is provided, in which the proposed methods are applied to the determination of the shape of the luminosity profile of the elliptical galaxy NGC 5017. 相似文献

Research on the university experience of disabled students has focused on barriers in learning and teaching, while the social world of university has as yet gained little attention as a distinctive object of study. Here we examine social experience and socially imposed restrictions through the lenses of social capital and self-concept. A qualitative study investigated the formation of social capital and changes in self-concept amongst physically disabled Australian university students. Data were collected through semi-structured interviews and analysed using a grounded theory approach. The study found weak social attachments at university, but stronger attachments outside. Self-concept did not appear to be structured in any direct way by university-generated social capital, partly as a consequence of its weakness. 相似文献

The paper examines changes in the influence of family background, including socioeconomic and social background variables on educational attainment in Australia for cohorts born between 1890 and 1982. We test hypotheses from modernization theory on sibling data using random effects models and find: (i) substantial declines in the influence of family background on educational attainment (indicated by the sibling intraclass correlations); (ii) declines in the effects of both economic and cultural socioeconomic background variables; (iii) changes in the effects of some social background variables (e.g., family size); (iv) and declines in the extent that socioeconomic and social background factors account for variation in educational attainment. Unmeasured family background factors are more important, and proportionally increasingly so, for educational attainment than the measured socioeconomic and social background factors analyzed. Fixed effects models showed steeper declines in the effects of socioeconomic background variables than in standard analyses suggesting that unmeasured family factors associated with socioeconomic background obscure the full extent of the decline. 相似文献
