个人信息保护与刑法干预的正当性——兼评《刑法修正案（七）》第七条

相对于国家信息与社会信息的刑法保护而言,我国个人信息保护尚处于缺失的状态。为了保护公民个人信息安全性,《刑法修正案（七）》增加了对个人信息保护的条款。但是,围绕个人信息保护,引发了众多的争议,如“人肉搜索”是否入罪？鉴于此,我们从刑法干预的正当化根据出发,认为,个人信息安全是刑法介入个人信息保护的价值诉求,进而对个人信息刑法保护提出了建设性的构想。

对运用表面光电压技术(SPS)对半导体材料光电性质的研究进行了综述,系统阐述了表面光电压谱(SPS)和场诱导表面光电压谱(FISPS)在测定半导体类型、表面态及其能级位置、表面电荷分布、半导体的能带隙等方面所表现出的优越性质.研究了半导体能带隙所表现出的特有性质.     

Nonparametric and semiparametric estimation of the three way receiver operating characteristic surface

In many situations the diagnostic decision is not limited to a binary choice. Binary statistical tools such as receiver operating characteristic (ROC) curve and area under the ROC curve (AUC) need to be expanded to address three-category classification problem. Previous authors have suggest various ways to model the extension of AUC but not the ROC surface. Only simple parametric approaches are proposed for modeling the ROC measure under the assumption that test results all follow normal distributions. We study the estimation methods of three-dimensional ROC surfaces with nonparametric and semiparametric estimators. Asymptotical results are provided as a basis for statistical inference. Simulation studies are performed to assess the validity of our proposed methods in finite samples. We consider an Alzheimer's disease example from a clinical study in the US as an illustration. The nonparametric and semiparametric modelling approaches for the three way ROC analysis can be readily generalized to diagnostic problems with more than three classes.     

Bayesian credible intervals for response surface optima

In response surface methodology, one is usually interested in estimating the optimal conditions based on a small number of experimental runs which are designed to optimally sample the experimental space. Typically, regression models are constructed from the experimental data and interrogated in order to provide a point estimate of the independent variable settings predicted to optimize the response. Unfortunately, these point estimates are rarely accompanied with uncertainty intervals. Though classical frequentist confidence intervals can be constructed for unconstrained quadratic models, higher order, constrained or nonlinear models are often encountered in practice. Existing techniques for constructing uncertainty estimates in such situations have not been implemented widely, due in part to the need to set adjustable parameters or because of limited or difficult applicability to constrained or nonlinear problems. To address these limitations a Bayesian method of determining credible intervals for response surface optima was developed. The approach shows good coverage probabilities on two test problems, is straightforward to implement and is readily applicable to the kind of constrained and/or nonlinear problems that frequently appear in practice.

Three-group ROC predictive analysis for ordinal outcomes

Measuring the accuracy of diagnostic tests is crucial in many application areas including medicine, machine learning, and credit scoring. The receiver operating characteristic (ROC) surface is a useful tool to assess the ability of a diagnostic test to discriminate among three-ordered classes or groups. In this article, nonparametric predictive inference (NPI) for three-group ROC analysis for ordinal outcomes is presented. NPI is a frequentist statistical method that is explicitly aimed at using few modeling assumptions, enabled through the use of lower and upper probabilities to quantify uncertainty. This article also includes results on the volumes under the ROC surfaces and consideration of the choice of decision thresholds for the diagnosis. Two examples are provided to illustrate our method.     

The Scalability of the Shack/Slum Dwellers International Methodology: Context and Constraint in Cape Town

Shack/Slum Dwellers International (SDI) was created by the Indian Alliance and South African partners. SDI has affiliates in 33 countries and is probably the world's largest network of community peer‐to‐peer knowledge exchange in the area of slum/informal settlement upgrading. Common to the Indian Alliance's ‘Federation Model’ and the SDI methodology are a commitment to community organization and community‐led upgrading that is undertaken in partnership with local government. In a context where it is projected that there will be two billion slum dwellers by 2030, the ambition is to enable tens of millions of households to obtain upgraded housing and services. This article questions the scalability and universality of the SDI methodology in Cape Town, where the SDI Secretariat is located.     

Interpreting conflict and integration through the reciprocity lens: mobility and settlement in a historical perspective on the Sierra Leonean coast

ABSTRACT

In recent years, Sierra Leone has witnessed intense population movements. During the civil war (1991–2002), many populations fled the fighting zones of the interior to take refuge on the coast. Since the conflict ended, new populations have reached the coastal area with the hope of accessing economic opportunities in the fishing business. Mobility, along with changing sociopolitical and economic conditions, has generated conflict between immigrants and Sherbro populations, who consider themselves autochthonous and deny migrants the freedom to access political and land rights. The paper argues that present dynamics of conflicts are rooted in long-term patterns of settlement and relationships of reciprocity between groups. Relations between migrants and local populations are grounded in a sociocultural idiom that implies the institutionalization of practices of reciprocity between local inhabitants (hosts) and later settlers (strangers). The host/stranger reciprocity system is an emic model of cultural action embedded in historical and power relations between groups. It implies the progressive integration of strangers into the host society. This paper highlights how, in a situation of conflict, long-established social relationships between groups are reevaluated with reference to norms of integration and reciprocity. The paper draws on Sherbro oral traditions to show how social memories about interethnic relations are reframed with reference to values and expectations of reciprocity, in order to explain the recent conflict that opposes Sherbros to immigrants. Sherbros use oral traditions to interpret these tensions in a long-term perspective, thereby expressing their own view on settlement, conflict and integration.
