《侵权责任法》第87条对侵权人不明的高楼落物侵权责任的承担进行了规定,具有保障受害人得到补偿、统一司法实践、降低致害概率的积极意义。但是,该规定也存在许多不足之处,主要表现为不利于社会和谐、容易引发道德风险、预防功能不充分、适用前提不明确等,没有很好地解决高楼落物侵权所面临的困境。采取社会救济、高楼落物赔偿基金、保险赔偿等多种途径相结合的救济方式,行政法、刑法与《侵权责任法》相配合的惩罚制度,不仅可以使受害人得到及时的、充分的补偿,而且可以有效预防此类侵权损害的发生。  相似文献

We establish exponential inequalities for the probability of the distance between the approximated solution and the exact one for a calibration problem. This study compares three variations in how researchers construct middle childhood social networks: (1) with friendships or affiliations as a relational tie; (2) with children providing self reports of relationships, or in addition, multi-informant reports of relationships in which they are not involved; and (3) whether network computation is correlational or distance-based . The sample was 357 fourth- and fifth-grade students in 17 classrooms. The strongest differences were between self-reported friendship and affiliative networks. Results showed that compared with affiliations, friendship networks had smaller groups, more isolates, and lower fall-to-spring stability. Agreement in social placement between friendship and affiliative networks was generally average, but poor for unpopular and aggressive children. Multi-informant affiliative networks were most robust in their positioning of aggressive children. Multi-informant centrality was uniquely uncorrelated with aggression. Network computation differences were not substantial. Discussion focuses on recommendations for research and the educational promise of network technology.  相似文献

ABSTRACT

This article focuses on the professional isolation faced by social group work practitioners and educators. It identifies the need for peer support and connection in an environment of limited opportunities for professional development. The paper describes and assesses long-term peer support groups initiated and developed by each of the authors, one for group work educators and the other for practitioners. It discusses the potential for expanding the development of such groups, which could benefit individual group workers as well as strengthen efforts to ensure the survival of group work.  相似文献

An educational approach to preparing clients for group is a widely held concept delineated throughout the literature and research studies on group work practice. The author is suggesting an important additional component as part of any preparation model, focusing on the client's perceptions, expectations, fantasies and concerns about what it means to be a member of an organized group. This client focused process can have a positive impact on each individual's experience within the group as well as accelerating the formation of group cohesion. Abstract

Objective: To examine the feasibility and initial efficacy of 2 abbreviated dialectical behavior therapy (DBT) skills training groups: emotion regulation skills only and emotion regulation with mindfulness skills. Participants: Participants were 24 undergraduates (aged 18–29) with significant emotion dysregulation who participated between February and May of 2010, 2011, and 2012. Methods: Participants participated in 2-hour weekly group sessions for 8 weeks and completed outcome measures at baseline, midtreatment, posttreatment, and 4-week follow-up. Results: Participants in both conditions made significant gains, with large effect sizes, across measures of emotion regulation, affect, skills use, and functioning. There were no differences between the 2 groups, suggesting no additive benefit of mindfulness skills. Conclusions: This pilot study provides support for the acceptability and efficacy of abbreviated DBT skills training in colleges, given significant improvements, positive feedback, and low attrition. Impediments to feasibility included recruitment difficulties, particularly due to scheduling constraints.  相似文献
