论“公海”定义的分歧及我国的应对策略

《联合国海洋法公约》并未对“公海”下一个明确的定义,这导致了“公海”定义的分歧.美国一直认为领海之外即公海,专属经济区属于公海的一部分.而我国的的立法意图是将专属经济区视为独立于公海的一个特殊海域,但这一理解未必能够得到条约法和习惯法上的支持.我国应在国内立法和双边条约中规定公海的定义,从国家实践和法律确信方面强化公海不包括专属经济区这一意图.     

Bayesian inference for stable Lévy–driven stochastic differential equations with high‐frequency data

In this paper, we consider parametric Bayesian inference for stochastic differential equations driven by a pure‐jump stable Lévy process, which is observed at high frequency. In most cases of practical interest, the likelihood function is not available; hence, we use a quasi‐likelihood and place an associated prior on the unknown parameters. It is shown under regularity conditions that there is a Bernstein–von Mises theorem associated to the posterior. We then develop a Markov chain Monte Carlo algorithm for Bayesian inference, and assisted with theoretical results, we show how to scale Metropolis–Hastings proposals when the frequency of the data grows, in order to prevent the acceptance ratio from going to zero in the large data limit. Our algorithm is presented on numerical examples that help verify our theoretical findings.     

The Complexity of Families Involved in High-Conflict Disputes: A Postseparation Ecological Transactional Framework

The use of the term ‘high conflict’ to describe a wide range of family dynamics after separation and divorce has increased significantly over the years. At the moment, no consensus on the definition of high conflict exists. Lack of definitional clarity hinders the ability for legal and mental health professionals to assess, identify, and effectively intervene with this population. Based on a rapid evidence assessment of 65 empirically based social science studies relevant to high conflict, this article positions high-conflict separation and divorce using an ecological transactional model to better understand risk factors and indicators associated with these families. Authors propose a more comprehensive definition that captures the complexity and interactions of various risk factors and indicators on multiple levels. Positioning high-conflict families using an ecological model identifies several points of intervention professionals can use and the fundamental need for collaboration among stakeholders for effective intervention.     

基于Hawkes因子模型的股价共同跳跃研究

本文首先比较了三种目前主流的共跳检验方法：基于LM检验的共跳检验、BLT共跳检验和FHLL共跳检验,结果表明,三种方法在识别共跳数量上差距明显,但三者结果的重合部分基本属于市场暴涨暴跌行情,说明共跳识别对市场剧烈波动的聚集性较为敏感。基于跳跃、共跳存在的聚集性问题,本文将Hawkes过程引入跳跃和共跳的研究,构建了基于Hawkes过程的因子模型,结果显示,基于Hawkes因子模型的MJ统计量、CJ统计量和实证数据的拟合程度较好,表明因子模型能够更好地描述跳跃和共跳的聚集性。     

网络侵权投诉的平台审核及边界

现行法律规定网络平台侵权投诉（即通知）的形式审查,在机制目的设置上,旨在降低平台实质审查带来的高成本。然而,过于简单的形式审查要件之规定对平台的稳定性与人力审核成本反而提出了更高的要求。为维护平台信息数据的稳定性,平台难免会选择实质审查来减少形式审查所产生的信息波动。这又与网络平台侵权投诉形式审查的宗旨相悖。平台针对不同的权利类型的投诉进行审核,其中最为核心的就是对“构成侵权的初步证明材料”的把握。这个过程是个主观大于客观的自我内心确信。在以高度盖然性为标准的大前提下,网络平台要做的是权利归属的恰当性判断。

从跨文化交际语境出发,根据语境文化对交际模式的影响,探讨日本高语境文化形成的原因,分析在高语境文化影响下日本人以和为贵、集团主义意识强、以心传心的体察式的交际模式,对于提高人文素养,减少跨文化交际中的误解,促进交流都将有着重要的意义。     

Is High Sexual Desire a Risk for Women’s Relationship and Sexual Well-Being?

Historically, women’s sexual desire has been deemed socially problematic. The growing popularity of the concept of hypersexuality—which lists high sexual desire among its core components—poses a risk of re-pathologizing female sexual desire. Data from a 2014 online survey of 2,599 Croatian women aged 18–60 years was used to examine whether high sexual desire is detrimental to women’s relationship and sexual well-being. Based on the highest scores on an indicator of sexual desire, 178 women were classified in the high sexual desire (HSD) group; women who scored higher than one standard deviation above the Hypersexual Disorder Screening Inventory mean were categorized in the hypersexuality (HYP) group (n = 239). Fifty-seven women met the classification criteria for both groups (HYP&HSD). Compared to other groups, the HSD was the most sexually active group. Compared to controls, the HYP and HYP&HSD groups—but not the HSD group—reported significantly more negative consequences associated with their sexuality. Compared to the HYP group, women with HSD reported better sexual function, higher sexual satisfaction, and lower odds of negative behavioral consequences. The findings suggest that, at least among women, hypersexuality should not be conflated with high sexual desire and frequent sexual activity.     

Differential predictors of academic achievement: individual and familial factor interactions with community poverty

We present an analysis of the contexts within which adolescents graduate from high school and enroll in college. Data from the National Longitudinal Study of Adolescent Health show that adolescents’ school engagement, maternal academic monitoring, and community poverty significantly interact to explain differences in high school graduation and college enrollment rates (n?=?7100). To examine this association, we performed weighted logistic regression analyses, controlling for gender, race, block level unemployment, and block level median income. Findings suggest that protective factors can help youth overcome the challenges associated with community poverty and achieve academically in low and medium levels of poverty, but that youth in high-poverty contexts may need more resources to reach higher levels of academic attainment.

基于熵权法的江苏生态环境高质量发展评价研究

针对生态环境内涵的多样性,结合传统高质量发展的评价指标,从环境质量、排放强度、污染治理和资源利用4个维度构建生态环境高质量发展评价指标体系,并基于熵权法提出指标量化和评估数据预处理的解决方案。结果表明:2010—2019年江苏生态环境质量水平由“缓慢增长”向“波动下降”转变,污染治理和资源利用成为改善现阶段生态环境质量的重要突破口,政府、社会、企业、个人等主体可从循环经济、人居环境、水环境综合治理角度进行生态环境的整治。
