商务英语合同中同义词并用的特征及其翻译

研究指出,为了确保准确性和严密性,商务英语合同中存在着同义词并用的现象。根据目的的不同,可以将这些词归纳为两类,即＂求同型同义词＂和＂求异型同义词＂。按照词性的不同,文章进一步将这些词进行分类,并尝试通过例句论证在翻译这些词语时可以采用的策略。     

协动主义下的审理契约论

与诉讼契约有所不同,审理契约之主体范围突破了双方当事人的限制,涵盖了法院。于审理构造而言,审理契约最为重要的就是两造与法官所达成的关于审理计划和争点决定的合意。就诉讼契约的成立与撤回要件、形式、内容及效果等也因种类不同而各异。在协动主义的审理模式下,认可审理契约不仅有助于实现口头辩论的集中化,而且有助于提高审理的计划性,促进审理的高效运营。     

无套利分析在非完美条件下远期合约定价中的运用

无套利分析方法是现代金融理论的基石之一,已成为金融衍生品定价的一种重要方法,传统的金融工程教科书很少涉及非完美条件下远期合约的定价问题。在介绍无套利分析方法的基础上,通过现金流复制技术,研究了三种非完美条件下远期合约的定价问题。

An integrated approach for the electronic contract manufacturer selection problem

In the global competitive environment, lead companies have to outsource their manufacturing to electronic contract manufacturers (ECM) in order to reduce operational cost and capture higher profit. Thus, the process of selecting contract manufacturers to be strategic partners is important for these companies. For this reason, this paper proposes an integrated approach for the electronic contract manufacturer selection problem, combining the voting method and the goal programming (GP) model to take into account quantitative factors involved in the selection process, which is applied to a real-world ECM selection problem encountered by a leading provider of complete broadband access solutions. Results of the case study indicate that the voting method can acquire the rating information quickly from manufacturing managers based on suitable evaluating criteria. The rating information simultaneously incorporates ECMs' performance scores as a weight for each ECM. A production planner can easily employ the GP model and ECMs’ weight information to effectively assign demand quantities to ECMs. Therefore, the integrated approach is a practical and useful tool for solving the contract manufacturer selection problem.     

我国高校毕业生就业协议法律问题研究

毕业生就业协议是用人单位与应届毕业生之间签订的关于未来建立劳动关系的合同,其作用是多元化的。该协议应当属于普通民事合同,与劳动合同存在很大区别。目前,我国仍旧应当保留毕业生就业协议,但它的缺陷也非常明显,因此需要对其从主体、内容、性质和配套措施等方面进行完善。     

论重大自然灾害作为合同免责事由的原因力

重大自然灾害在合同法上被界定为不可抗力，作为法定的免责事由而免除当事人合同不履行的法律责任。但司法实践中却可能存在诸多的因素导致合同不履行，重大自然灾害可能不是唯一的合同不履行的原因，故在重大自然灾害背景下探讨重大自然灾害与合同不履行之间的原因力关系，对司法实践中处理与重大自然灾害有关的合同纠纷案件具有重要的现实意义。     

Helpers “Here on the Front Lines”: Welfare‐to‐Work Managers' Moral Identity Work

Using data drawn from telephone interviews with Ohio Works First program managers (N = 69), we examine managers' moral identity work. This work included using militarized rhetoric to evoke moral identities as honorable workers. It also involved signifying helper/helpful moral identities by defining what it means to be helpful, legitimating their helper identity through connections to caseworkers, and affirming their identity through telling success stories. Additionally, managers implicitly othered clients they viewed as needy and politicians they considered to be out‐of‐touch. Our research contributes to the literature on welfare‐to‐work, but also more broadly to our understanding of moral identity work and implicit othering.     

Unfair to Me or Unfair to My Spouse: Men's and Women's Perceptions of Domestic Equity and How They Relate to Mental and Physical Health

Research examining the relationship between household labor and health has not sufficiently considered perceptions of domestic equity, physical health, or potential gender differences in these relationships. Using survey data from 1,234 lawyers, we examine how perceptions of domestic equity are related to mental and physical health and whether these relationships differ by gender. The results indicate that perceiving the division of household labor as unfair to oneself is related to poorer mental health, whereas perceiving the division as unfair to one's spouse is related to poorer physical health, regardless of gender. This article demonstrates the importance of treating perceptions of unfairness to oneself and one's spouse as distinct experiences, while also considering the wider context wherein these relationships exist.

汉源县城建设项目是移民迁复建项目,在迁建过程中存在规划调整、设计成果不衔接、擅自提高设计标准、实施与规划不一致、实施组织混乱、施工质量低劣等问题,其原因是主要领导的频繁更替使安置思路的连续性受到影响,缺乏有效的设计协调和项目管理计划,前期选择的施工队伍能力低下,监理机构工作不力等.基于上述情况,提出采用设计总承包协调各设计单位工作、提高设计质量,加强项目前期策划工作,制定切实可行的项目管理计划和实施组织计划,促进施工管理的科学化、规范化,实行施工总承包模式,简化地方政府管理难度,保证施工质量的建议.这些建议对于移民迁建中的重大项目具有普遍的借鉴意义.
