《中国建设》对新中国国家形象的构建（1952—1956）

摘　要：《中国建设》杂志坚持实事求是的办刊原则,将宏大叙事与微小叙事相结合,广泛采用新旧对比的写作手法和借助外宾的表达方式,从政权、民生、文化三个层面构建出新中国的国家形象：政府与人民休戚与共、水乳交融的政权形象;百姓生活日益改善、妇女地位不断提升的民生形象;传统文化守正创新、文教事业不断发展的文化形象。其构建新中国国家形象的外宣实践,为新时代对外宣传与国家形象构建工作提供了珍贵的历史经验。     

论中国古代的宗族刑法

中国古代宗族刑法助长群体意识与道德标准入律,忽视公平与正义,破坏国家法治统一,侵犯国家司法权,有违刑法保障人权机能与刑法保护秩序机能。司法实践中,动用“家法”和私刑代替国家司法权、煽动“民愤”等干扰司法活动的现象以及宗派争诉、情胜于法等宗族刑法观,是对国家司法权的挑衅和破坏,其消极作用不言而喻。     

文化差异对国际商务交流活动的影响

通过讨论在不同文化环境下,国际商务活动呈现的差异,从微观的角度分析文化差异在人际交流、商务洽谈、管理风格、商务决策和企业结构等方面对国际商务交流的影响。     

论佘祥林规则

广为人知的佘祥林冤案,折射出我国当前刑事司法的弊端:缺失司法公正理念,不当行使司法权力,刑事法律制度不健全.以佘祥林案为戒,借鉴美国的米兰达规则,构建符合我国国情的佘祥林规则,对于我国的刑事法治是具有重要意义的事情.我们初步设计的余祥林规则为:尊重和保护犯罪嫌疑人、被告人人权;实行无罪推定,告知犯罪嫌疑人在讯问时有权保持沉默;赋予犯罪嫌疑人、被告人及其辩护人更多权利,实现司法正义.     

薛福成与中英梅生私运军火一案的交涉

梅生案是上海、镇江两海关在1891年查获的一起以英国人梅生为首的私运军火案。由于治外法权的存在,该案由上海会审公廨审理,最终的结果是判处梅生九个月监禁。此案显然是重罪轻判,清政府对此判决深为不满,责令当时的驻英大使薛福成就此案与英国外务部进行交涉。经过多次艰难的交涉,梅生最终被驱逐出中国,这在一定程度上维护了中国的尊严,阻止了军火走私的蔓延之势,从而为中国赢得了一个有利的国际、国内环境。     

欧盟知识产权跨界禁令与竞争规则研究

《布鲁塞尔规则》2001年取代了《布鲁塞尔公约》,成为新的欧盟指令来规范相关的跨界国际私法的争议。欧盟委员会2004年针对适用《欧洲经济共同体条约》第81条的规定颁布了配套的指令TTBER和适用这个指令的指南。指令第3条规定了两个协议合作的企业市场份额门槛的认定标准,这个标准取代了过去的分类方法,在欧洲引起广泛的讨论。欧盟知识产权跨界禁令和竞争规则研究,突破了知识产权的地域性原则,完善了知识产权的竞争规则,并提供了相应的法律救济,有助于中国政府指导自己的企业与欧盟开展贸易。     

Through community eyes: the transition of international organizations from community aid to development in postconflict Sierra Leone

Sierra Leone experienced an 11-year civil war, brutalizing its people and destroying its communities. With the cessation of violence, international organizations helped to secure peace, deliver aid and supplies, and, after, assist with development projects. This grounded theory study, which aims to understand the role these organizations played from the viewpoint of community members in 2 communities, posits that community members’ regard of international organizations lessened as their efforts transitioned from securing the peace and relief efforts to aid for development. Highlighted are the successes and challenges of this work and a broad discussion of implications and recommendations.     

LGBTQI-identified human rights defenders: courage in the face of adversity at the United Nations

The role of LGBTQI human rights defenders in the international arena at the United Nations (UN) is a particularly risky and insecure one, especially for those who themselves identify as lesbian, gay, bisexual, transsexual, transgender, two spirit, queer, and intersex (LGBTQI). This article focuses on the anecdotal experiences of LGBTQI-identified human rights defenders and their work at the UN, observed and noted during a research study examining the degree of recognition and legitimacy LGBTQIs have at the UN. Much courage is required on the part of LGBTQI-identified human rights defenders who, while defending others in their communities, themselves face opposition from those within the UN who hold traditional, religious, and culturally based values, as well as a result of state sovereignty and state-sanctioned criminalisation of their gender and sexual diversity.     

Positive and Negative Aspects of Transracial Adoption: An Exploratory Study From Korean Transracial Adoptees' Perspectives

Participants, 92 Korean-born transracial international adoptees, responded to two open-ended questions designed to explore both positive and negative aspects of transracial adoption. Almost all of them reported experiencing both benefits and challenges, suggesting that transracial adoption is more complex than the polarized “success or failure” paradigm that underlies much of the transracial adoption research. Participants described negative features that are consistent with themes in the extant literature, including racism, alienation from their White families and peers, unfamiliarity with Korean culture, and identity confusion. They also described positive aspects that have been less frequently explored, such as greater learning and awareness and advantages of belonging to multiple cultures. Of interest, facets that some adoptees considered to be positive aspects of transracial adoption were considered by others to be negative aspects.     

Replica localization in East Asia: the case of the Asian hedge fund industry

Hedge funds exemplify complex finance in the global economy and are appearing in diverse national settings. One question that follows is whether hedge funds in the Asian region have been localized and exhibit significant differences to their US/UK counterparts or whether there is predominantly one global model. The analysis here point to the importance of what is called replica localization, wherein local control has entailed little deviation from the practices of Anglo-American hedge funds. Evidence generated from databases and interviews confirms the largely equivalent structures and strategies found in the new Asian hedge fund sector. The significance is that a small but growing Asian financial space has been carved out that is funded by Asian capital and managed by Asian elites but matches external models. To further delineate globalized finance, comparative research is needed to determine when and why complex finance is either present or absent outside of Anglo-American economies.
