关于构成侵犯著作权罪应否需要“以营利为目的”的理性思考——兼评《关于办理侵犯知识产权刑事案件适用法律若干问题的意见》中的相关规定

关于构成侵犯著作权罪应否需要"以营利为目的",学界形成了"取消论"和"保留论"两种意见。双方各有一定道理,但是不足之处也很明显。妥当的做法应当是从"批评"和"固守"走向"解释",通过对"以营利为目的"的扩大解释,可以有效规制市场秩序,实现法律效果与社会效果的统一。事实上,新近出台的《关于办理侵犯知识产权刑事案件适用法律若干问题的意见》也采取了这种立场。这体现着对作者利益与公共利益的平衡,对社会进步与人权保障的平衡,以及对著作权法保护与刑法保护的平衡。     

我国司法解释存在的问题及对策

本文介绍了司法解释的含义及功能,认为传统的学术观念应与司法实践相结合;归纳了我国最高人民法院所作的司法解释的特点,指出了存在的问题,并提出了改进的建议。     

What do lesbians do in the daytime? Recover

This paper examines a narrative taken from an ethnographic interview, for the speaker's conversational construction of lesbian and other identities along with ideologized personal history. To tell her story, Marge shifts to the discourse style used in the meetings of addiction recovery groups. She prioritizes the recovery (twelve-step) program's coherence system, structuring her life story in conformity with its terms while narrating a complexly queered identity. Four analyses are given, beginning with a Labovian formal examination and proceeding with a consideration of three types of discourse echoing: interdiscursivity, intratextuality, and manifest intertextuality. This study demonstrates the analytical linking of nonpublic linguistic discourse to social discourses; individual identity construction to social construction (and its coherence systems); and personal history to historical eras. The paper adds the concept of a metalevel complicating action to narrative theory and develops a means of examining intratextuality for critical discourse analysis. It presents a revised view of essentialism for the sociolinguistic study of gender and sexuality.     

论经典诠释与哲学建构之关系——以朱子对《四书》的解释为中心

在中国经典解释传统中,经典文本与解经者的哲学建构之间,存在着既不能分割,而又互为紧张的关系。两者之所以不可分割,是因为中国哲学家常常首先是哲学史家,他们经由古圣先贤及其经典的召唤,而浸润在古典的精神世界之中,他们“回顾性地”为经典作注解,正是他们“展望性的”哲学建构工作的起点。但是,经典文本与解经者之间,又有其紧张性,因为中国哲学家(如本文所研究的朱子)常常抱着他们自己的哲学问题进入经典,以自己的思想叩撞经典作者的心灵,因此,某种“解释的张力”终难以避免。我们可以从孟子学汲取化解两者间张力的方法论灵感:一是尚友古人,与古人对话,进入古人的心魂,这是“对话的”经典诠释法;二是进入古人的时空情境,在古人的脉络中温故而知新,这是“历史的”解释方法。两者交互应用,庶几在经典诠释与哲学建构之间获致动态的平衡。     

Articulations of Same-sex Desire: Lesbian and Gay Male Dating Advertisements

A survey of self and other categorisation in 200 lesbian and gay male dating advertisement texts, taken from current magazines and newspapers, reveals the discursive means by which homosexual advertisers in our corpus commodify and market sexual/self-gendered identities. Detailed analysis of a sub-sample of the advertisements allows us to trace the discourse processes and conventions used in formulating identity in such texts. We interpret these discourse practices in relation to a social critique of gay attitudes, beliefs and lifestyles. The different conventions for self-commodification followed by lesbians and gay men in this survey suggest generalisable differences in sexual stance and cultural identification     

挪用公款“归个人使用”的司法解释与立法解释比较

论题对法释[2001]29号与全国人大常委会《关于刑法第384条第一款的解释》两者的效力关系进行了分析,并对构成挪用公款罪的基本要件、何为“以个人名义”、何为以“个人决定以单位名义”以及对不具有法人资格的私营企业、私营合伙企业归类问题进行了探讨。     

The foundations of econometrics-are there any

The conclusions of alogically consistent economic theory which strictly adheres to Aristotle's axioms of logic are factually true if its sufficient conditions are all factually true. Alternatively, if a conclusion of such a theory is false, then at- least one of its assumptions is false. Unfortunately, the factual truth of sufficient conditions cannot be established because the problem of induction i s impossible t o solve. It is algo true that the falsity of a conclusion cannot be established in the presence of uncertainty. While the philosophy of instrumentalism applied to sufficient and logically consistent explanations may provide useful solutions to immediate practical problems, the principles of simplicity, parsimony and profligacy--all of them requiring conditional deductive arguments--are useless as criteria for model choice.     

孙璋《性理真诠》对“太极”的诠释

孙璋《性理真诠》对于太极的看法有四:一是认为“空”、“无”不能表达“太极”的本性,二是认为理学后儒对太极的诠释在一多、前后、虚实、纯杂等方面互相矛盾,三是认为“太极”既非“空”,亦非“无”,亦非“气”,而是“元质”(即天主创世所用的原初质料),四是认为这种“元质”虽然蕴涵于阴阳二“气”之中,但是阴阳二“气”之消长变化的动机并非来自于“太极”本身,而是来自“天主”。他对太极的看法显示,传教士对于中国文化的解释常常是出于传教的目的和需要,因而这种解释往往不能真正理解中国文化,明末清初借传教契机所推动的中西文化交往从而也始终未能产生真正的对话。     

论合同的解释及漏洞补充

合同解释规则本质上属于裁判规则，构成合同法的重要组成部分。本文论述了合同解释的基础和对象、法官在合同解释中的地位，并结合当今最新立法、司法及法学理论，对合同解释规则给予了全面且较为详细的分析     

《汉语大字典》释义补正

字典、辞书的释义具有稳定性,同时也往往具有一定的保守性、封闭性。作为共同语的地域变体———方言,具有存古性,又有创新性,其词汇则往往可成为字典、辞书编撰的重要参考资料。本文以宜昌方言词为参照,结合文献考察,对《汉语大字典》以及《现代汉语词典》中几个语词的释义进行商讨补正。
