片面实行行为定性研究

刑法中的实行行为包括单一行为和复合行为。在单一行为中,片面实行犯既有共同的犯罪故意,又有参与不知情者所实施之罪的共同行为,承认片面实行犯为单方的共同犯罪,是主客观相统一的犯罪构成的当然逻辑结论。在强奸、抢劫等复合行为的场合,片面实行行为即使只参与复合行为的一部分,行为人也要对整个犯罪承担共同责任。将片面实行行为认定为共同犯罪,既有利于完善我国的共同犯罪理论,又可以迅速地恢复社会秩序,实现预防犯罪的社会作用。     

工伤保险赔偿责任研究 ——以劳务派遣用工为切入点

劳务派遣作为一种灵活的用工形式,受到我国各类用人单位的青睐和广泛运用。2013年《劳动合同法》修订弥补了我国劳务派遣制度上的不足,但由于起步时间较晚,加上制度的复杂性,存在工伤赔偿制度的责任划分不清晰、工伤保险待遇先行支付具体操作存在困难、异地劳务派遣工伤保险制度执行不明确等方面的问题。我国需要从确立《劳动合同法》中派遣单位与用工单位的具体责任分担制度、完善劳务派遣工伤待遇先行支付规定、明确异地保险制度相关规定等方面入手,进一步完善工伤保险制度在劳务派遣用工中的适用,有效保护被派遣劳动者的合法权益。     

The effect of joint control training on the acquisition and durability of a sequencing task

Gutierrez (2006) experimentally demonstrated the effects of joint control and particularly the role of response mediation in the sequencing behavior of adults using an unfamiliar language. The purpose of the current study was to replicate and extend the procedures used by Gutierrez by comparing the effects of joint control training with the effects of a prompt-and-fade procedure on the acquisition of a sequencing task. The effects of each procedure on delayed sequencing behavior were also tested. Ten undergraduate students participated in 2 experiments. The results indicated that all participants acquired the sequencing response in fewer trials and maintained accurate delayed responding when the component responses necessary for joint control were directly taught. Finally, when the self-echoic mediation component was blocked, accurate responding deteriorated in 8 of 10 participants.     

论道光年间滇南地区土司“文化治边”之举措——以《滇事杂档》史料为中心

道光年间滇南地区土司依靠清王朝授予的诰敕、号纸、印信等信物取得合法统治权之后,他们通过治边文化软实力的浸润,采取多种举措体现自己的权力象征,以实现“文化治边”的目标。具体而言,“文化治边”举措有四：一是在物质文化方面,土司衙署的建立;二是在制度文化方面,印信号纸的获得;三是在行为文化方面,土司法令的施行;四是在精神文化方面,表征系统、话语体系和意识形态等文化权力结构的建立。《滇事杂档》相关史料中以文治和教化等文化权力表征体系来治理滇南土司地区的思想,既是对清代中期官僚政治的认识与理解,又是对道光年间土司文化治权的阐述和诠释。     

Estimation and inference of the joint conditional distribution for multivariate longitudinal data using nonparametric copulas

In this paper we study estimating the joint conditional distributions of multivariate longitudinal outcomes using regression models and copulas. For the estimation of marginal models, we consider a class of time-varying transformation models and combine the two marginal models using nonparametric empirical copulas. Our models and estimation method can be applied in many situations where the conditional mean-based models are not good enough. Empirical copulas combined with time-varying transformation models may allow quite flexible modelling for the joint conditional distributions for multivariate longitudinal data. We derive the asymptotic properties for the copula-based estimators of the joint conditional distribution functions. For illustration we apply our estimation method to an epidemiological study of childhood growth and blood pressure.     

Analysis of robust design experiments with time-dependent ordinal response characteristics: a quality improvement study from the horticulture industry

An approach to the analysis of time-dependent ordinal quality score data from robust design experiments is developed and applied to an experiment from commercial horticultural research, using concepts of product robustness and longevity that are familiar to analysts in engineering research. A two-stage analysis is used to develop models describing the effects of a number of experimental treatments on the rate of post-sales product quality decline. The first stage uses a polynomial function on a transformed scale to approximate the quality decline for an individual experimental unit using derived coefficients and the second stage uses a joint mean and dispersion model to investigate the effects of the experimental treatments on these derived coefficients. The approach, developed specifically for an application in horticulture, is exemplified with data from a trial testing ornamental plants that are subjected to a range of treatments during production and home-life. The results of the analysis show how a number of control and noise factors affect the rate of post-production quality decline. Although the model is used to analyse quality data from a trial on ornamental plants, the approach developed is expected to be more generally applicable to a wide range of other complex production systems.

Palm Distributions for Log Gaussian Cox Processes

This paper establishes a remarkable result regarding Palm distributions for a log Gaussian Cox process: the reduced Palm distribution for a log Gaussian Cox process is itself a log Gaussian Cox process that only differs from the original log Gaussian Cox process in the intensity function. This new result is used to study functional summaries for log Gaussian Cox processes.

论共有人的优先购买权

针对共有人的优先购买权,现代大陆法系国家民法和我国现行立法都明确承认和保护共有人的优先购买权,但就该制度的存废仍然存在争议,文章主张保留并完善共有人的优先购买权制度.从本质而言,共有人的优先购买权是法定权和形成权并具有物权效力.在一定条件下,应当赋予共同共有人、建筑物区分所有的共有人、集体经济组织成员对集体财产的优先购买权,但在出卖人向法定继承人出卖财产份额、以拍卖和招投标方式出卖标的物、依强制执行方式而进行的出卖等情形下则不适用优先购买权.
