论量刑规范化应当缓行——以我国现行刑法立法模式为前提的研究

量刑规范化是我国为达成刑事司法公正,限制司法权力的重要举措。量刑规范化的努力,从价值追求上具有充分的合理性。我国量刑规范化以细化实体法规则作为基本方式,其优点是严格限制了司法裁量权,但其带来的副作用——相当范围的公正实现面临难以克服的困难也不容忽视。如何通过选择合理的规范化量刑方式以达到量刑公正,是一个重大且亟待解决的问题。因此本文提出量刑规范化应当缓行,慎重对待事关整体刑事司法公正实现程度的重大问题。     

王国维“意境”新义源出西学“格义”考

王国维意境新义的理论来源一直是困扰学界的重要问题。以往的研究由于无法明晰作为中国传统固有诗学名词的意境如何与西学发生了直接的联系,因而难以得出令人信服的结论。通过对晚清文献使用意境一词的考察,可见出意境在晚清还存在另外一种使用形态——对西学的格义。这种格义使意境与西学发生了意义上的互渗,从而成为意境意义古今转换的原动力。王国维创造性地将这种经过意义转换后的意境运用到中国的文学批评实践中去,使意境的新义得以确立。王国维这一批评实践虽然使意境重生于现代文论话语之中,但也因此给后人造成了理解上的混乱。     

论系列合同中的第三人权利

系列合同是围绕着一个中心事件而在不同当事人之间缔结多份合同的现象。按合同相对性原则,合同效力不及于第三人,因此第三人不能针对违约当事人请求救济。然而出于社会正义和司法效率的考量,在系列合同中,赋予受损害的第三人以合同上权利,直接寻求针对违约当事人的权利救济是有正当理由的。实践中,系列合同呈现辐射式和链式两种不同的形态,第三人在不同形态的系列合同中获得救济的条件和方式也有所差异。     

论人大监督中的程序正义问题

正义的监督,必须建立在正义的监督程序之上,程序正义不仅是司法领域的重要问题,也是人大监督的重要问题。就目前情况看,我国人大及其常委会的监督程序仍不完善,影响了监督的正义性。提高人大监督的正义性,要在民主的价值观下,采取实证主义的方法,建立以宪法和监督法为主,其他法律法规和政治惯例为辅的科学的、完善的监督程序。     

Introduction Les perspectives transnationales du droit international du travail

Dans cette introduction, l'auteure replace le thème du numéro spécial dans le contexte du 100^e anniversaire de l'OIT et de la difficulté à réaliser les principes du travail décent, qui reste entière aujourd'hui, alors que des forces transnationales diverses font sentir leur influence. Pour sortir de l'impasse et réformer le cadre de régulation transnational, il faut, pour l'auteure, redonner une place centrale au droit international du travail, qui fournit le fondement normatif du droit transnational du travail. En outre, il faut associer à l'entreprise une large gamme d'acteurs, tout en mobilisant l'OIT, en tant qu'organe normatif et force de coordination.     

“She invited other people to that space”: audience habitus,place, and social justice in Beyoncé’s Lemonade

We argue that place offers an effective framework for connecting popular culture with social justice narratives by exploring audience interpretations of Lemonade in 2016’s tumultuous racial climate. Working from interviews with 35 of Lemonade’s listeners/viewers regarding their understanding of the album, we argue that audience members used Lemonade to plot spaces of racial pride, community, and equality. Supporting previous audience studies’ findings, Beyoncé’s audiences engaged actively with the text and explored the complex symbolism through interpretive communities, but the audiences we spoke with also transcended these spaces. Using Lemonade as a tool to understand and reimagine historical social movements, audiences deployed the album to cultivate an anti-racist habitus in attempts to make their worlds more just.     

Social cohesion in rural Australia: Framework for conformity or social justice?

While social cohesion has become a commonly accepted policy goal and framework in many ethnically diverse societies, there is a general concern in some academic literature that it can be a form of governmentality that constructs manageable subjects and communities, represses diversity and distracts attention from the social, political and economic production of inequalities. Drawing on ethnographic fieldwork in two rural Australian towns with ethnically diverse populations, this article engages with these criticisms of social cohesion while simultaneously asserting that social cohesion is viewed by local practitioners as a desirable objective for both strengthening intercultural community and addressing issues of social justice and inequality. We also aim to bring some needed clarity to relevant debates in the literature in distinguishing between social cohesion discourses used for normative and/or homogenising purposes versus frameworks developed in the academic literature with a concern for social justice and equality among diverse populations.     

行政裁量基准司法审查的理论、实践和出路

行政裁量基准是行政法的法源,将其纳入司法审查具有必然性。但司法审查的实践势必面临审查＂依据＂与＂对象＂、行政理性与司法理性、成文基准与非成文基准之间抉择的两难。审查的指导理念从＂浪漫与怀疑＂到＂现实＂、审查模式从静态向动态转变、价值目标追求从被动守护正义到能动回应现实,是走出尴尬的基本途径。

贯穿于20世纪人类学理论所有领域的结构概念在人类学学科领域中已经成为主流话语之一.从20世纪早期出现的结构-功能主义,法国年鉴学派,结构人类学,象征人类学,文化唯物主义到历史人类学等种种学派中不同人类学家将结构概念用于理论的表述和具体文化研究实践中去.本文从比较分析的角度对结构概念在不同理论学派中的内涵进行探讨,以期为阐释和梳理人类学理论研究提出分析视角.

现代发展是现代化视野下的发展,是与现代化相关的发展。原发式现代化国家在实现现代化的同时,也造成了相位的“发展问题”,发展中国家的现代化道路同样需面对发展问题题：历经长期思考．在发展理论的变迁中形成现代发展理念、思维取向和原则。
