民事自助行为的性质及构成要件

民事自助行为是私力救济的重要手段,对其性质有进攻说、权利保全说和公力救济例外说三种不同观点,其中公力救济例外说赋予私力救济相对独立的正当性基础。民事自助行为的构成有三要件、四要件和五要件等不同学说。四要件说更能实现保护当事人权益和维护社会稳定的目的,但其具体实施中的问题亟待解决。对民事自助行为之目的要件、对象要件、情势要件、限度要件进行具体分析,以使其在司法实践中得到更妥当的运用。     

Fetishes and factishes: Durkheim and Latour

This paper defends the concept of ‘fetishism’ as an explanatory parameter in sociological theorizing on Durkheimian grounds, while at the same time paying due attention to important insights regarding the role of objects in social life, originating from Actor‐Network Theory (ANT). It critically assesses the current critique of the concept of fetishism propagated by ANT protagonist Bruno Latour. Latour and suggests a compromise between these two ‘schools’. First, to place the paper firmly in context, I analyse some examples of modern fetishism and outline the themes of the ensuing discussion. Next, I turn to Durkheim, seeking to develop a distinct interpretation of the concept of the social and of fetishism, and then point to some of Durkheim's shortcomings and attempt to make room for Latourian perspectives. Finally, I critically assess Latour's dismissal of forms of social ‘explanation’ and of the concept of fetishism.     

《齐民要术》动宾式双音词形义演变及成因

《要术》出现了不少动宾式双音词,其中近一半是魏晋南北朝的新词。这些双音词大多数以原形、原义进入现代汉语。但也有不少形义有变：或形同义异,或形异义同,或形异义异,或形失义存。产生这种变化的主要原因是该书运用了大量的方言口语和专业词汇,有些构词语素表义欠明晰,另外动宾式构词法本身存在的不足也是重要的因素。

胡塞尔在《逻辑研究》中探讨了范畴直观,认为范畴直观是对含义中对象性的形式的明见和充实,因而可谓是知性明察和一个最高意义上的思维。它为从现象学上澄清逻辑明见性开辟了道路。然而,恰恰是在这一“对象化”的框架下,“存在”这一涵义丰富的概念本身被降低为最低的“混杂的”范畴。而要明了他究竟如何漏过了“存在”概念,则要求我们回到胡塞尔对范畴直观概念的提出和确立上,回到范畴直观概念的形而上学基础中去追问。

Time Cost of Children as Parents' Foregone Leisure

From the 1998–99 French Insee time use survey, the time cost of children is estimated in terms of hours of foregone leisure. The focus on couples with two spouses working full time implies no need to be concerned about substitution between home production and labor supply. The model accounts for selection into full-time employment, endogenous wages, and controls for outside help with home production and child care. The foregone leisure cost per child under the age of 3 is 1.6 hours for each parent. It is about half that size for children aged 3 to 14. Children over age 14 involve no leisure cost to parents.     

Physical activity patterns in healthy middle-aged women

ABSTRACT

Exercise in healthy female adults around the menopausal transition has been routinely examined in leisure activities alone, potentially discounting the physical activity (PA) that is accumulated in household and outdoor domains. The purpose of this study was to quantify PA in healthy middle-aged women and to examine the extent to which the Center for Disease Control (CDC) PA guidelines were met through leisure, household, and outdoor activities. Methods: 440 healthy women, 51–64 years old, BMI ≥18.5 or < 40 kg/m², participated in the study using the Lifetime Physical Activity Questionnaire (LPAQ) to quantify PA. Results: 25.91% met the CDC PA guidelines if leisure time alone was examined. When multiple domains were included, 73.41% of the women met the PA guidelines. This percentage is much higher than the reported 20.6% of U.S. adults who met the guidelines in 2011. PA in women may be underrepresented in data limited to leisure time PA.     

Driven to Care: The Car,Automobility and Social Work

Abstract

Welfare practices are invariably represented in static and sedentary ways and their mobilities ignored. This paper corrects for this by examining the car and auto‐mobility in social work. The car is not just a means to reaching vulnerable children and other service users quickly, and a mobile office, but a space where significant casework goes on and deeply meaningful ‘therapeutic journeys’ happen. The car carries similar emotional meanings and possibilities for workers as a space within which to contain the anxieties and emotions they routinely confront in their work. Drawing on mobile social science and psychoanalytic theory, the paper shows how the power and meanings of auto‐mobility in ‘car therapy’ are products of the design of cars and the distinct rhythms and mobilities they produce in themselves. The car in social work is conceptualised as a ‘fluid container’ for the processing of personal troubles, emotion and key life changes. The theoretical implications of this argument for the social science of mobilities are drawn out.
