关于不报、谎报安全事故罪的几点思考

认定不报、谎报安全事故罪,应注意理解"不报或谎报"、"安全事故情况"、"贻误事故抢救"等客观方面的构成要素;本罪与其他安全事故犯罪发生关联适用时,应数罪并罚;本罪与滥用职权罪或玩忽职守罪发生关联适用时,应以本罪论处;本罪属于过失情节犯,而过失情节犯是存在一定的内在冲突的,将本罪规定为过失情节犯属于立法缺陷,因此有必要将本罪中的"情节严重"修改为"造成严重后果",即通过抛弃情节犯、规定过失犯的危害结果要件来完善本罪立法.     

浅议民国时期第一届国会的弹劾权

《临时约法》变总统制为内阁制,但对内阁制特有的不信任投票权却没有具体规定。《临时约法》设计者将不信任投票权和弹劾权混同,目的是以国会制约政府权力,自身又不被解散。可在国会真正需要行使不信任投票权时,或因弹劾手续烦琐不能奏效,或因没有法律依据而无所适从,不仅不能制约政府,反而因无法可依而相当被动。

本文认为 ,江泽民同志“三个代表”的精神具有划时代意义 ,是由“阶级说”马克思主义向“人类学”马克思主义的转变 ,从而极大地推进了马克思主义哲学的全球化进程。它是对人类共产主义“大同境界”的前瞻意识。     

房地产经纪合同佣金支付条件规则重构

当前房地产经纪人服务范围已超出报告、媒介等传统居间服务范围,但司法实践中对房地产经纪人佣金请求权成立条件的认定仍然以传统民事居间理论为基础,导致判决结果要么与实践脱节,要么存在法理错误。房地产经纪人佣金请求权成立条件的认定不应该采取演绎推理方式,而应该采取结果导向司法思维。通过比较分析"提供适格交易对象规则"、"合同订立规则"、"合同订立+履行规则"、"合同履行规则"这四项主要的佣金支付条件规则的实效可知,合同履行规则比其他三种规则更可取,建议采此规则为佳。     

中庸结构内涵及其与集体主义关系的研究

基于4批共949份调查问卷数据,首先探索目前中国情境下中庸价值取向的结构内涵,得到“执中一致、慎独自修、消极成就、消极规避”4个维度,其中,“执中一致”是中庸结构内涵的核心,描述了个体与周围情境互动时的价值取向.然后,基于参照框架效应理论发现,相比于集体主义,中庸能更为有效解释中国员工的帮助行为;在高和谐导向氛围的情境下,中庸对集体主义有显著的促进作用.     

Global sensitivity analysis with dependence measures

Global sensitivity analysis with variance-based measures suffers from several theoretical and practical limitations, since they focus only on the variance of the output and handle multivariate variables in a limited way. In this paper, we introduce a new class of sensitivity indices based on dependence measures which overcomes these insufficiencies. Our approach originates from the idea to compare the output distribution with its conditional counterpart when one of the input variables is fixed. We establish that this comparison yields previously proposed indices when it is performed with Csiszár f-divergences, as well as sensitivity indices which are well-known dependence measures between random variables. This leads us to investigate completely new sensitivity indices based on recent state-of-the-art dependence measures, such as distance correlation and the Hilbert–Schmidt independence criterion. We also emphasize the potential of feature selection techniques relying on such dependence measures as alternatives to screening in high dimension.     

The analytic construction of D-optimal designs for the two-variable binary logistic regression model without interaction

Candidate locally D-optimal designs for the binary two-variable logistic model with no interaction, which comprise 3 and 4 support points lying in the first quadrant of the two-dimensional Euclidean space, were introduced by Haines et al. (D-optimal designs for logistic regression in two variables. In: Lopez-Fidalgo J, Rodrigez-Diaz JM, Torsney B, editors. MODA8 – advances in model-oriented designs and analysis. Heidelberg: Physica-Verlag; 2007. p. 91–98). The authors proved algebraically the global D-optimality of the 3-point design for the special case in which the intercept parameter is equal to?1.5434. However for other selected values of the intercept parameter, the global D-optimality of the proposed 3- and 4-point designs was only demonstrated numerically. In this paper, we provide analytical proofs of the D-optimality of these 3- and 4-point designs for all negative and zero intercept parameters of the binary two-variable logistic model with no interaction. The results are extended to the construction of D-optimal designs on a rectangular design space and illustrated by means of two examples of which one is a real example taken from the literature.     

基金发行潮与管理公司绩效

区别于传统以基金作为独立个体的研究,本文以基金的母体——基金家族作为研究对象,重点考察以下问题:为何基金家族纷纷发行新基金?基金家族的迅速繁衍是否损害了其投资绩效?文章从理论上探讨了基金家族热衷于发行新基金的原因。并运用随机前沿分析(SFA)方法,以测算基金家族投资绩效为切入点,重点检验了新基金发行对家族业绩的影响。发现基金家族总体业绩偏低,新基金发行在短期能提高家族业绩,在长期会损害家族业绩。为此,文章进一步探讨了新基金发行对家族业绩的门槛效应。发现要有效促进基金家族业绩,单个基金家族半年内新发行基金数不能超过3只,其旗下基金总数不能超过11只。根据研究成果,文章提出了相关政策建议。     

消解诗意的形而下欲望书写--大众文学粗鄙化倾向批判

市场语境下的中国大众文学优缺互见。一方面它凭借独具的艺术魅力,满足了大众的精神文化需求,赢得了受众青睐,获得了商业成功;同时,它又存在着“玩”文学、夸张地表现物欲、无节制地展示性爱等为媚俗而流于粗鄙化的缺陷,解构了文学的神圣性。对大众文学粗鄙化倾向的批判以及为其寻求去粗鄙化的有效途径,既是大众文学自身健康品格培养和未来可持续发展所需,也是社会主义文化建设的具体实践。
