少数民族民间文学艺术法律保护研究

贵州省是少数民族大省,少数民族文化丰富多彩。当前贵州省少数民族民间文学艺术保护的法律法规体系呈现公法“纵横交错”的格局,但却存在私法保护严重不足、知识产权法律无法全面覆盖传统少数民族民间文学艺术等缺憾与不足。新时代背景下,应坚持依法治国,以科学立法为目标,总结贵州省少数民族民间文学艺术法律保护的现有问题。据此提出建立完善以民法为主结合其他特别法的私法保护体系,提高地方立法的可操作性,增强权利主体意识等改进措施。     

不同类型留守儿童与一般儿童自我接纳的比较

为考察不同类型留守儿童与一般儿童自我接纳的差异,从而为提出有针对性的干预措施提供依据。采用自我接纳问卷对310名留守儿童和714名一般儿童进行调查。结果发现：（1）一般儿童自我接纳得分最高,显著高于各种类型的留守儿童;母亲外出的留守儿童自我接纳得分最低,显著低于其他类型的留守儿童。（2）性别和留守类型在自我评价上的交互效应显著,表现为母亲外出留守儿童中女生的自我评价得分显著高于男生。（3）学段和留守类型在自我接纳上的交互效应不显著,但学段的主效应显著,表现为SAQ总分上随着学段上升而上升,且各个学段之间的差异显著。     

新时代下师范生师德养成教育路径探究

师德是教师的核心职业素养,加强师范生师德养成教育是培育社会主义核心价值观的必然要求,是培养新时代高素质教师的关键所在,是推进教育供给侧结构性改革的客观需要。针对当前师范生师德养成教育存在的工作机制不顺畅、教育内容片面狭隘和教育考评机制不完善等问题,提出了创新师德养成教育工作机制、“四个载体”丰富师德养成教育内容、“一份档案”完善师德养成教育考评机制、“三个体验”提升师德养成教育工作实效的具体路径。     

中国法院对重整计划强制批准的问题与解决

法院对重整计划的强制批准是破产法中的核心法律制度,“供给侧结构性改革”推动了法院对重整计划强制批准的司法适用。中国法院对这一“舶来”法律制度的司法适用存在诸多问题:严重的社会本位主义、盲目过高的适用比例、与正常批准的关系颠倒、缺乏全面的审查规定、对普通债权人的保护不利等。要回归法院强制批准正确的司法功能,确保中国法院对重整计划强制批准的正当适用,就必须借鉴《联合国破产法立法指南》及域外的立法,结合2018年最高院《破产审判会议纪要》“审慎适用”规定,从理论、立法和司法层面寻求对问题的解决途径包括充分认识法院强制批准权力的属性、正确定位正常批准和强制批准的关系、修订完善强制批准的实体审查条件、合理构建强制批准的审查程序等。法院对重整计划强制批准问题的解决有助于中国《企业破产法》的修订完善。     

涉农财政资源分配体系的重构与村庄治权再造

税费改革后,国家涉农财政资源是采取技术化分配方式输入农村,没有实现向村级治理资源的转化,未起到增强村庄治权的效果。成都市和清远市农村资源分配体系创新实践通过资源整合、组织配套和分配程序创设等体制建设重构了国家涉农财政资源的民主化分配体系。其所内涵的村级组织资源统筹机制、村民利益关联机制和村民民主参与机制实现了村庄治权再造,这对优化国家涉农财政资源分配体系、提升农村基层治理能力具有重要的启示意义。     

Simultaneous Confidence Intervals for the Parameters of Pareto Distribution under Progressive Censoring

In this article, we consider the progressive Type II right censored sample from Pareto distribution. We introduce a new approach for constructing the simultaneous confidence interval of the unknown parameters of this distribution under progressive censoring. A Monte Carlo study is also presented for illustration. It is shown that this confidence region has a smaller area than that introduced by Ku? and Kaya (2007 Ku? , C. , Kaya , M. F. ( 2007 ). Locking the Wiener Process to its Level-Crossing Time

We consider the specific transformation of a Wiener process {X(t), t ≥ 0} in the presence of an absorbing barrier a that results when this process is “time-locked” with respect to its first passage time T _a through a criterion level a, and the evolution of X(t) is considered backwards (retrospectively) from T _a . Formally, we study the random variables defined by Y(t) ≡ X(T _a  ? t) and derive explicit results for their density and mean, and also for their asymptotic forms. We discuss how our results can aid interpretations of time series “response-locked” to their times of crossing a criterion level.     

On Order Statistics from Sine Distribution

We derive closed form expressions for the first two moments of order statistics from the sine distribution. For the higher moments, a recurrence relation is given. We also give a recurrence relation for the product moments. These relations will be useful for moment computations based on ordered data.     

Large Deviations for Empirical Estimators of the Stationary Distribution of a Semi-Markov Process with Finite State Space

We prove the large deviation principle for empirical estimators of stationary distributions of semi-Markov processes with finite state space, irreducible embedded Markov chain, and finite mean sojourn time in each state. We consider on/off Gamma sojourn processes as an illustrative example, and, in particular, continuous time Markov chains with two states. In the second case, we compare the rate function in this article with the known rate function concerning another family of empirical estimators of the stationary distribution.
