Changing compatibility of cohabitation and childbearing between young British women born in 1958 and 1970

We investigate the effect of parenthood on whether non-marital unions led to marriage or parting for two cohorts of British women when they were aged between 16 and 29. We compare the effect of conceptions leading to births and the presence and characteristics of children on the odds that a cohabitation was dissolved, or that it was converted to marriage, for women born in 1958 and 1970. A multilevel, multiprocess, competing-risks model allows for multiple cohabitations per woman and endogeneity of fertility status. We find that cohabiting couples’ response to impending parenthood and the presence of children changed over time. In particular, the proportion of cohabiting couples who married before a birth decreased and, in the 1970 cohort only, the risk of dissolution declined during pregnancy. There is also evidence that the presence of a child cemented a cohabiting union for women from the 1970, but not the earlier, cohort.     

Registered domestic partnerships among gay men and lesbians: the role of economic factors

In this paper, we predict the demand for a marriage-like status—registered domestic partnership–among same-sex couples. Domestic partnership in the state of California now comes with almost all of the rights and responsibilities of marriage that a state can provide. We use the LGBT (Lesbian, Gay, Bisexual, and Transgender) Tobacco Use Survey conducted by the California Department of Health and the Field Research Corporation in 2003. From this telephone survey, we use a probability sample of 1,002 lesbian and gay individuals in California. Using multinomial probit models of partnership status (single, not cohabiting, cohabiting, or registered), we find limited evidence of economic motivations in the choice to register. Gay men’s likelihood of registration rises with income; lesbians’ probability of registration rises with age. Couples with longer duration are more likely to register, suggesting that registration and duration are complementary signals of commitment and possibly of the need for rights and benefits of registration.

论合伙商事人格登记制度

我国有很多合伙没有进行商事登记就从事商事活动,一旦产生纠纷,是以商事登记的信息还是以客观事实作为法律事实,各个法院看法不一。这对善意第三人信赖利益的保护十分不利。通过研究其他国家和地区对合伙商事人格登记制度的不同规定,并结合我国的立法现状,本文认为立法者应当对合伙的商事登记的法律效力进行完善。商事登记对于个人合伙、联营型合伙和普通合伙的商事人格仅具有公示效力,对于特殊的普通合伙和有限合伙的商事人格不仅具有设权效力,也具有公示效力。     

我国风险投资强制性制度变迁的分析与研究

风险投资对于一国高科技的进步、经济结构的转变具有重大的推动作用,而其发展离不开相应的制度安排,从20世纪80年代以来,我国在风险投资领域出现了一系列由政府主导的强制性制度变迁,对风险投资的快速健康发展产生了积极影响。本文在分析我国强制性制度变迁必要性的基础上,从当前实施的典型的风险投资制度——有限合伙制和退出机制着手,进行分析与研究,总结目前面临的问题和困境,同时为后续的制度变迁提供完善的路径。     

浅议合伙企业跨国所得之课税

对合伙企业的跨国所得进行课税时常常要适用双边税收协定,而协定的适用又离不开国内税法,由于各国国内所得税法对合伙企业的规定不同,当缔约国给予合伙企业不同税收待遇时,其对合伙企业所得的性质会产生识别冲突,从而导致双重征税和不征税。因此,课税时应结合税收协定与缔约国有关规定对合伙企业的居民资格、企业利润、特别报酬予以分析,以便进行正确的定性,正确适用双边税收协定,避免双重征税。     

客运产业组织与客运市场效率

为探索客运产业组织变迁与客运市场效率的关系,综合运用产业组织理论和制度变迁理论,分析了长途客运市场在实践中如何产生“竞争性失效”并导致客运产业组织变迁的原因。分析认为,在以车主协议发车的初始变迁失败后,以单车统管为模式的再次变迁成功地克服了初始变迁下的“囚犯困境”状态。随单车统管的实施,客运市场结构由竞争型向垄断型转变,并由此导致市场效率的变化,要求在矫正客运市场“竞争性失效”和尽可能减少垄断福利损失之间作出权衡。

Promises and Partnership

We examine experimentally the impact of communication on trust and cooperation. Our design admits observation of promises, lies, and beliefs. The evidence is consistent with people striving to live up to others' expectations so as to avoid guilt, as can be modeled using psychological game theory. When players exhibit such guilt aversion, communication may influence motivation and behavior by influencing beliefs about beliefs. Promises may enhance trustworthy behavior, which is what we observe. We argue that guilt aversion may be relevant for understanding strategic interaction in a variety of settings, and that it may shed light on the role of language, discussions, agreements, and social norms in these contexts.     

Cohabitation in Great Britain: not for long, but here to stay

This paper uses a new source of data to study the dramatic increase in cohabiting unions in Great Britain. It analyses, in turn, entry into first partnership, the stability of cohabiting unions and repartnering after dissolution of cohabitation. In excess of 70% of first partnerships are now cohabitations, and these last a relatively short time before being either turned into marriage or dissolved. The shift to cohabitation as the dominant mode of first partnership plays an important role in the delay of first marriage and motherhood. The paper also investigates the factors that are associated with the outcome of cohabitations.
