个人叙事与传统建构——以即墨“田横祭海节”为例

民俗学力从民俗传承主体的个人叙事和生活史中去发现民俗传承和发展的机制。田横祭海节上民俗传承主体讲述的关于修建土地庙、龙王庙、天后庙、文君庙等庙宇的个人叙事中,体现了传统被建构的过程和机制。个人叙事与传统建构的关系就是：传统是一个过程,个人叙事在传统不断被建构的过程中发挥着重建、发扬、新建并不断强化的作用。     

娄底市商业性健身俱乐部私人教练需求分析

为了提高私人教练的整体素质,促进私人健身教练的市场发展。运用文献资料法、问卷调查法、访谈法、数理统计等研究方法,对娄底市商业性私人健身教练的需求进行了研究。结果显示：娄底市私人健身教练以文化程度中等偏低,工作经验薄弱的男性教练为主体,年龄结构趋于年轻化。有63.6%学员需要私人教练提供指导,选择私教的学员仅占7.5%,他们的态度与行为存在较大的反差,这与学员对私教认识,经济收入,对健康的强烈程度,私教市场培育与管理等影响因素分不开。

新闻法治是依法治国的一部分。新闻法治的基本理念包括：知情权、维护＂人格权＂、更正与答辩权、保密权等。媒体报道司法的权利源于公民对司法信息的知情与表达权;媒体报道司法的法律限制目前主要是要协调媒体报道司法的自由与人格权,即肖像权、名誉权和隐私权等的冲突;重提新闻专业精神是协调该冲突的必要途径。     

私人复制:合理使用抑或侵权

为私人使用而复制作品(以下简称私人复制)是传统著作权法所规定的合理使用制度中的经典条款,但随着科学的发展和技术的进步,这一条款受到了前所未有的质疑和挑战.世界各国的立法者为平衡著作权人和使用者的利益,对传统的为私人使用而复制作品的制度都作出了适当的修正.在借鉴他国经验的基础上,力图建构起一套适合我国国情和立法现状的为私人使用而复制作品的制度.     

一般人格权争议问题我见

从一般人格权的产生角度看,一般人格权只是在为法律明确列举之外的“其他人格权”落实一个请求权(特别是抚慰金请求权),并为法院裁判该类案件提供依据时创设的一个概念。一般人格权实际上是一种法律技术,它所体现的价值取向———对人格权进行全面保护———可以通过人格权立法的多元模式实现。如果我们坚持人格权立法的多元模式,从立法技术上不采纳一般人格权的处理方法,那么可以将人格尊严权与人格自由权视为个别(具体)人格权。将人格尊严权和人格自由权作为个别人格权,也能为人格权的广泛保护提供一个可操作的平台。     

Framing the tendency to betray one's good intentions. Akrasia as a dialogical dynamic

Akrasia, otherwise known as ‘weakness of will’, is a state of mind whereby people act deliberately against their better judgment. This paper aims to provide a conceptual framework for understanding akrasia from psychosocial perspectives that assume the self is multiple and strongly interconnected with the relational flow of which it is a part. Drawing on key ideas from Dialogical Self Theory, we analyze the main dialogical dynamics that can generate akratic episodes with reference to how individuals organize their personal position repertoire, and to the relational and socio-cultural setting in which the actions are taken. The discussion enables us to identify some indicators to frame the tendency to betray one's good intentions, and to offer some suggestions on how to reduce the occurrence of the various forms of akrasia analyzed.     

Reflexivity over and above convention: the new orthodoxy in the sociology of personal life, formerly sociology of the family

There is a new orthodoxy in the field that was once understood as the sociology of the family, and is increasingly understood as the sociology of 'personal life', 'intimacy', 'relationships' and 'families'. The orthodoxy highlights the open-endedness of intimate relations at the expense of the family as an institution; that is, reflexivity over and above convention. This article argues that the new orthodoxy not only overstates reflexivity at the expense of convention, but abdicates understanding to frameworks grounded in biologistic and economistic understandings of human behaviour. The article makes its point through attention to three areas of research at odds with the new orthodoxy: paternity uncertainty, inheritance and family business. It then proposes that conceptualization of the family as an institutional regime gives due weight to the reflexive reconfiguration of family relationships and practices on the one hand, and their institutional embeddedness on the other.     

The Attitudes of Social Work Students Toward End-of-Life Care Planning

This study examined the attitudes of social work students toward end-of-life care planning, as well as their degree of willingness to engage in this area of social work practice. Factors associated with their attitudes were measured through structured surveys completed by 102 social work students (N = 102) at a school of social work in the southeast. Results indicated that these social work students tended to have positive attitudes toward end-of-life care planning in general. Moreover, these attitudes were positively associated with preference for pain relief treatment, higher levels of comfort when discussing death, more emphasis on self-determination, and apprehension of conflicts of self-determination. The results of this study underscored the increased societal need for recognition of personal preferences in end-of-life care, higher levels of comfort when discussing death, and an increased commitment of social workers' to maintaining the ethical principle of the client's right to self-determination in end-of-life planning. While this is not surprising, it points to a continuing need to re-assess where the field stands in its preparation of social work professionals who will work closely with people who are dying and their families.     

商事侵权行为概念研究

目前的法学界没有明确提出商事侵权行为这个概念,但是,商事侵权行为由于具有其自身特点,如果不将其与一般民事侵权行为相区别,将不利于被侵犯的商事权利的保护.文章从商事主体具有营利性的特点出发,分析了商事侵权行为所应当保护的客体--商事人身权的内涵和外延,最终提出了商事侵权行为的概念和特征.     

Sexual Orientation and Quality of Life Among University Students from Cuba,Norway, India,and South Africa

This article explores quality-of-life aspects among gay, lesbian, bisexual, and straight male and female students in Havana (Cuba), Troms? (Norway), Hisar (India), and Cape Town (South Africa). In the period 2004–2005, a questionnaire survey on sexuality, happiness, and life satisfaction was undertaken among 339 students from the University of Havana, 144 students from the University of Troms?, 200 students from Guru Jambheswar University, and 189 students from the University of the Western Cape. The majority of the participants were straight and, in Hisar and Cape Town, few of those who regarded themselves as gay/lesbian/bisexual had engaged in sex with a person of the same gender. In all cities, straight men and women scored higher than gay, lesbian, and bisexual persons on the quality-of-life measures. Quality of life among gay/bisexual men and lesbian/bisexual women was higher in cultures with accepting attitudes toward homosexuality than in cultures with restrictive attitudes.
