我国计算机软件专利保护文献综述

计算机软件作为一种新的智力劳动成果,如何保护研发者的利益,提高他们研发的积极性,目前,世界各国政府都在积极研究出台相关法律来保护这一新型智力劳动成果.主要介绍了有关计算机软件专利保护的国内外现状及保护的不足之处,提出了完善我国计算机软件专利保护的建议.旨在为我国计算机软件专利保护问题研究的进一步发展提供一个参照平台.     

L'adoption par l'OIT d'une approche fondée sur la durabilité et ses conséquences sur le droit d'expression collective des travailleurs

L'action de l'OIT pour le développement durable s'est d'abord organisée autour des notions de «transition juste» et d'«emplois verts», en lien avec la protection de l'environnement. Aujourd'hui, les objectifs du développement durable devraient permettre à l'Organisation de se saisir pleinement de la dimension sociale du développement durable, grâce à l'ODD 8, qui mentionne le travail décent, et à la cible 16.7 sur la participation à la prise de décisions. L'auteure examine comment l'OIT pourrait promouvoir l'expression collective des travailleurs dans le contexte du débat sur un «avenir du travail durable» et cherche à déterminer qui doit avoir un droit d'expression et comment celui-ci doit s'exercer.     

‘Seeing through their Eyes’: Towards Understanding Risk and Protection Perspectives of Young Bedouin Children in the Unrecognised Villages of the Naqab

This article is based on a participatory, context-informed study that examined perception of ‘risk’ and ‘protection’ among 30 Bedouin children aged four to five. It was conducted in the Bedouin unrecognised villages — Southern Israel and utilised photography, drawings and verbal explanations. The analysis yielded seven themes representing children’s perceptions of risk and protection. It indicated that children facing extreme adversity were aware of numerous risk conditions, including a lack of infrastructure and the fear of losing their homes, thus adversely affecting their well-being. Children’s insights, and suggested modes of protection, as the study findings reveal, are crucial for promoting children’s welfare.     

环境污染责任的构成要件研究——基于《侵权责任法》第八章的分析

环境污染责任属无过错责任,原则上以环境污染行为、损害事实、行为与损害之间的因果关系这三项为构成要件。环境污染责任作为一种危险责任,不要求污染行为具有违法性。环境污染责任的保护范围主要限于物质性人格权和物权．不包括环境权。环境污染的损害类型包括人身损害、财产损害、精神损害。在因果关系方面,我国相关法律确立的举证责任倒置模式与比较法上一些采用因果关系推定的新理论存在差异。     

基于模糊权重的多目标订单分配模型

随着竞争的日益加剧,采购成了影响企业生存和发展的关键因素。在这种情况下,正确的订单分配是成功实行采购的关键。实际上,影响订单分配的许多信息并不是确定的已知条件,例如目标、约束条件和影响权重等。本文通过考虑上述信息的不确定性和模糊性,构建一个包含模糊目标、模糊权重和随机约束的订单分配模型。然后,利用数值算例证明了模型的可解性。最后,指出了未来可能的几个研究方向。     

基于价格保护策略的渠道协调

针对当今产品生命周期缩短、用户需求不确定性增强、产品价值急剧下跌的市场竞争环境,分析了实现渠道协调的价格保护策略,给出了基于单次订购二阶段价格保护额度最优策略动态模型.研究表明,通过设置合理的批发价格和价格保护补偿额度,能够导致优化的零售商订购数量,并进一步证明,该策略可以优化渠道联盟的总体绩效,而且渠道成员可以达到双赢的目的,从而实现渠道协调.     

投资者法律保护、产品市场竞争与现金股利支付力度——来自中国制造业上市公司的经验证据

在股利代理理论的框架下,实证检验了投资者法律保护、产品市场竞争与企业现金股利支付力度的关系,以及在不同投资者法律保护水平(包括法律制度和法制环境)下,产品市场竞争对企业现金股利支付力度的影响.研究发现,在其他条件一定的情况下,投资者法律保护水平、产品市场竞争程度与公司现金股利支付力度呈显著正相关关系;当法律保护水平较低时,产品市场竞争对公司现金股利支付力度的影响更显著.研究结论进一步说明了在法律保护水平较低时,激烈的产品市场竞争可以弥补法律保护的不足,保护投资者的利益.     

A Model for Setting Performance Objectives for Salmonella in the Broiler Supply Chain

A stochastic model for setting performance objectives for Salmonella in the broiler supply chain was developed. The goal of this study was to develop a model by which performance objectives for Salmonella prevalence at various points in the production chain can be determined, based on a preset final performance objective at the end of the processing line. The transmission of Salmonella through the broiler production chain was modeled. The prevalence at flock level was calculated from the measured prevalence at sample level. The transmission model is based on data on the occurrence of Salmonella collected in the Dutch broiler production chain during several years. The developed model can be used by policymakers and industry to determine economically and politically acceptable performance objectives for various points of the production chain and to draw conclusions about which interventions are most appropriate.     

基于区间灰色区间数的多准则决策方法

将灰色模糊数扩展,定义了区间灰色区间数及其距离.针对准则值为区间灰色区间数的信息不完全的多准则决策问题,提出了一种基于目标规划法的灰色模糊多准则决策方法,求得最优权重向量,从而得到各方案的排序.最后给出一个算例说明方法的可行性和有效性.
