论《刑事诉讼法修正案(草案)》中的特别程序——再谈刑事和解制度

《刑事诉讼法修正案(草案)》将刑事和解制度首次纳入特殊程序范围,这是我国刑事司法理念不断创新和提升的直接体现,具有重要的实践意义。为确保刑事和解制度能够切实运行而不空为一纸规定,有必要对该制度的存在基础予以明晰,同时进一步完善其运行机制,最终实现刑事和解程序化解当事人矛盾、弥补受害人损失、修复被破坏社会关系的根本目的。     

Climate justice and sustained transnational mobilization

ABSTRACT

Samir Amin’s final essay called for the creation of a new international organization of progressive social forces. Here I review evidence from twenty-first century transnational movements germane for understanding the likelihood of the emergence of such an international organization and the issues and sectors most likely to facilitate coalitional unity. More specifically, the ecological crises identified by Amin in the form of global warming and climate change have created an unprecedented global environmental threat capable of unifying diverse social strata across the planet. The climate justice movement has already established a global infrastructure and template to coordinate a new international organization for confronting neoliberal forms of globalization. Pre-existing movement organizing around environmental racism, climate justice in the global South, and recent intersectional mobilizations serve as promising models for building an enduring international organization that will represent subaltern groups and have a substantial impact on world politics.     

在公正与效率之间:证人出庭作证制度的困境和出路

证人出庭作证问题,涉及证明标准与法律假设、法律规则与法律标准、诉讼效率与诉讼成本、自利偏见与社会效应等诸多方面。证人不出庭作证的规范依据仍然存在、证人出庭作证的权利和义务不对等、配套措施不完善等原因,导致证人不愿意出庭。美国辩诉交易制度在很大程度上减少了开庭刑事案件的数量,其关于书面陈述的规定也减少了证人出庭作证的需求,在一定程度上实现了被告人人权保护和公共利益的平衡,值得借鉴。完善证人出庭作证制度,应以案件"客观需要"为标准,以追求事实真相为出发点,以人权保护和人性回归为落脚点,遵循限制性处罚原则和禁止利益冲突原则,提高相关规定的可操作性。因此,不宜盲目追求证人高出庭作证率。     

对中国社会经济改革进程中收入不平等的认知:一个同期群组的分析

不同群组在对收入不平等的态度上是否会因为个人经历不同的时代背景而产生差异?运用2005年中国综合社会调查的数据,比较四组拥有不同时代背景经历的群组,在转型期对收入不平等的看法。研究结果显示,年龄较老的群组对于收入不平等持有更多批评而年轻群组则对收入不平等有着更为宽容的态度,考虑不同群组中的不同自身利益之后并不能大幅度降低人们对收入不平等的态度上的差异。研究进一步表明,更重要的中介因素是人们对社会公正的信念。     

寓言与民主

民主问题是当前的热点问题,中国民主问题屡遭西方国家的指责。民主是一种社会制度,没有普适的民主。我们需要借鉴西方民主发展的成果,但民主建设只能走自己的道路。在此将通过三则寓言,对什么是民主、专制做出阐释,对民主建设提供有益的思索。无论正确与否,这种探索都是有意义的,这本身就体现了民主。     

休谟的正义观述评

本文讨论休谟的正义理论。指出正义起源于人性的有限慷慨与资源的相对匮乏;正义的主要作用是确立财产权;正义的有效实现依赖政府保护;同时指出休谟正义理论的合理性与局限性。

“政教合一制”是一种特有的政治制度,然而在对这一制度的判断标准上学界却有不同的意见,文章通过西藏地方和中世纪西欧“政教合一制”形成的比较,提出作者自己的判断标准。     

From a ‘sort of Muslim’ to ‘proud to be Alevi’: the Alevi religion and identity project combatting the negative identity among second-generation Alevis in the UK

ABSTRACT

This article explains how the negative identity of second-generation Alevi-Kurds in the UK has been transmitted intergenerationally, linked to their history of persecuted exclusion in Turkey and to the transnational settlement of Alevi migrants in the UK, and how this sense of marginalization and invisibility in the receiving country can be addressed. Education is identified as a starting point for the underachievement and disaffection of Alevi pupils, which can lead them into more serious trouble and descent into the rainbow underclass. In the quest to tackle this identity issue, a unique collaborative action research project was set up between an Alevi community centre, local schools and a university to develop the world’s first Alevi lessons as part of the compulsory Religious Education curriculum in British schools. The Alevi Religion and Identity Project is described and evaluated in terms of its outcomes, especially its contribution towards a more positive Alevi identity as a reflection of a vibrant community.

宗教与应对密切相关,当宗教的行为和思想用于压力应对时,这样的应对便称为宗教应对。文中对宗教应对的内涵、宗教对我国少数民族压力应对的影响进行了阐述,指出宗教应对是少数民族压力应对的一种特殊方式,包括宗教行为应对和宗教思想应对。研究少数民族宗教应对具有重要的现实意义。
