中国不动产物权变动交错模式立法--评《物权法草案(三次审议稿)》相关规定

提出<中华人民共和国物权法草案(三次审议稿)>既存在着"意思主义"规定,又存在着"债权形式主义"的规定.认为这种交错模式立法选择在理论上和实践上均存在缺陷,难以与相应的不动产登记制度相协调.建议立法应对两种模式进行权衡采纳其一.

商事侵权行为概念研究

目前的法学界没有明确提出商事侵权行为这个概念,但是,商事侵权行为由于具有其自身特点,如果不将其与一般民事侵权行为相区别,将不利于被侵犯的商事权利的保护.文章从商事主体具有营利性的特点出发,分析了商事侵权行为所应当保护的客体--商事人身权的内涵和外延,最终提出了商事侵权行为的概念和特征.

分税制是我国财政体制的重要内容,通过对我国分税制历史的简要回顾,分析了分税制在立法方面存在的主要问题:缺少完整立法,地方税权小,中央和地方事权划分不合理,转移支付有待立法.针对这些问题,结合我国实际情况,提出立法上的建议:制定作为分税制依据的税收基本法,给予地方一定的税权,合理划分中央和地方的事权、财权,制定转移支付法.     

电子商务中隐私权保护制度研究

本文以我国电子商务的发展环境为背景,探讨了电子商务中隐私权保护的必要性和现实性,并提出相应的隐私权保护原则和保护方式.     

The Politics of Sexual Citizenship: Negotiating Acts of Citizenship Among Non-Heterosexuals in Hong Kong

ABSTRACT

The notion of sexual citizenship has been developed over the past two decades, and its discussion has been expanded to other regions. This article investigates the claiming of rights by non-heterosexuals in Hong Kong to achieve two objectives: to articulate the importance of the rights claiming process, particularly regarding how non-heterosexuals are being transformed to become claimants through rights claims, and to extend the notion of sexual citizenship in East Asia, particularly in the Hong Kong context. The findings show four distinctive characteristics of sexual citizenship in Hong Kong. Non-heterosexuals are found to have faced different struggles and barriers before or during the process of claiming rights, including restricted welfare rights access in various social institutions. Furthermore, the development of sexual citizenship in the Hong Kong local context is found to be limited.     

Algorithm for determining whether various two-level fractional factorial split-plot row–column designs are non-isomorphic

The confounding and aliasing scheme for fractional factorial split-plot designs with the units within each wholeplot arranged in rows and columns is described and illustrated. Isomorphism for this design type is described, together with a procedure which considers extensions of the concepts of wordlength patterns and letter patterns that can be used to test isomorphism between designs. Using in part this isomorphism testing procedure, a construction algorithm that may be used to obtain a complete set of such non-isomorphic two-level designs is described. Software based on this construction algorithm was used to obtain a complete set of non-isomorphic designs for up to five wholeplot factors, five subplot factors and up to 64 runs, which is presented as a table of designs. To aid the experimenter in distinguishing between competing designs, the estimation capacity sequence for each design is presented.     

Ranked set sampling with unequal samples for skew distributions

A ranked set sampling procedure with unequal samples for positively skew distributions (RSSUS) is proposed and used to estimate the population mean. The estimators based on RSSUS are compared with the estimators based on ranked set sampling (RSS) and median ranked set sampling (MRSS) procedures. It is observed that the relative precisions of the estimators based on RSSUS are higher than those of the estimators based on RSS and MRSS procedures.
