视阈融合下的知识产权诠释

法哲学、哲学诠释学的任务从来就是认识知识产权本质及知识产权制度本质。其目的是为了更好地安排知识产权制度,而其困难在于法律专业的分工导致法律思维的专业限制,只有超越知识产权法才能看清知识产权及其制度本质。用法哲学思维、辩证逻辑的方法分析知识产权制度,探索不同性质的制度结构及相互关系,证明知识产权制度本质是一个均衡对价的制度安排,蕴涵了高超的政治智慧。知识产权立法只有具备这种政治智慧,才能使人们心悦诚服地按照知识产权规则从事生产和生活。     

Separate education and hegemonic domination: civil society challenges in the Arab-Jewish city of Jaffa

The case of education in the mixed Arab-Jewish city of Jaffa, Israel, demonstrates the dialectical role of education in conflict-affected societies. As scholars of transformative education and critical pedagogy have noted, education tends to serve as an instrument of the dominant ideology of social and political elites, yet it is also a significant arena of civil society, where diverse and often subversive identities and values can be asserted. This duality is particularly evident in conflict-affected societies, where, as Gallagher points out, education can either contribute to conflict or challenge it, through structure of schools, contents of the curriculum and the routes and opportunities available to young people. The education system in Jaffa demonstrates the ways in which schooling separation, lack of multiculturalism in the curriculum and discrimination in education enforce elite domination. At the same time, it demonstrates how community members and civil society organisations may use the education system as an arena for challenging the status quo of inter-community relations in conflict-affected societies, through initiatives that may occur due to necessity, response to negative change or ideological challenges to domination.     

对话协商：构建人类命运共同体的内核与特质

习近平总书记提出的人类命运共同体,立足当今中国所处的时代方位,放眼当代世界发展大势,是一种全球治理新理念,是为人类文明发展提出的新方案。这一方案的内核与特质是“对话协商”,即遵循“平等相待”“相互尊重”的对话协商理念,建设“对话不对抗、结伴不结盟”的对话协商伙伴关系,建立“以对话解争端、以协商化分歧”的对话协商沟通机制。     

共享单车需求评估及调度方案设计

共享出行是当下流行的一种共享经济模式,由于过去几年共享单车企业为占据市场而过度投放车辆,单车停放点供需不均衡,导致正常的社会秩序受到严重扰乱。以西安市13个县区为样本,以人口密度、人均可支配收入和公交车站的密度为指标,用熵值法计算样本指标的权重,得到比重矩阵之后计算指标信息熵值和信息效用值,进而对共享单车需求进行评估,并设计调度方案。研究发现,人均可支配收入的信息价值系数最大,即人均可支配收入对共享单车的需求评估结果的贡献程度最大。根据需求评估结果做出的热力图,发现西安市的共享单车需求量可以用同心圆模型表示,对不同的半径范围内赋予相应的比例系数,即可求出每个区域的共享单车需求量;共享单车的调度即优化问题的求解,通过随机产生初始路径,以调度路径最短为目标函数,并设置调度车的容量、最大行驶距离、调度的车辆数等约束条件,运用遗传算法求出每次调度的路径长度、路径分布以及所需的调配车数量。提出了合理投放、规划电子围栏停放点、基于大数据和空间要素的车辆调度、引入混合管理模式等可行性建议。     

A modified two-stage approach for joint modelling of longitudinal and time-to-event data

Joint models for longitudinal and time-to-event data have been applied in many different fields of statistics and clinical studies. However, the main difficulty these models have to face with is the computational problem. The requirement for numerical integration becomes severe when the dimension of random effects increases. In this paper, a modified two-stage approach has been proposed to estimate the parameters in joint models. In particular, in the first stage, the linear mixed-effects models and best linear unbiased predictorsare applied to estimate parameters in the longitudinal submodel. In the second stage, an approximation of the fully joint log-likelihood is proposed using the estimated the values of these parameters from the longitudinal submodel. Survival parameters are estimated bymaximizing the approximation of the fully joint log-likelihood. Simulation studies show that the approach performs well, especially when the dimension of random effects increases. Finally, we implement this approach on AIDS data.     

Estimation in the Positive Stable Shared Frailty Cox Proportional Hazards Model

Shared frailty models are of interest when one has clustered survival data and when focus is on comparing the lifetimes within clusters and further on estimating the correlation between lifetimes from the same cluster. It is well known that the positive stable model should be preferred to the gamma model in situations where the correlated survival data show a decreasing association with time. In this paper, we devise a likelihood based estimation procedure for the positive stable shared frailty Cox model, which is expected to obtain high efficiency. The proposed estimator is provided with large sample properties and also a consistent estimator of standard errors is given. Simulation studies show that the estimation procedure is appropriate for practical use, and that it is much more efficient than a recently suggested procedure. The suggested methodology is applied to a dataset concerning time to blindness for patients with diabetic retinopathy.

本文作者通过 2 0世纪治史学路的回识 ,认为进化论———五形态论是 2 0世纪中国民族史学通向现代化的关键环节 ,宏观共性是其学理的基本特征。而中国史学的传统特性是宏微通观 ,它可以在弘扬与兼收西学各种学理的基础上实现世界历史位置的自然回归。     

共享积极情感：孤独症儿童干预中的作用机制及提升策略

孤独症儿童在情感理解和表达上存在较大障碍,积极情绪较少,难以与其他个体体验共享积极情感。作为微观的心理单元,积极情绪和共享积极情感同时作用于个体与环境,调节着个体的人际活动进程和内部动机。共享积极情感在生理、心理和社会三个层面对干预双方产生积极效应:形成生长导向的干预模式,延长互动时间,增加互动频率,提升互动质量。在临床中,干预人员和父母可以通过提升联合注意水平、增强游戏性以及表达积极情感等策略来帮助孤独症儿童体验共享积极情感。未来孤独症儿童研究有必要将共享积极情感视为干预目标的重点,重视与共享积极情感有关的笑行为在孤独症儿童早期筛查工作中的作用。     

集群共享性资源对中小企业包容性增长作用机制研究--以浙江中小企业为例

用问卷调查法对"集群共享性资源对中小企业包容性增长的作用机制"这一科学问题进行了研究。实证结果表明,集群共享性资源是影响中小企业包容性增长的重要决定因素,集群制度环境和企业能力是影响集群共享性资源和中小企业包容性增长关系的重要因素。研究结论揭示了集群共享性资源对中小企业包容性增长的影响作用,同时剖析了企业能力和集群制度环境对中小企业包容性增长的作用机理。
