男女平等的法律并不是最好的法律——以女性从政和婚姻诉讼为视角

从性别的视角来考察法律发现,现代法律与过去法律相比,一个最大的进步,就是消除了歧视妇女的条款。而现代法律的一个最大缺陷,则是忽视了两性区别,用毫无性差的法律规定男女同权、男女平等,其结果是男女根本不可能平等。因而,这种男女平等,实际上是用形式上的平等掩饰了事实的不能平等,是一种包装了的男女不平等。所以,男女平等的法律,并不是最好的法律。只有体现性别差异、补充女性能力、实现男女无利差的法律,才是最好的法律。     

基于交叉学科视角对和谐权理论的重构

基于经济学、管理学、生物学和医学的理论框架,对和谐权理论的机制和价值做一交叉学科的分析,即个人、群体和社会三者在无各自＂私益＂的前提下,实现协调的行动,从而达到共赢的局面。采用以交叉学科构建的和谐权理论进行分析,展现和说明了在传统的人权理论所不能解释和无法权衡的领域,和谐权理论仍可进行有效运作。     

“Spokes in the wheel” and how policy gains can diversify a social movement

ABSTRACT

Activists often use their resources to pursue protective legislation, like anti-discrimination or environmental protection laws, and the results are often compromised versions of what they wanted. This process of political institutionalization requires ongoing and robust mobilization to strengthen these resulting policies or prevent them from being rescinded all together. Therefore, to understand the pros and cons of political institutionalization we must understand the recursive effects between policy reform and consequent mobilization. Quantitative and qualitative data on the animal advocacy movement, a movement existing for over a century, are used to explore the effects of policy gains on consequent mobilization and explore whether policy gains were followed by de-escalation of protest forms. The findings indicate that policy gains for animal welfare do not de-escalate mobilization, both in terms of the use of disruptive collective action and proliferation of organizations. The article explores the ways that infighting over the terms of policy reform may be an important factor in diversifying the movement.

财产权是公民用以防御公共权力可能侵犯的基本权利。长期以来，由于思想观念滞后、借公共利益的名义侵害公民的合法财产、行政法律制度不健全等原因，使得财产权利缺乏全面有效的保护。财产权利的保护有利于我国民主政治的建设，有利于市场经济的发展，有利于和谐社会的构建。

Not Threat,But Threatening: Potential Causes and Consequences of Gay Innumeracy

Existing literature on numeracy suggests that people are likely to perceive outgroups as larger if the group is perceived as threatening. However, some studies also suggest that numeracy is a function of wishful thinking or even a lack of political knowledge. We engage the literature on numeracy of the gay and lesbian population by employing data from 1977 and 2013 surveys of American adults. We examine the factors that are associated with estimating the gay population. Next we explore how innumeracy may shape attitudes about homosexuality and gay rights. Our findings suggest that estimates of the gay population are partly a function of knowledge, and perhaps wishful thinking, but not threat. However, our analysis also reveals that higher estimates of the gay population are associated with less support for gay civil rights in the current era and were not a factor in the past.
