从压制型刑法到自治型刑法——兼论我国刑罚制度的完善及合理适用

与政治上专制相对应,人类社会早期的刑法,其干预广泛,裁判者自由裁量权大,法律道德主义盛行,刑法呈现压制型特征;近代以降,自治型刑法逐渐成为主导性的刑法模式,在观念、功能、原则、规则、司法运作等方面呈现出不同于压制型刑法的特点.我国当下刑法正艰难地从压制型刑法走出,其艰难表现为观念层面的压制型,原则、规则层面自治型的不彻底性.于是,在以法治国背景下,建构自治型刑法当是我们的选择.     

走不出命运怪圈

张恨水小说《夜深沉》中的杨月容是典型的女伶悲剧形象.残酷的生存环境在把她推向人生炼狱的同时,铸就了她抗争的秉性.但抗争结果却没有摆脱沦为有闲阶级享乐工具的命运.从卖唱维生的大杂院大众情人到供有闲阶级享用的剧院明星,再到觉醒后毅然逃出堕落围城回到民间重操旧业以糊口,她像在沉沉黑夜里走了一个"鬼打墙"的怪圈.这是一个不以抗争者意志为转移的命运怪圈.杨月容最终没有走出这个怪圈,却以抗争失败后的反思与觉醒实证了女伶悲剧人生的社会必然性.     

Measuring Infant‐Mother Attachment: Is the Strange Situation Enough?

The purpose of this study was to examine the validity of a new procedure for assessing infant-mother attachment. Sixty children (34 in child care) and their mothers were seen in the Strange Situation (SS) at 17 months and in a new attachment assessment, the California Attachment Procedure (CAP), which does not involve mother-child separations, at 18 months. Overall, children were more likely to be classified as secure in the CAP (83% vs. 67%), but this was particularly true for children with experience in routine nonmaternal care. Of the children in nonmaternal care who were insecure in the SS, 91% were secure in the CAP, whereas of the maternal-care children who were insecure in the SS, only 44% were secure in the CAP. Attachment security in the CAP was more highly correlated with observed maternal sensitivity than was attachment security in the SS, particularly for children in nonmaternal care.     

技术抑制的法律规制——以汽车工业为主要视域

单边技术抑制主要表现为拒绝许可专利、不使用专利,在汽车及其他技术领域都会遇到,对其可以考虑适用强制许可,但对其追究反垄断法责任则存在较多争议。联合技术抑制主要指两家以上企业以协议或其他方式联合限制新技术的研发和应用,在美国汽车业发展史上,该问题曾经比较突出,为此,美国司法部进行了锲而不舍的反托拉斯指控。从我国目前汽车工业领域技术进展、专利布局情况看,未雨绸缪、提前研究技术抑制与反抑制相关问题以及制定知识产权反垄断法规是有必要的。     

H_(01)~○—H_(10)~□高功率定向耦合器的改进设计

提出了一种从圆波导 TE_(01)模到矩形波导 TE_(10)模的定向耦合器的设计方法。利用这种方法设计的用于高功率回旋速调管的-50dB 定向耦合器表明,改变矩形波导尺寸可以提高对圆波导 TE_(11)模的抑制度,而调整最后两个耦合孔的距离则可以优化方向性。

Listening to children imagining gender: observing the inflation of an idea

Using three of the clinical articles in this special issue of the Journal of Homosexuality as examples, the author attempts to show how their views of gender may influence clinicians' conceptualizations and treatment choices in response to children diagnosed with gender identity disorder (GID), or gender dysphoria. In particular the author argues that the belief that gender is a psychophysiological entity that is organismic and transhistorical, that is, the view known lately as essentialism, promotes more invasive interventions (e.g., endocrinological and surgical) and mistakenly deemphasizes psychological therapies as a clinical response to the suffering of trans children. He tries to show that the drawbacks of essentialism and its correlated treatment approaches are twofold, that a) they promote treatments with insufficient attention to our limited knowledge regarding their safety and efficacy, and b) they advance a reified differentiation of the genders that is politically problematic. The author suggests that a better response to trans children would be one that emphasizes the child's broadly subjective role in his or her construction of transgressive, gender-related psychological and interpersonal phenomena (both painful and not), thus, offering a deeper validation for trans children's challenges to our gender system.
