中小跨国公司对海外子公司控制的规范化问题研究

随着企业国际化发展,我国中小跨国公司逐渐增多,加强对中小跨国公司海外子公司的有效控制日显重要。这即要求应健全相应的责任、选拔、激励、监督等机制,以及有效推进海外经营地人才的本土化建设等。     

Antecedents and Outcomes of Political Tie Intensity: Institutional and Strategic Fit Perspectives

Although international nonmarket strategy research has highlighted the importance of political ties, it is still unclear why some foreign subsidiaries are more politically active than others and what conditions may render political practices beneficial in a host country. We argue that foreign subsidiary political tie intensity—the extent to which senior managers provide time and resources in informally dealing with government officials for nonmarket purposes—will be influenced by political institutions in their parent's home country, especially when the MNE parent attempts to protect foreign subsidiary resources. Additionally, we assert that fit between a parent's home country political institutions and foreign subsidiary political tie intensity will positively affect subsidiary performance. We employ primary data collected from 181 foreign subsidiaries in the Philippines and find support for our hypotheses. This study advances international nonmarket strategy research by highlighting how an MNE's home country political institutions shape subsidiary political networking and strategic performance outcomes in host country environments.

欧盟成立前欧共体立法已具备三个特性,即直接效力原则、优先原则及先占原则,在欧盟成立后,其立法又具有了新的特性即从属原则。论述了欧盟立法的上述特性,试图证明欧盟主体资格演进的格局是从一体化组织向联盟国家迈进。     

地方财政自主的宪政逻辑——辅助原则的分析进路

辅助原则不仅是个人、社会和国家之间的位阶排序,而且是一种由下至上的组织原则。通过德国、日本以及欧盟的实践,辅助原则已经由宗教教义转化为宪政设计的基本准则,因为它与宪政的人权保障、分权制衡等理念保持一致。辅助原则为地方财政自主提供正当性基础。目前,依据辅助原则,需要建立与之相适应的地方财政自主的具体制度包括,加强地方预算民主,完善地方税费制度及规范财政转移支付。     

论孔学的主体思想与秩序和谐理想

"礼"和"仁"是孔子思想的重要范畴,"贵礼重仁"是孔子思想的主体.本文认为春秋时期礼在政治和社会生活中仍充当重要角色,也给普通士人提供了进身的阶梯,孔子贵礼是和当时的礼治思潮相适应的.尽管礼是社会和谐秩序建构的重要手段,由于春秋战国时期社会面临着新的整合,因此儒家的秩序理想难以化为现实,但孔子的秩序和谐理想,具有重要的历史和现实意义.     

我国公平竞争审查例外制度的适用困境与对策

近年来,我国持续深入推进公平竞争审查,强化竞争政策的基础性地位。出于协调竞争政策与其他经济政策的考量,我国公平竞争审查制度设置了例外制度安排,允许实施具有限制竞争效果但符合规定情形和条件的政策措施。但是,由于相关规则抽象模糊,例外制度的适用存在滥用或误用的问题,有损公平竞争审查制度的实效。当前,《公平竞争审查制度实施细则》已正式出台,但例外制度的适用在实体与程序方面均存在较多问题。为了构建符合我国国情的公平竞争审查例外制度,在实体层面,应根据比例原则和附属限制理论明确例外情形和限制性条件;在程序层面,需要形成科学可行的操作流程和监督机制。     

Mapping and managing productive organizational energy over time: The Energy Pattern Explorer tool

To strategically manage the deployment of collective human resources toward performance, managers must recognize, interpret, and align the volatile resources of productive organizational energy. Despite relevant prior work, research and practice still lack a comprehensive approach toward analyzing and managing energy patterns over time. We develop a framework for temporal configurations and prototypical trajectories of productive organizational energy. We then introduce the ‘Energy Pattern Explorer’ as a strategy tool to: (1) identify and predict actual patterns of productive organizational energy in organizations, and (2) suggest energy leadership activities specific to current and anticipated changes and patterns of productive organizational energy. We provide examples of how managers can use this tool and conclude with suggestions for research and practice.     

2012年上海市民对物价上涨总体评价

2012年,上海CPI总体呈现出稳步下降的态势,物价涨幅较2011年显著回落。物价上涨势头得到遏制,除了经济增速放缓等客观因素影响,也反应出政府一系列稳定物价的政策措施发挥了积极作用。2013年上海仍要准确把握调控节奏,强化政策落实效果,构建稳定物价的长效机制,把主副食品等价格控制在合理范围内,守住保障市民基本生活的底线。
