临时股东会议召集权纠纷中股东救济法律问题

股东对违法召集的临时股东会议加以救济的重要途径,是自行召开临时股东会,但其须先行使临时股东会召集请求权。此外,股东通过请求法院撤销临时股东会决议这一事后救济,不享有表决权的股东也享有撤销权。股东还可以通过申请法院先予执行以及发出暂缓召开临时股东会的通知的事前救济方式。不过,先予执行这一救济方式的法定条件并不能适用于中止临时股东会的召开,适用先予执行所需时间也不能满足中止临时股东会议召开的紧迫性,因此,需要加以修改。通知这种救济方式,无论是内容还是效力都需要完善。

拉萨市流动人口调查报告

在西部大开发战略实施过程中,西部城镇的开发项目和服务业的兴起吸引了大量的外来流动人口,他们当中有许多人来自东部和中部的汉族地区,这些流动人口为西部城镇的经济发展带来一定的动力,但同时与本地劳动力在就业市场上形成一定的竞争,加之具有不同的民族身份与文化习俗,在与本地人的互动中又增加了民族、宗教等复杂因素。拉萨作为西藏自治区的首府,近年来也出现了不少流动人口,本文即是作者2005年在拉萨城区开展的流动人口问卷调查的分析报告,对拉萨流动人口的基本人口、经济特征作了系统的分析,同时也从民族关系的角度分析了流动人口对当地社会的影响。     

Facilitating labour migration from Latvia: strategies of various categories of intermediaries

ABSTRACT

Within the broad category of migration industries, we focus on intermediaries between employers in Norway requiring migrant labour, and suppliers of Latvian workers willing to migrate. Mediation of labour power is a regulated domain in both countries, but regulations may change: regulations in Latvia have become more lenient, whereas in Norway, they have become stricter in response to increased migration. Intermediaries must be responsive to fluctuations in labour supply and demand, as well as to changing regulations. Today, destination countries are experiencing an overabundance of available migrant labour. This buyer’s labour market represents a challenge for intermediaries, spurring adjustments and side-stepping of regulations. Formal temp agencies are supplemented by informal ones, challenging the conceptualisation of intermediaries. Also work migrants may become agents, shaping new forms of intermediation and expanding the concept of ‘migration industry’ to encompass facilitation of labour migration through social networks. In this article, we construct typologies inductively, establishing categories meaningful in the complex context of labour migration from Latvia to Norway. We distinguish between mediation through formal versus informal agencies, establish characteristics of agencies versus individual social network-based mediation and discuss mediation through the posting of workers by companies.

中国流动人口带眷系数及其影响因素

中国流动人口家庭由于空间分隔,家庭成员居住生活在不同地域,其家庭结构不同于通常家庭的结构。基于对流动人口家庭结构划分、迁移人员及其序次的分析,本文使用2010年下半年全国流动人口动态监测数据,界定了流动人口家庭化迁移的带眷系数概念及其表现形式,分析了劳动年龄流动人口的人口学因素、流动居住因素、在居住地的收入消费等因素对流动人口带眷系数的影响,总结得出促进和阻碍流动人口合理流动的一些主要因素。     

中国"小组"政治组织模式分析

小组,是广泛存在于中国各级党政机关中以议事协调机构和临时机构名义存在的一种特殊组织模式。基于制度层面的静态分析,影响小组产生并长期存在的因素,主要包括政府横向间机构设置的小部门结构、政府纵向间职责配置的职责同构格局等结构性因素,单任务—泛职能的功能性因素,分管型副职模式的制度性因素;其类型包括:根据存在时限可划分为常设型、阶段型、短期型,根据权属关系可划分为职责同构型、权责自属型。基于技术层面的动态分析,小组的中轴依附的组织结构特点,虚实结合的存在方式,倍量增减的运行过程,这三个要素共同构筑了小组独具特色的运转系统。     

Stochastic differential equation systems for an SIS epidemic model with vaccination and immigration

Two Itô stochastic differential equation (SDE) systems are constructed for a Susceptible-Infected-Susceptible epidemic model with temporary vaccination. A constant number of new members enter the population and total size of the population is variable. Some conditions for disease extinction in the stochastic models are established and compared with conditions in deterministic one. It is shown that the two stochastic models are equivalent in the sense that their solutions come from same distribution. In addition, the SDE models are simulated and the equivalence of the two stochastic models is confirmed by numerical examples. The probability distribution for extinction is also obtained numerically, provided there exists a probability for disease persistence whereas the expected duration of epidemic is acquired when extinction occurs with probability 1.

政治社会化,包括社会的政治化及社会传播政治文化的过程和社会成员获得政治文化的过程两个方面,思想政治工作是政治社会化的具体实现形式,在形成政治认知、校正政治评价、培养良好的政治心理等方面具有重要作用。思想政治教育开展的状况直接决定着政治社会化的效果。当前发挥思想政治工作政治社会化功能需要明确思想政治工作的价值定位,坚持以强化政治认同、培养群众的政治参与意识及维护社会稳定和社会发展的大局为价值取向,不断提高劳动者素质,促进生产力提高和社会进步。
