对新疆两市社区体育现状的调查研究

该文运用问卷调查法、统计法和访谈法,对居民参加社区体育锻炼的情况进行调查和研究。结果显示,社区居民的体育意识较好,参加体育锻炼的手段丰富多样,居民参加体育锻炼以自行组织为主,并以选择清晨参加锻炼者居多。而硬件设施不够完善、缺乏科学的组织和管理及专业的技术指导等,是影响社区体育发展的因素之一。     

An Inquiry into Liberty,Slavery, and Thomas Jefferson’s Place in American Memory

Abstract

This article presents a guided inquiry into Thomas Jefferson’s place in American memory. It centers on Jefferson’s liberty-based articulations and his involvement in slavery, which are paradoxical when juxtaposed. Evocative primary sources and competing secondary sources ground the inquiry. Discipline-specific strategies direct students through the stages of inquiry. Close reading, text-based writing, and informed action intertwine with history literacy, historical thinking, and historical argumentation. Discussion focuses on logical curricular extensions.     

竞业限制条款法律适用及其完善

企业基于商业秘密之保护和维持永续竞争力,通常要求员工签订竞业限制协议或条款,其中涉及商业秘密保护权和员工劳动就业权的冲突。因我国目前相关法律规定零散而不成体系,因此应合理构建竞业限制条款的具体制度,规定一般员工的法定竞业限制义务,明确竞业限制的主体、适用范围、经济补偿、违约责任、期限等,准确理解违反竞业限制义务的责任构成及其责任形式是实现权利冲突的合理解决和劳资双方共赢的最佳途径。     

我国商业信用的资源再配置效应与强制性特征——基于工业企业数据的实证检验

商业信用的资源再配置假说认为,商业信用可实现银行信贷资金的再配置,从而提高资源配置效率。以2004—2007年中国工业企业微观数据为基础,对我国商业信用的资源配置效应以及恶意拖欠基础上的强制性信用特征进行的检验结果表明,在我国,获取更多银行信贷的企业(包括国有企业)不仅未能提供更多商业信用,反而获取了更多商业信用,而市场势力的存在可能是导致这一配置结果的扭曲性因素;拥有更多应收账款的企业倾向于扩大应付账款规模,从而使企业间债务关系呈现出较强的"三角债"趋势。此外,与出口企业相比,产品内销企业在商业信用的供给中面临着更多的坏账损失风险。这说明我国商业信用的产生具有显著的恶意拖欠特征与违约风险。我国的商业信用不仅未能改善资源配置效率,反而增大了市场的交易费用和运行风险。     

劳动合同法视域下福建自贸区弹性用工研究

弹性用工是一种灵活的用工方式，是实现人力资源最优配置的有效途径。我国对弹性用工不合理的制度设计，限制了弹性用工效用的发挥，这些制度包括：劳动合同期限制度、劳务派遣制度、特殊工时制度、非全日制用工制度。     

Remaking the labour movement in Italy: the revival of strikes at Fiat-Chrysler Automobiles in 2015–17

ABSTRACT

After the Fiat-Chrysler merger in 2009, CEO Sergio Marchionne imposed a drastic reorganization of labour relations in Italy’s plants, precipitating a profound crisis of the system of industrial relations in the country. But between 2015 and 2017 a significant section of workers at Melfi, Atessa and Termoli plants went on strike against compulsory overtime and labour intensification, establishing links with grassroots unions that successfully organized in logistics. The metalworkers’ union FIOM-CGIL, however, delegitimized the union representatives who resisted Marchionne’s plans. In this article, we trace the context and development of these still little-known strikes. Because of their growing institutionalization, we argue, the confederal unions (CGIL, CISL, UIL) have both failed to mobilize workers and repressed workers’ attempts to resist the deterioration of their conditions. The strikes at FCA and in logistics, however, show that new forms of radical unionism are emerging, pointing to new possibilities for working-class organizing.     

Dividend barrier and ruin problems for a risk model with delayed claims

In this paper, a compound Poisson risk model in the presence of a constant dividend barrier is considered. Two types of individual claims, main claims and by-claims, are defined, where every by-claim is induced by the main claim and and the time of delay for the claim is assumed to be random. A system of integro-differential equations with certain boundary conditions for the expected discounted penalty function is derived. We show that its solution can be expressed as the solution to the expected discounted penalty function in the same risk model with the absence of a barrier plus a linear combination of two linearly independent solutions to the associated homogeneous integro-differential equation. Using systems of integro-differential equations for the moment-generating function as well as for the arbitrary moments of the sum of discounted dividend payments until ruin, a matrix version of the dividends–penalty type relationship is derived. We also prove that ruin is certain under constant dividend barrier strategy. The closed form expressions are given when the claim amounts from both classes are exponentially distributed. Finally, a numerical example is presented to illustrate the solution procedure.     

生产者货币计价决定因素的实证研究

利用12个发达国家和发展中国家的非平衡面板样本数据,对微观、宏观和其他因素对生产者货币计价(PCP)的影响进行实证研究,指出经济规模、市场份额、金融市场的发达程度、币值的对内稳定性和产品差异化程度是最主要的影响因素,而出口商的谈判能力、币值的对外稳定性等因素也对PCP的选择有一定影响。根据实证检验结果,对人民币作为贸易计价货币的条件进行评估,发现其优势在于我国的经济规模、出口商的市场份额及其谈判能力以及人民币汇率的相对稳定性; 劣势在于相对落后的金融市场、不可预期性较大的通货膨胀水平以及产品的差异化程度。     

英国脱欧对中英贸易的影响分析

英国公投脱欧的决定,是由英国与欧盟长久以来的政治分歧与经济发展受限等原因,以及移民负担过重这一导火索共同推动的。对英国与欧盟的贸易关系进行分析,发现英国在欧盟中占据重要的贸易地位,与欧盟进出口贸易关系密切。对英国与中国的贸易现状进行分析,发现英国与中国的贸易发展良好,但贸易结合度不高。英国脱欧后,不再享有作为欧盟成员国的优惠贸易条件,可能产生中英进出口贸易额增多、贸易规模扩大、中英贸易顺差减小以及中英贸易政策出现新格局等影响。     

原产地多元化视角下的地方产业集群升级研究

地方产业集群升级是区域经济发展的重要研究主题,由于中国特别是东部地区产业集群具有"天生全球化"特质,基于价值链的集群升级理论在适用性上存在局限。本文以原产地多元化为切入点,依据产业集群嵌入全球价值链的程度,对其通过原产地多元化实现升级的途径进行探讨,并结合案例分析加以验证。进而提出基于原产地多元化实现地方产业集群升级的主要内容和政策建议,以期为现实的产业集群发展和区域经济政策制定提供启示。
