在香港教育改革发展的政策制定与实施中,教育咨询研究机构发挥了重要作用。体系完备,运作协调的教育研究及咨询机构以独立的姿态参与政策过程、沟通政府与民众关系、制订方案影响决策、发布研究报告影响舆论,有效发挥了现代咨询机构的功能和作用。其在参与教育改革制定与实施过程中体现出来的开放、互动、理念引导、共识凝聚、过程监督等特点值得思考和借鉴。     

协商执法:行政执法新模式初探

协商执法既是现代行政民主化的要求,也是行政主体灵活应对复杂多变的执法状况的需要,在行政执法中引入协商机制具有民主正当性,并且有利于提高执法效率,彰显以人为本的行政理念,营造和谐的执法秩序。为使执法协商机制发挥更加积极的作用,必须构建完善的行政执法协商制度。     

政府双重干预下基于渠道商价格欺诈的农产品交易演化博弈模型

个体小规模、分散式的生产方式以及信息不对称的经营环境,导致了我国农户在农产品供应体系中的弱势地位,政府通常采用保护价收购和价格补贴等行政干预手段保护农民利益。论文构建了信息不对称条件下,考虑渠道商价格欺诈的农户、渠道商以及政府的三方演化博弈模型,分析了政府“惩罚”+“保护价收购”双重干预下的博弈演化过程及稳定策略,探讨了政府监管的边界问题,并应用实例进行了验证。研究结果表明：政府监管的概率与选择“欺诈”策略的渠道商规模和选择“销售”策略的农户规模相关;渠道商选择“欺诈”策略的概率随农产品交易规模的增大而提高,随罚金额度的增加而下降;政府的保护价收购政策不一定能保证积极的效果,不合理的折价系数可能破坏现有的市场秩序。说明了合理、适度的市场监管对于维护农产品交易市场秩序具有重要意义。     

从“官吏分途”到“群体三分”:中国地方治理的人事结构转换及其政治效应——对周雪光《从“官吏分途”到“层级分流”:帝国逻辑下的中国官僚人事制度》一文的一个补充

官吏分途作为古代中国国家治理的人事制度安排,依然具有其延续性和再生性。中国地方和基层治理中官僚群体、派生群体和雇佣群体的三分,与官吏分途有着异曲同工之妙。本文作为对周雪光《从“官吏分途”到“层级分流”:帝国逻辑下的中国官僚人事制度》一文的一个补充,提出群体三分是更接近官吏分途的延续者与变异者。层级分流与群体三分,共同构成了地方和基层治理的主干。官吏之间在数量和规模上的不对称与目前官僚群体、派生群体和雇佣群体在数量和规模上的不对称是相通的。雇佣群体是影响地方和基层治理绩效的重要因素。进入层级分流的精英群体或干部群体,除了具有经济学和社会学意义上的理性之外,还拥有政党所赋予的使命。使命政治是对晋升锦标赛政治的一个补充,它是解释中国的巨变和崛起的重要视角之一。     

Self-Reported Incidence of Physical Violence in College Students

Abstract

A survey of a college student population indicates that physical abuse is prevalent in our society. The self-reported data were found to be similar to that occurring in the literature on parent-reported child abuse, documenting that approximately one-third of college students had a history of moderate abuse and 5 to 10% had a history of a severe abuse during their developmental years. Through an awareness of its high prevalence, the health care provider will question a history of physical violence when evaluating a student with a medical or psychosocial complaint and appropriately plan a management program including therapeutic counseling to decrease the effect of the prior or current physical abuse.     

论中国特色协商民主制度的设计原则

在分析协商民主诸要素的基础上,提出中国特色协商民主的制度设计应当遵循五项基本原则：协商主体的平等性与多元性原则,协商客体的理性与包容性原则,协商方式的多样性与程序性原则,协商过程的公开性与协商性原则和协商结果的合法性与责任性原则,以期为解决当代中国协商民主中存在的问题和完善中国特色协商民主的制度设计提供有益启示。     

Social Justice Advocacy Readiness Questionnaire

Summary

Social service providers of consultation, counseling, and education can benefit from determining their social justice awareness, knowledge, and skills to ensure culturally competent practice and to challenge the multiple oppressions facing clients and staff on individual, cultural, and institutional/systemic levels. The Social Justice Advocacy Readiness Questionnaire (SJARQ) provides a means to advocate for social justice with persons of multiple cultural identities, including all sexual orientations and gender identities. The SJARQ instrument contains three areas of self-assessment for social services staff: individual social justice advocacy awareness, comfort, and values; cultural social justice advocacy knowledge; and institutional/systemic social justice advocacy skills.     

Subject to a new law: historicizing rights and resistance in Maya anti-mining activism

ABSTRACT

Since 2004, the Marlin Mine, located in North-west Guatemala, has produced conflict between Goldcorp, the Guatemalan state and the primarily indigenous Mayan communities affected by the mine. This conflict has generated local anti-mining movements that organized community consultations which, grounded in indigenous rights law and Mayan decision-making practices, allow affected communities to decide whether or not to permit mining in the region. While communities resoundingly rejected open-pit mining, and while this decision received international support, the Marlin Mine continues operations. Drawing on field research and new developments in philosophies of rights, this paper makes two related arguments. First, Mayan anti-mining resistance must be situated within a broader colonial history defined by exploitation and primitive accumulation. Second, Mayan activism challenges current conceptions of the relationship between rights, cultural identity and political agency; most significantly, Mayans do not only claim rights on the basis of identity, they enact and politicize the form in which these rights potentially take place.     

发达国家处理劳资关系的经验及启示

劳资关系是现代社会赖以旋转的中心,劳资关系的失衡不仅影响经济的发展,而且危及社会的和谐与稳定。文章简要分析了转轨时期我国劳资关系的现状、问题及成因,采用比较分析方法来总结了发达国家处理劳资关系经验,结合我国劳资领域的实际情况,提出了现阶段协调劳资关系的治理模式：转变工会角色和行为;建立健全劳资关系法律体系,健全相关劳动制度;明确劳资关系三方主体,建立三方协调机制;强化政府在协调企业劳资关系中的责任,加强监管力度。     

征收征用与公民基本权利保护

在我国的征收征用工作中时常出现侵权问题。为了解决这些问题,社会各界都提出了建议和对策。但现实中侵权现象仍不断出现,公民基本权利所受到的侵害始终得不到救济。本文拟从这个问题展开,探讨我国征收征用中相关公民基本权利保护问题。同时,征收征用中的侵权主要还涉及补偿问题,因而本文还将对补偿协商机制作一些探讨。
