价值评价合理性的困境及新路径

在价值评价过程中,合理性是一个无法回避的问题,而评价主体的主观性与相对性始终制约着价值评价的合理性。为突破当前存在的理论困境,需要从事物合乎自身之理、主体的合理需要及两者关系的历史统一的角度出发,对合理性进行再分析,进而探寻价值评价合理性的新路径。     

试论最高人民法院司法解释的衡平价值

最高法的司法解释作为一种规则渊源,能克服立法推动主义导致的立法粗疏及其在司法上的不敷衍用;应从体制上明确最高人民法院的规则制定权限,赋予其适度的"空隙立法"的职能,从而有效发挥司法解释在处理具体案件中的衡平价值。     

体育锻炼对职业中专学生人际交往困扰的影响

采用问卷调查法对职业中专学生的体育锻炼和人际交往困扰及其关系进行研究。结果表明,职业中专尚有很大一部分学生在人际总分及其各维度上存在一定困扰或是严重困扰,女生在待人接物和异性交往方面好于男生,高年级学生在待人接物、异性交往和人际总分上好于低年级学生;大锻炼量学生的人际交往困扰少于中小锻炼量学生,而起主要作用的是每次参与锻炼的时间。     

On Variance Upper Bounds for Unimodal Distributions

We obtain upper bounds on the variance of discrete unimodal distributions. The alternative proofs of the corresponding bounds for the continuous unimodal distributions are also given.     

Developing the new socialist Czechoslovak state: abortion,eugenics, and the politics of choice between 1945 and 1962

ABSTRACT

The author analyzes the political and medical discourses surrounding the legalization of abortion in Czechoslovakia in the 1950s and the establishment of the institution of abortion commissions to approve women’s demands. Through a genealogical intersectional lens, she explores the continuity of this rationality, which started to fear the degeneration of the collective more than its depopulation. As the Cold War commenced, for the first time in history Czechoslovak women obtained reproductive rights, particularly when a pregnancy was recognized as a threat to women’s and children’s health. Drawing on biopolitical theories and other critical feminist scholarship that have problematized the liberal underpinnings of choice and autonomy, the author demonstrates how eugenics trespassed from expert circles into politics, and, with the help of planned parenthood, recreated a complex system of socio-biological classes, determining who should reproduce and whose life was worth living, and worth protecting. The text defies the classic totalitarian thesis that divides peoples and society into two types, the totalitarian subject and its liberal counterpart. The author argues that, regardless of the political system, abortion rights operate as a regulatory strategy of power aimed at maintaining a certain population optimum by re-defining women’s responsibilities to deliver a healthy child into a healthy environment.     

我国机长权力法律规制的立法完善

机长权力是《东京公约》的重要内容,厘清机长权力的法律性质对规范机长权力以及维护航空安全有重要意义。机长权力是一种代理关系的表达,兼具私人代理与准行政代理的性质。机长权力中是否包含作为义务,可以说是权力中有没有义务这一争议话题的延伸。机长是飞机上权力最大的人,其权力实际上是一种包含作为义务的权力。机长权力是代理与自治的结合体,对其进行规制至关重要。对权力与义务的事前控制及约束,对规范机长权力的行使以及保护刑法所保护的生命法益尤为关键,应为立法所重视。     

Evaluating a social marketing campaign on healthy nutrition and lifestyle among primary-school children: A mixed-method research design

Italy has one of the highest levels of childhood overweight and obesity in Europe. Therefore, preventing children from becoming overweight is a major public health challenge. Here, we used a mixed-method research approach – including a quasi-experimental design and three surveys – to create a formative evaluation of a social marketing campaign on healthy nutrition and lifestyle in Italian primary school children. The social marketing campaign was organized around the 4 Ps of the marketing mix (product: the educational activities; place: the involved schools and supermarkets; promotion: the in-person and technology-based communication; and price: hours spent by the targeted children in fulfilling the educational activities). The campaign involved primary-school children across four Italian cities. The findings suggest that social marketing education campaigns can be effective tools to improve children’s knowledge about healthy food and lifestyle, reduce their sedentary behavior, and increase their consumption of healthy food. Also, increasing children’s acceptance of healthful nourishment is a valuable tool to improve the dietary habits of the entire family. With relation to the educational program assessment method, this study can inform societal interventions especially those involving children through the integration of different qualitative and quantitative research methods, which collect data from different subjects and perspectives.     

The Arab Spring for Women? Representations of Women in Middle East Politics in 2011

This article explores the complex, liminal, and difficult space in which stories of women in “the Arab Spring” were wielded as parts of political narratives of gender, race, class, religion, democracy, and Westernization in Western media as the Arab Spring unfolded. It examines those stories by using the tools of postcolonial feminism. After briefly describing what is meant by (gender and) the Arab Spring, the article outlines a method for evaluating the significations of the media narratives surrounding it. We find two dissonant narratives (of gender as emancipatory and of gender as problematic) and ask what assumptions about gender (and sex and race and culture) have to be made to produce these particular representations. We argue that the dissonant narratives have in common using the situation of women as a barometer for the success of Westernization, liberalization, and democratization. The article concludes by exploring the implications of these findings.     

人力资本、社会资本对大学生就业质量的影响

人力资本对就业地区、就业行业、单位性质和承诺月薪的影响力分别为3.08%、10.4%、2.89%、12.38%,总影响力为7.19%;社会资本对以上四项的影响力分别为17.57%、3.54%、3.48%、1.82%,总影响力为4.69%。人力资本和社会资本成为大学生就业质量的双轮驱动力。就业质量差异扩大是一国经济发展的必然结果。人力资本的影响是合理的,而社会资本的影响具有两面性。大学生要努力积累人力资本,高校应开展就业能力导向的教学改革,政府要完善劳动力市场,以改善大学生就业质量。     

Inequalities for tail probabilities for the multivariate normal distribution

Inequalities for tail probabilities of the multivariate normal distribution are obtained, as a generalization of those given by Feller (1966). Upper and lower bounds are given in the equi-correlated case. For an arbitrary correlation matrix R, an upper bound is obtained, using a result of Slepian (1962) which asserts that certain multivariate normal probabilities are a non-decreasing function of correlations.
