关于建立行政诉讼调解制度的探讨

在我国行政诉讼领域,因"公权不可处分"等理论禁区的存在,立法上对行政诉讼调解予以明确禁止。然而从域外的经验、传统法律文化、服务行政、诉讼经济原则等方面来看,我国应当建立行政诉讼调解制度。行政自由裁量权为行政诉讼调解提供了可能。行政诉讼调解在调解范围、调解程序、调解协议等方面应作出特殊规定。     

Bus rapid transit identity meets universal design

As bus rapid transit (BRT) systems continue to become more popular and as capital expenditure for such projects continues to grow, careful consideration of BRT identity design becomes ever more necessary. Properly considered identity systems can ensure accessibility to and usability of physical features and can also ensure that BRT systems are accessible and practical to use. Based on the seven principles of universal design, this article proposes a basic means to evaluate existing and planned BRT identity systems. The article concludes with recommendations for evaluators and guidelines for designers of BRT identity systems that will help to ensure the practical usability of BRT identity systems by a broad audience of diverse users, regardless of physical, cognitive or situational ability.     

Conflict management in the modern world-system

What is the relationship between the status of nation-states in the modern world-system and their strategies for conflict management? Using Wallerstein's world-systems theory, Kick's empirical specifications of core, semiperiphery, and periphery, and Black's theory of conflict management, I examine the use of self-help, avoidance, negotiation, and third-party settlement by nation-states. These possible tactics are variously used as forms of social control from below, social control from above, and social control between equals. I argue that the status of nations within the world-system is correlated with the primary mode of conflict management they use at a given time. I speculate that the use of a particular strategy may also subsequently contribute to changes in nations' status.     

当牧民定居：来自雀尔沟镇的个案研究

文章以新疆呼图壁县哈萨克族牧区为例,通过田野调查分析目前该地区牧民定居现状及其存在的问题,就牧民定居未来的发展方向提出己见,认为当地政府制定地区发展计划时需倡导参与式发展、让当地居民受益的理念,并探讨了生态环境保护、水利资金投入和限制当地牲畜数量对于地区经济发展的重要意义。

论我国劳动争议解决机制的完善

劳动权同其他宪法基本权利一样需要司法程序的保障。我国劳动争议的仲裁和诉讼的范围过于狭窄 ,争议解决程序不利于劳动权的保护。随着市场经济的深入运行和人权事业的发展 ,我国劳动争议的仲裁和诉讼的客体既包括所有的个体劳动权 ,也应当包括集体劳动权 ;劳动争议的仲裁和诉讼的主体应当具有普遍性 ;改革劳动争议解决机制 ,重新分配举证责任 ,既注重了劳动权的安全 ,又注重了劳动权的效益     

The geolinguistics of /l/ vocalization in Australia and New Zealand

Recent work in comparative sociolinguistics marks a re–engagement of variationists studying language change in progress with geography. In this study of the vocalization of /l/ in nine speech localities in Australian and New Zealand English, the geographical, the linguistic and the social constraints on variation are all included in the quantitative analysis. The usual identification of the starting point of change as the factor that is quantitatively ‘more’ is challenged by variable constraint hierarchies associated with speech localities as well as by the identification of Christchurch as the place of the origin of the sound change. Neither the gravity nor the urban hierarchy models of diffusion explain the geographical pattern of the sound change; a number of place effects are proposed as potential explanations, including the geographical variability of the vigorousness of the change. Variable isoglosses representing discontinuities in the dataset are mapped; they reveal the subtle patterns of sociolinguistic variation that mark the difference between Australian English and New Zealand English.

司法最终解决原则,是指以法院的审判作为解决民事纠纷最终手段的原则。随着市场经济体制的逐步建立,应在我国确立严格的司法最终解决原则,赋予其“凡私法调整范围内的社会纠纷都可由法院以民事诉讼程序解决”的含义。但在此过程中,要有以下两方面的改革与之配套：提高司法效率,增强民事诉讼解决纠纷的机能;开发新的替代性纠纷解决方法。以减轻诉讼机制的压力。
