中国传统纠纷解决机制的特征与启示

中国传统纠纷解决机制的主要特征有纠纷解决方式的多元性、以避讼为直接目标、诉讼审判的伦理教化性、以“社会生成法”为主要适用规则。这些特征予我们以如下启示:纠纷解决的国家方式与非国家方式并重,且有相应的联接机制;能有效解纷的社会应该是一种有限自治的社会,法律并非在所有纠纷解决中不可或缺;纠纷解决机制应该是成本最低、最能促进和谐的机制。贯彻和实践这些启示,可能是中国建成法治社会与和谐社会的关键。     

波普、库恩、拉卡托斯科学哲学思想之比较

在西方科学哲学从逻辑经验主义向历史主义演变的过程中,批判理性主义起了纽带的作用。波普、库恩、拉卡托斯是当代西方科学哲学发展进程中批判理性主义和历史主义的代表人物。本文从比较和分析的角度出发,从科学的划界问题、科学方法论和科学发展模式三方面分析了三位科学哲学家的批判与继承关系,并试图对当代西方科学哲学的发展进程作一描述。     

中小城市应对外资并购的对策研究——兼论镇江市应对外资并购对策

外资并购已经成为国际直接投资的主流模式,我国成为外资并购热点具有其必然性.通过分析我国外资并购的现状,认为我国迫切需要开展中小城市应对外资并购的对策研究.本文对中小城市(以镇江市为例)产业结构特点进行了分析,研究了中小城市应对外资并购的基本对策、方向选择和方式选择,并设计了中小城市(以镇江市为典型)相应的外资并购控制程序,提出了中小城市应对外资并购应注意的主要问题.     

论外层空间活动争端的解决机制

联合国制定的有关外空条约及原则宣言对和平解决外层空间争端做出了原则性的规定。但这些规定本身存在着一些问题。对于如何构建外层空间活动争端的解决机制存在着不同的构想。各国应当共同努力,在现有的争端解决机制的基础上,对外层空间活动争端 的解决做出补充和完善。

《雾都夜话》作为重庆电视台十年未衰的地方节目,一直引人关注。节目成功的一个重要因素就在于它采用了传统艺术中"讲故事"的叙述方式,使之区别于现代传播中的一般电视剧和电影,开创了自己的特色化道路。     

Kinship care in Australia

Kinship care is the fastest growing form of out‐of‐home care placement in Australia. It is now a more common form of placement than foster care in some Australian states and is the most common form of placement for Indigenous children nationally. This paper reviews national data and reports ?ndings from a state (New South Wales) study of the experience of kinship carers, children and workers. Relative carers, children and child welfare caseworkers were found to identify psychological bene?ts, family obligation and criticism of other forms of care as reasons for preferring kinship care. Legislation and policy, particularly the Aboriginal Child Placement Principle, are also identi?ed as factors contributing to the rise in kinship care. Concern for the high levels of stress among carers and the low levels of monitoring of children's safety and well‐being are discussed and a stronger policy and practice response from government agencies is proposed. Indications of new policy and programme responses are demonstrated by several recent initiatives at state and national levels. Copyright © 2004 John Wiley & Sons, Ltd.     

以人为本:英语提高阶段课程体系改革的思考——清华大学英语选修课课程设置学生问卷调查分析

清华大学外语系大学英语选修课教研室于2003年秋季学期在306名本科生中做了一次选修课课程设置的问卷调查。该问卷调查试图从选课目的、课程总体收获、具体学习收获、学习需求和存在问题等方面了解学生对英语提高阶段选修课的反馈意见。文章将对调查数据所展示的重要信息进行概要的介绍和分析,并就如何在课程设置改革中体现“以人为本”的思想提出了一些设想和建议。     

Problematic Progress in Asia: Growing Older and Apart

The purpose of this article is to describe the demographic dynamics in 14 Asian countries. The foreseen impacts on economic growth, income disparity, social stability, pension programs, retirement, health care insurance, and labor market are presented. Public policy recommendations are delineated.     

Tailored program evaluation: Past, present, future

This paper discusses measurement issues related to the evaluation of computer-tailored health behavior change programs. As the first generation of commercially available tailored products is utilized in health promotion programming, programmers and researchers are becoming aware of the unique challenges that the evaluation of these programs presents. A project is presented that used an online tailored health behavior assessment (HBA) in a worksite setting. Process and outcome evaluation methods are described and include the challenges faced, and strategies proposed and implemented, for meeting them. Implications for future research in tailored program development, implementation, and evaluation are also discussed.
