法律体系是衡量文明社会的重要标志.巴林作为中东民族国家建构体系中地缘、社会与文明实体的重要一环,尽管面积不大,人口较少,但其法律体系却在海湾地区具有历史悠久、体系完备以及内容丰富等特点.巴林法律体系历经四个时期:教法学家主导下的伊斯兰法时期、酋长管理下的部族法时期、英国控制下的混合法时期以及世俗和伊斯兰共生下的二元法时期.巴林法律体系的现代化呈现出多元化的理论形态与文化取向.     

Beyond “filling in the gap”: the state and status of Latina/o Feminist Media Studies

Against the socio-economic and cultural backdrop of the ongoing Latina/o media “boom,” this critical literature review delineates the location and status of contemporary Latina/o Feminist Media Studies. Departing from a critique of current mainstream Feminist Media Studies research and citational practices, it traces the influence of rapidly expanding transnational Latina/o media markets, the gendering of Latinidad, and transnational feminisms on recent Latina/o Feminist Media Studies scholarship. As it not only breaks with exclusively domestic analyses of intersectionality and accurately reflects twenty-first century media’s transnational orientation, this essay argues that the theoretical paradigms and thematic concerns of Latina/o Feminist Media Studies must ultimately be reframed as central, not marginal, to Feminist Media Studies research.     

‘Nothing about us without us’: the emerging disability movement and advocacy in China

The disability movement and disabled persons’ self-help organizations (DPOs) are emerging in China, some of which succeeded in promoting policy and social changes with special strategies. Based on an original survey and interview, this article explains the development and survival strategies of China’s DPOs, and especially interprets some successful cases of social advocacy and policy advocacy in the emerging disability movement. It is hoped that scholars will pay more attention to the advocacy and public engagement of the disability community in non-western settings in the future.     

The relationship between the community participation of disabled youth and socioeconomic factors: mixed-methods approach in rural Sri Lanka

Mixed methods were applied to examine the association of community participation by disabled youth with socioeconomic factors in rural Sri Lanka. There was a significant association between community participation and socioeconomic factors in the quantitative survey (n = 116): participants living in socioeconomically disadvantaged conditions had lower levels of community participation than those living without these disadvantages. Consistent with the findings of the survey, previous educational experiences, household economic conditions, and perceived resource information were common themes in the qualitative study (n = 26). The dynamics of these factors, including marginalisation of disabled youth within the household, were also observed.     

Mighty Crime Victims: Victims' Rights and Neoliberalism in the American Conjuncture

Over the last 30 years, the victims' rights movement has expanded the role of victims in the American criminal justice system. As a result of this movement, judges, prosecutors and parole boards must now hear victims' views at all stages of the criminal justice process, including plea bargains, and sentencing and parole decisions. Legislative efforts have been spearheaded by victims' families, and legislation has been named after deceased victims. Also, victims' families can now view executions in states across the country. The victims' right movement assumes that the criminal justice system should privilege victims' interests over those of society. In so doing, it denies society as a consideration, which is tantamount to a denial of society itself. This article positions victims' rights' denial of society within the current conjuncture, marked as it is by the contradiction between neoliberalism and American liberalism. Victims' rights' denial of society is an expression of the denial of society implicit in American neoliberalism, which seeks to privilege individual interests over those of society. This paper argues that victims' rights is a powerful element of the neoliberal project for three reasons. First, victims' rights imputes the authority of legal discourse to neoliberalism's denial of society. Second, important actors in the rise of neoliberalism have also worked to establish victims' rights. Finally, victims' rights comprehensively circulates throughout America and offers powerful points of identification that incorporate Americans into the victims' rights formation. I explore the denial of society in three victims' rights practices: naming criminal legislation after crime victims and passing such laws in honour of victims; allowing victims' families to view executions; and prosecutors, judges and police personnel making legal decisions according to victims' wishes. I examine the consonant denial of society in three neoliberal practices – monetarism, supply-side economics and welfare reform – and demonstrate how neoliberal advocates like Bill Clinton, Ronald Reagan and Paul Gann worked to advance victims' rights. I also describe the production, consumption and comprehensive circulation of victims' rights texts. Finally, I consider Cultural Studies' unique contribution to legal studies.     

Social Work and Complex Care Systems: The Case of People Hospitalised with a Disability

Health and hospital system reforms prioritise efficiency. However, initiatives can impact on people with new or existing disabilities who require time to maximise functional independence. With greater demands for shorter hospital stays social workers face increasing pressure to facilitate discharge. This paper reports findings from research identifying factors contributing to extended stays for adults with disabilities. We sought to better understand patient characteristics and discharge planning challenges by analysing a clinical dataset of 80 patients and qualitative interviews with five experienced hospital social workers. Three key factors are identified: issues around rehabilitation services; assessment and planning for community care; and availability of and access to discharge options. Strategies to reduce length of stay are reported. We argue that building collaborative partnerships and working across multiple, complex systems and disciplines are vital to ensure these patients access appropriate community-based resources within the current health reform environment.     

Accessibility of European museums to visitors with visual impairments

People who have visual impairments exceed 250 million persons worldwide and represent an important cohort of museum visitors. However, they experience many constraints to participation in daily life. Few studies analyse the accessibility of museums to visitors with visual impairments, and many are confined to a single museum and to a small set of strategies for improving accessibility. This article aims to identify a broad set of strategies to increase the accessibility of museums to visitors with visual impairments and analyse the accessibility of museums in four European cities. Conclusions and implications for policy-makers and museum managers, designed to promote the creation of inclusive museums, are presented.     

Widening the social context of disablement among married older adults: Considering the role of nonmarital relationships for loneliness

Utilizing the stress process and life course perspectives, we investigated the influence of non-spousal social support on the associations between marital quality, physical disability, and loneliness among married older adults. Using data from the National Social Life, Health, and Aging Project (NSHAP), we found that the association between physical disability and loneliness was partially accounted for by the fact that physical disability was associated with less supportive nonmarital relationships. While physically-disabled older adults in higher-quality marriages were buffered from loneliness, supportive non-martial relationships did not offset elevated loneliness among those in low-quality marriages. These associations were largely similar for men and women. Thus, although both marital and nonmarital relationships are important for loneliness, when confronted with a stressor such as disablement it is the marital relationship alone that matters.     

Filling holes in the safety net? Material hardship and subjective well-being among disability benefit applicants and recipients after the 1996 welfare reform

Some of the rapid recent growth in disability income receipt in the United States is attributable to single mothers post-welfare reform. Yet, we know little about how disability benefit receipt affects the economic well-being of single mother families, or how unsuccessful disability applicants fare. We compare disability recipients to unsuccessful applicants and those who never applied among current and former welfare recipients, and examine how application and receipt affect material hardships and subjective measures of well-being. We then examine whether alternative ways of making ends meet mediate differences in well-being. After controlling for alternative sources of support, no significant differences in overall actual hardships or difficulty living on current income remained between the three groups. However, even after controlling for these strategies, unsuccessful applicants were significantly more likely to report that they expected hardships in the next two months. Our results suggest a pervasive level of economic insecurity among unsuccessful applicants.     

Inferences on regression coefficients in a regression model under heteroscedasticity and robustness with respect to departure from normality

In this paper we consider a simple linear regression model under heteroscedasticity and nonnormality. A statistical test for testing the regression coefficient is then derived by assuming normality for the random disturbances and by applying Welch's method. Some Monte Carlo studies are generated for assessing robustness of this test. By combining Tiku's robust procedure with the new test, a robust but more powerful test is developed.
