湘西土家族苗族自治州扶贫开发的历史反思

经过 2 0年的艰苦奋斗 ,湘西土家族苗族自治州的扶贫开发取得了显著成效 ,基本实现了预期的扶贫工作目标。但是 ,全州仍然有相当部分农村人口尚未解决温饱问题 ,扶贫任务还十分艰巨。本文从全国反贫困战略的角度 ,梳理了湘西州扶贫开发的基本过程 ,评述了扶贫开发的思路和举措 ,总结了 2 0年扶贫开发的基本经验 ,对于推动下一步的扶贫开发工作具有一定的启发作用。     

Divorce and the Divine: The Role of Spirituality in Adjustment to Divorce

This study examined the role of three spiritual responses to divorce for psychological adjustment: appraising the event as a sacred loss/desecration, engaging in adaptive spiritual coping, and experiencing spiritual struggles. A sample of 100 adults (55% female) was recruited through public divorce records. Most appraised their divorce as a sacred loss/desecration (74%), experienced spiritual struggles (78%), and engaged in adaptive spiritual coping (88%). Appraisals of sacred loss/desecration and spiritual struggles were tied to higher levels of depression. Adaptive spiritual coping was tied to greater posttraumatic growth. Spiritual coping and struggles each contributed uniquely to adjustment beyond parallel forms of nonspiritual coping and struggles and mediated links between viewing the divorce as a sacred loss/desecration and depression.     

FDI Determinants: Case of Romania

Even if the FDI is important for all host countries, for those in the process of transition to a market economy the FDI presence is critical under many respects. Not all transition countries benefited from the very beginning from the FDI presence. Several determinant factors explain the differences. Romania was lagging behind regarding the interest of foreign investors during the first 9–10 years of transition. The situation has improved greatly. The aim of this paper is to identify the main factors determining the evolution in the FDI/GDP (%) as proxy for the FDI evolution. To this end, we used the method of factors analyses. The four resulted determinant factors are: Market size and potential, Reform progress, Business liberalization, and Labor cost. A linear regression model expresses the connections between dependent variable and the four determinant factors. The paper concludes with certain policy implications.

司法附属行政语境下的中国古代法官地位

“司法附属行政”是中国古代司法的一个重要特征。在这一背景下,中国古代法官地位就呈现出鲜明的附属性特征,这种特征同样体现在法院的地位和司法权的地位上,这也导致中国古代法官没有专门的职业保障制度,而这一切都深深地镶嵌在当时的人治大背景之中。通过与现代法官地位的比较,可以更加深切地感受到古今法官地位以至整个司法状况的巨大差异。中国现代法官地位在独立性方面相对于古代法官有了巨大改善,但仍然不尽如人意,还需要在今后的司法改革中进行反思和重点关注。     

死者人格利益法律保护之构建

死者无人格权,但死者具有人格利益。为了维护社会利益和善良风俗,我国法学界和司法实务界对死者人格利益保护也达成了共识。完善死者人格利益应在保护范围、行使主体、法律责任、免责事由及保护期限等方面给予立法规制。     

论夫妻忠实义务与隐私权冲突的法律协调

配偶间的隐私权和忠实义务的冲突是我国婚姻关系中错综复杂的问题,随着社会的发展,该问题日益凸显,不仅关乎我国婚姻制度的完备,更关乎社会的稳定和谐。《婚姻法》修订后的数年中,我国最高人民法院随后出台了三次司法解释,但是却对夫妻间忠实义务与婚内隐私权冲突的协调没有提出具有实质指导性的法律意见。文章拟通过对夫妻忠实义务和婚内隐私权的含义及特点的理解,阐述夫妻间忠实义务和婚内隐私权的客体内容和法律关系,通过讨论二者之间的冲突现状、原因,以寻求解决途径。     

社会多元化转型期隐私权与知情权关系研究

当代中国,社会的思维方式、行为方式、评价模式发生着深刻变化,并具体对隐私权与知情权的发展扩展产生重要影响。今天,隐私权与知情权冲突问题日益突出,冲突本质在于两者在价值与利益问题上的紧张关系,并具体展现为公法领域冲突与私法领域冲突两大方面。为化解权利冲突,应明确人格尊严与自由、社会政治与公共利益的基本冲突协调原则,构建包括认定、确立、调整、评价四个层次的完整冲突协调体系。     

On the computation of the noncentral <Emphasis Type="Italic">F</Emphasis> and noncentral beta distribution

Unfortunately many of the numerous algorithms for computing the comulative distribution function (cdf) and noncentrality parameter of the noncentral F and beta distributions can produce completely incorrect results as demonstrated in the paper by examples. Existing algorithms are scrutinized and those parts that involve numerical difficulties are identified. As a result, a pseudo code is presented in which all the known numerical problems are resolved. This pseudo code can be easily implemented in programming language C or FORTRAN without understanding the complicated mathematical background. Symbolic evaluation of a finite and closed formula is proposed to compute exact cdf values. This approach makes it possible to check quickly and reliably the values returned by professional statistical packages over an extraordinarily wide parameter range without any programming knowledge. This research was motivated by the fact that a very useful table for calculating the size of detectable effects for ANOVA tables contains suspect values in the region of large noncentrality parameter values compared to the values obtained by Patnaik’s 2-moment central-F approximation. The cause is identified and the corrected form of the table for ANOVA purposes is given. The accuracy of the approximations to the noncentral-F distribution is also discussed. 中小企业存在问题的原因是多方面的,有企业外部的原因,比如政府扶持力度不够、融资环境有待改善、市场经济体制的完善尚需时日等,但主要还是由中小企业自身存在的劣势所决定的。以中小企业为目标,从并购、一体多元化、加盟集聚三个方面论述培育和提升其核心竞争力的措施。     

The role,importance and challenges of social sciences and humanities in the work of the intergovernmental science-policy platform on biodiversity and ecosystem services (IPBES)

Qualified competences in social science and humanities are required across the various deliverables of the intergovernmental science-policy platform on biodiversity and ecosystem services (IPBES) in order to fully address the objectives of IPBES. Building integrative approaches has long been acknowledged as a scientific challenge. Hence, new paths have to be forged, including revisiting basic ontological and epistemological considerations, such as how we understand the world, what knowledge is, and the role of science. Constructive interdisciplinary dialogues in IPBES supports the development of innovative frames and terminologies. One example is the evolution from the Millennium Ecosystem Assessment ecosystem service framework to the Nature’s Contributions to People classification now applied in IPBES assessments. IPBES is still in a learning phase and critical examination of what is accomplished this far is useful when refining ongoing modes of work and in long-term strategic considerations.
