略论契约婚姻视角下的离婚损害赔偿制度

传统的离婚损害赔偿制度建立在侵权责任基础上,只有完全满足侵权责任构成要件才能够适用,无法解决无过错离婚造成的损害问题。而在契约婚姻框架下,实行严格责任归责可以追究无过错方的违约责任,能够更好地保护因离婚受到损害的一方。     

韩国协议离婚立法对中国的启示

韩国的协议离婚立法规定了离婚的考虑期、法院的离婚确认制度、离婚的户籍申告制度及对离婚的无效和撤消制度,相对于中国法律规定的协议离婚立法,更加严格与完善。由于中国与韩国都属于东方文化的国家,因此韩国协议离婚立法的规定对我国立法更具有借鉴意义。     

Child custody issues and co‐occurrence of intimate partner violence and child maltreatment: controversies and points of agreement amongst practitioners

The situation of families undergoing separation in a context of co‐occurrence of intimate partner violence (IPV) and child maltreatment raises certain issues related to child custody. The results presented in this paper were collected and analysed within the framework of a qualitative study aiming to identify the principal points of agreement and the main controversies amongst practitioners in several different types of organizations. Focus groups were held with a total of 43 practitioners from six different settings concerned with child custody in cases of co‐occurrence of IPV and child maltreatment. Although they agreed on the importance of ensuring the safety of victims of violence, their views diverged on three points: (1) the importance of preserving the father–child relationship; (2) collaboration between voluntary organizations and semi‐voluntary or legal agencies; and (3) consideration of cultural differences.

Premarital Sex,Premarital Cohabitation,and the Risk of Subsequent Marital Dissolution Among Women

Using nationally representative data from the 1995 National Survey of Family Growth, I estimate the association between intimate premarital relationships (premarital sex and premarital cohabitation) and subsequent marital dissolution. I extend previous research by considering relationship histories pertaining to both premarital sex and premarital cohabitation. I find that premarital sex or premarital cohabitation that is limited to a woman's husband is not associated with an elevated risk of marital disruption. However, women who have more than one intimate premarital relationship have an increased risk of marital dissolution. These results suggest that neither premarital sex nor premarital cohabitation by itself indicate either preexisting characteristics or subsequent relationship environments that weaken marriages. Indeed, the findings are consistent with the notion that premarital sex and cohabitation limited to one's future spouse has become part of the normal courtship process for marriage.     

The Legacy of a Grandparent's Divorce: Consequences for Ties Between Grandparents and Grandchildren

This study assesses the implications of divorce in the grandparent generation for grandparent‐grandchild relationships. The sample of 538 grandparents comes from the Iowa Youth and Families Project. Results indicate that many aspects of grandparenting are negatively associated with ever experiencing a divorce. Some of the negative effects of divorce are explained by ever‐divorced grandparents' greater geographic distance from, and weaker bonds to, their adult children. Negative effects of divorce are stronger for grandfathers and paternal grandparents. Furthermore, a good grandparent‐parent relationship can compensate for the negative effects of a grandparent's divorce on relations with grandchildren. Implications of these findings are discussed in the context of the increasing percentage of individuals moving into the later years who have experienced a divorce.

建立我国分居制度的立法构想

我国婚姻立法将分居作为离婚判决的根据之一 ,没有将分居制度化。这不利于调整分居期间的婚姻家庭关系 ,实践中法官也不易操作。因此 ,我国婚姻立法应当参照国外立法经验 ,结合我国实际 ,建立我国的分居制度     

A KLEINIAN PERSPECTIVE ON THE DIVORCE PROCESS: FROM THE PARANOID-SCHIZOID TO THE DEPRESSIVE POSITION

This paper looks at the divorce process from the perspective of Kleinan theory. It argues that during the early stages of divorce, most persons are in Klein’s paranoid-schizoid position, characterized by splitting and persecutory anxiety, and that they move on to the depressive position, characterized by sadness and longing, only later. The movement occurs as the separated or divorced individual becomes able to tolerate ambivalence, and thus to integrate both the loved and hated aspects of the former spouse and marriage. The paper illustrates the claim in three case studies and recommendations are made for treatment and research.Nehami Baum Ph.D. is a lecturer of the School of Social Work at Bar Ilan University.
