基于参照依赖实验的公平偏好性质探究——来自中国情境下的实验证据

国内外已有的关于公平偏好的研究主要集中于获取人们普遍存在公平偏好心理的证据,尚缺乏对公平偏好固有性质的深入挖掘。本文借鉴Andreoni等的研究方法,设计了参照依赖实验,规范组织实施了多场次可控实验,探索了公平偏好的性质特征。实验结果显示人们的同情偏好呈现敏感性递减的变化规律且不存在拐点,而嫉妒偏好和自豪偏好均呈现先敏感性递减后经过拐点敏感性递增的变化规律;通过拟合公平偏好的函数表达式,分析其数学性质和经济学属性,发现嫉妒偏好的边际效用几乎是同情偏好的10倍,解决了将公平偏好因子引入传统的委托-代理模型的合理性问题,修正了传统的委托-代理模型。     

程序正义及其价值分析

程序具有两个层面的价值:外在性价值和内在性价值。程序正义是程序的内在性价值。程序正义的标准有:科学性、中立性、平等性、公开性。程序正义在法治实践中有着重要价值:程序正义对于保障和实现人权具有重要意义;能更好地促进法律的实施和遵守;有利于法制的进一步完善。     

A moral vision: human dignity in the eyes of the founders of sociology

The case argued in this paper is not that the concerns of the founders of sociology are uniformly and in every particular still our own (Runciman, 2008), but that the concepts and methods used to address just one of their concerns were both ground breaking and of enduring value (Shilling and Mellor, 2001, 2011, for example, make a similar claim). Such a concern focused on the kind of morality grounded in a capitalist social order and, by implication, how it might be theorized. This generated in the process the uniquely sociological operationalization of what had seemed hitherto a philosophical concept: human dignity, along with the freedom and autonomy that attend it. Certainly, the priorities differed in each of the contributions to this endeavour but, in coming at the problem from different standpoints, the concept of dignity came to appear more rounded, more substantive and more relevant to the human condition in all its historical specificity. Quite crucially, there is also in these sources from the classical period of sociology an intimation of method: both the way in which human dignity is to be ‘perceived’ within an inter‐personal dialectic at a micro‐level and, at a macro‐level, how we can discern that dignity transcends artificial confinement by any one aspect of life (be it economic, political or cultural).¹

Women’s Decision to Divorce in Light of Failure in Marital Status and Dignity

In Iranian society, divorce, as an instability index of family, has been on the increase over the last decade. In particular, this separation is fraught with considerable difficulties for wives with children. The overall aim of this study is to investigate the nature of the process of deciding to separate by the divorced women despite having children. Resting on the grounded theory method, this study was conducted among 20 divorced women with children in the city of Tehran. The findings show that having a child is not a determining factor for the women to remain married; rather, what determines the separation of women with children is experiencing a status loss within their marital life, an experience that originates from losing her status after a woman has gotten married. Of course, women’s agency within the domain of family disintegration happens when they have the ability to overcome social fears and also have economic support. Through this course of events, although children are of enormous importance for the mothers, they are temporarily neglected while the mothers, for a short period, think primarily of saving themselves. Making their final decision to get separated leads to reactivating the role of their children; then, the mothers proceed to make the optimal decision.

俄罗斯选择了市场经济体制作为改革的目标模式,加强财产利用已经成为不可忽视的趋势。民法典和土地法典对土地的永久使用权、终生继承占有权、对他人土地的限制使用权的规定,较完整地构成了俄罗斯的现代土地他物权制度,也体现出俄罗斯根据本国的需要对土地他物权的立法所作的必要调整。     

论黄庭坚“好诗”词风对宋词内质的重构

文章具体分析了黄庭坚所谓“好诗”词风的内涵,指出其词内蕴了江西诗风的二重性：既具有瘦劲典雅之气骨,也具有蕴藉静穆之意韵。气骨偏于诗质,意韵则是对词体内质的回溯和深化。黄庭坚正是以这种词风,参与了词中“宋调”内质的重新建构,并由此获得了词史上的一席之地。
