民法的人文关怀

比照近代民法以财产法为中心,现代民法强化了人文关怀,主要表现为从以财产法为中心到人法地位的提升,并广泛体现于民法中主体制度的发展、人格权的勃兴、合同制度的发展、物权法的发展、侵权法的发展、婚姻家庭法的发展等各个方面。中国未来的民法典应当以人文关怀构建价值理念,注重对人的自由和尊严的充分保障以及对弱势群体的特殊关爱。基于这一理念,在中国未来民法典中有必要增加人格权法和侵权责任法编。在中国民法的适用等方面更应强化人文关怀。     

女作家自恋性写作:私人领域与公共领域的断绝

本文引入“空间”视角,在当代文学变迁的大背景下对自恋现象进行整合细化,指出私人领域与公共领域的断绝是女作家自恋性写作的根源,并辨析女作家写作中相似自恋性空间意象中个人景观、镜像景观、物景观的差异,个人写作、私人写作和身体写作的流变,反思这些变化隐含的文化嬗变.     

网上银行发展中的相关因素分析——基于TAM理论

基于技术接受理论(TAM)构建了网上银行客户采纳模型,运用问卷调查的数据对此模型进行了验证。结果表明:网上银行的技术接受模型得到了验证;个人创新特质和感知安全性对网上银行使用意向有显著的影响;将个人创新特质、感知安全性与TAM理论结合起来,在一定程度上可以更好地解释客户网上银行的使用行为。     

Baby boomers and their entourage

The post-war generation of baby boomers has witnessed major transformations in family life as well as being at the vanguard of them. A study undertaken in Paris and London in 2006 among 90 individuals born between 1945 and 1954 reveals, however, strong relationships with ageing parents and adult children. Family groups based on local or dispersed entourages, with regular contact and the exchange of support, are clearly identified. Other configurations include families where affective ties persist but contact between the baby boomers and their entourage is less frequent. Few baby boomers have replaced family members with friends or remain socially isolated. These results show that the rise of individualism associated with the baby boomers has not weakened inter-generational ties, although tensions exist between the demands of family solidarity and individual projects.     

Physical Activity,Exercise, and Sedentary Behavior in College Students

Abstract

Objective: This article examines students’ perceptions of individual and institutional responsibility for sexual health so that institutions can better provide for the needs of their students to increase academic success and healthy relationship outcomes. Participants: Students from 2- and 4-year colleges in 1 state (N = 78). Methods: From May through November 2010, the authors used go-along interviews to examine students’ perceptions of resources for sexual health on their campuses. Results: Participants believed that it is the college's responsibility to provide resources and the responsibility of students to access resources. Participants at 2-year schools wanted referrals to resources, whereas participants at 4-year schools expected resources to be available and emphasized the importance of a supportive community. Conclusions: Students at 2- and 4-year colleges have different expectations of their institutions; by making resources and referrals for sexual health available, colleges can better serve their students, which will result in improved health outcomes.     

A study exploring factors of decision to text while walking among college students based on Theory of Planned Behavior (TPB)

ABSTRACT

Objective: This study attempted to identify critical predictors of intention to both send and read texts while walking based on Theory of Planned Behavior in order to provide resources for practitioners and campaign designers to inform college students of the perils of texting while walking and dissuade them from such a risky behavior. Participants: Three hundred twenty-nine college students were recruited from a large public university in the Southwest in September 2014. Methods: This study used a cross-sectional survey design. Results: Subjective norm (sending: B = .17, p = .02; reading: B = .17, p = .04), personal norms (sending: B = ?.32, p = .001, reading: B = ?.35, p = .001), and self-efficacy (sending: B = ?.27, p = .001; reading: B = ?.24, p = .001) were significant predictors of intention to both send and read text messages while walking. Conclusions: For students who have greater intention of texting while walking, persuasive communication should utilize normative influence and self-efficacy to discourage texting while walking.     

Reimagining Nursing Homes: The Art of the Possible

Long-term care (LTC) needs to be reconceptualized. The current efforts to reinvent the nursing home perpetuate a flawed model of care. The heritage of the nursing home as the dominant model for LTC needs to be reexamined. The basic LTC building blocks—housing, services, and medical care—can be combined in various ways to meet consumers' needs and preferences. We need innovative solutions that can offer reasonable service while recognizing the value of acceptable risk taking. Modest personal care should not come at the price of surrendering one's autonomy.     

Area Agencies on Aging and the Prevention of Elder Abuse:

This study reports findings from a 1989 survey of a national sample of directors of Area Agencies on Aging. The survey provided data on the structure of those agency activities which are intended to prevent elder abuse and on the perceptions of key decision makers with regard to the status of current efforts to prevent abuse. In addition, relationships between the population characteristics of planning and service areas (size, distribution) and program structures and perceived effectiveness were also examined.     

论我国个人信息法律保护的制度构建

个人信息是人格权的重要组成部分。然而,我国目前对个人信息保护的形势不容乐观。对于个人信息采取何种保护模式,学界进行了广泛而有益的探讨。为了充分保护个人信息权,规范信息流转制度,维护数字社会的信息安全,我们亟需制定一部统一的个人信息保护法,构建健全的权利制度保障体系,从而实现信息社会的可持续发展。
