论民族文化的发展规律——兼说"民族文化保护"的认识论问题

马克思主义的唯物辩证法思想是我们研究民族文化发展规律的指导原则。同世界上的其他客观事物一样,任何一种民族文化事项都有自身发生、发展和消亡的历史。一种民族文化事项产生之后到底能够存在多长时间,取决于它能够在多大程度上满足民族文化事项传承者的物质需要和精神需要。任何一种民族文化保护活动,如果不符合文化发展规律,不符合民族文化传承者自身的愿望,就不能达到预期目的。     

论食品安全事件中的良性媒体应对

食品安全事件是近年来全球公共安全问题中的热点,由于食品安全的重要性、食品安全事件的公众效应以及基于传媒的属性,媒体常将其作为关注的热点。媒体在食品安全事件中发挥着监测预警、沟通信息、舆论引导等功能,同时也存在关注视角的选择性和职业自律的松懈等不足。作为一种社会公共资源和社会监督力量,基于传媒良知和职业操守,媒体在食品安全事件中必须形成一套良性的应对机制,包括建立信息有效传播机制、建立食品安全事件相关方的沟通协调机制、建立媒体自律机制等。     

中国对中亚能源投资的法律问题及对策

中国与中亚在能源方面合作不断加强,逐步形成了更加紧密的能源安全共同体,然而在双方投资与合作过程中诸多相关法律问题也不断涌现,使中国对中亚地区的能源投资风险加大。文章对中亚能源投资中对投资的界定、投资准入、政治风险及环境保护等相关投资法律问题进行研究与分析,提出中国在中亚投资与合作过程中的相应对策,将对中国能源投资规避风险、保护投资利益大有裨益。     

区块链与法律的互动:挑战、规制与融合

区块链技术的迅速崛起在刑法、合同法、数据保护法和公司法等多个法律领域对法律带来了挑战,对区块链技术进行适当的法律规制是必要且可行的,应当采取试验性监管、自我监管、共同监管、类型化监管等策略对区块链实施适度、科学的法律规制,实现技术创新和公共政策的双赢。与此同时,区块链技术也与法律发生着融合,其不仅可作为法律科技辅助法律的实施,还在一定程度上补充乃至替代传统法律。区块链与法律的深度融合使法律呈现代码化的趋势,将使传统法律发生颠覆性重构。     

分析马克思主义的方法论基础探析

分析马克思主义作为西方马克思主义研究的一种新范式而出现,实现了马克思主义研究的方法论的新突破.西方社会科学中流行的个人主义解释模式构成其方法论的学术背景.约翰·埃尔斯特构建出分析马克思主义方法论的框架--以方法论个人主义为方法论原则,以意向性解释尤其是理性选择理论、博弈论为具体解释方法.围绕方法论个人主义和理性选择理论的争论逐步凸显出分析马克思主义研究方法论的全貌.只有运用辩证法精神,才能恰当处理方法论个人主义与方法论集体主义的关系、理性选择理论与功能解释的关系,才能准确评判与把握分析马克思主义的方法论基础.     

论案件事实信息的法律属性

诉讼证据中蕴涵的案件事实信息的收集、运用、识别和认定都应当符合法律规定的原则和程序。诉讼中要突出案件事实信息的法律属性,必须强化民事诉讼中的原被告双方或者刑事诉讼中的控辩双方的具有对抗性的举证和质证、分析和反驳,同时,法官应着重审查原被告或控辩双方举示的证据是否符合法律规定的条件,并对诉讼证据中蕴涵或留存的案件事实信息是否真实,以及这些案件事实信息是否就是证据事实,这些证据事实是否能够足以证明(即恢复或还原)案件事实,作为定案的根据等进行识别和认定。

毛泽东关于农民问题的论述科学地回答了农民在革命和建设中的地位与作用、农民的局限性以及对待农民问题的科学态度和政策等一系列基本问题,形成了一个完备的思想理论体系.在当今构建社会主义和谐社会的历史条件下,我们要认真坚持和发展毛泽东关于农民问题的思想理论,充分发挥农民的主体作用、积极维护和实现农民的经济利益和政治利益,全面提升农民的综合素质,培养社会主义新型农民,不断促进社会主义新农村建设.     

Agency of internal transnationalism in social memory

The article examines the limitations of methodological nationalism in the studies of social memory through a case study of memory of Stalinist repression in Belarus. It analyses how various social agencies – national and local activists, religious organisations, and international foundations – use the memory of repression for constructing post‐Soviet Belarusian identity by embedding their national representations in larger transnational frameworks. Drawing on the concept of ‘internal globalisation’, this article develops the idea of ‘internal transnationalism’ that suggests the importance of wider transnational configurations for the definition of nation. Internalized transnationalism does not make a national memory concept less nation‐centred, but it affects the choice of its cultural, political and civilizational framing. In contrast to methodological cosmopolitanism that implies rediscovering of the national as an internalized global, methodological transnationalism emphasizes the multiplicity of co‐existing transnational networks that can be invoked by social actors in their national mnemonic agenda. Using the case of the Kurapaty memorial site the article analyses how multiple framings of memory representations – the Belarusian national memory, liberal anti‐communist memory, contesting memories, such as Polish, Baltic and Jewish – compete and juxtapose in the space of social memory of political repression.     

Colonized Silence: Confronting the Colonial Link in Rural Alaska Native Survivors’ Non-Disclosure of Child Sexual Abuse

Though there is evidence linking the history of colonialism and oppression of Indigenous people to the high rates of rape and child sexual abuse experienced by this population today, it is less understood how colonial processes, past and present, condition the decision to disclose or report victimization. Drawing on a survivorship storytelling study of rural Alaska Native survivors of child sexual abuse, this paper underscores the importance of centering colonialism in understanding the culture of silence surrounding sexual victimization among Indigenous people. Results show that reasons for non-disclosure are quite embedded within larger social, historical and political themes of colonialism, oppression, and marginalization. Implications for policy and praxes are discussed, as well as a broader mandate of social change to remove barriers to disclosure.
