诉讼证据及其结构的逻辑新探

诉讼证据是诉讼制度的核心概念之一,同时也是学界争议最多的概念之一。通过逻辑的视角分析证据概念既有助于廓清一些不必要的理论纷争,同时又能揭示其深层结构,进而获得对证据概念本质的新理解：作为范畴的证据概念在法律规范的语境中是不可定义的;证据的结构是一个可废止推理,该推理的逻辑后承就是核心意义上的证据。

美术史的发展过程与观察方法有着密切的关系,可见观察在绘画中的重要意义。通过对莫奈和塞尚作品分析和比较,可了解他们在观察方法上各自的特点。莫奈发现了色彩和光的秩序,强调绘画是客观的提取和概括;塞尚发现了造型的几何构建,运用多视点使绘画进入主观表现世界。     

Computer-aided formulation and optimal control of an integrated production system for competitive products

An integrated production, inventory and advertising system has been formulated based on control engineering principles. In this system, the customer's demand is satisfied from stock, which in turn is replenished from production facilities. But sales reflect the advertising effort, present as well as past. The past effort has been considered as a delay with an assumed delay period. The problem is formulated as a state and observation model. Out of this an augmented model of state and parameters is formed. The parameters describing the model are estimated from MAP discrete filter algorithm. It is shown that sales of product 1 or product 2 at (k + l)th period is effected by sales and advertising of product 1 or product 2 at the kth period, and also by sales and advertising of product 2 or product 1 at (k-θ)th period, where 6 is the delay.     

Regression analysis of longitudinal data with time-dependent covariates in the presence of informative observation and censoring times

In longitudinal observational studies, repeated measures are often correlated with observation times as well as censoring time. This article proposes joint modeling and analysis of longitudinal data with time-dependent covariates in the presence of informative observation and censoring times via a latent variable. Estimating equation approaches are developed for parameter estimation and asymptotic properties of the proposed estimators are established. In addition, a generalization of the semiparametric model with time-varying coefficients for the longitudinal response is considered. Furthermore, a lack-of-fit test is provided for assessing the adequacy of the model, and some tests are presented for investigating whether or not covariate effects vary with time. The finite-sample behavior of the proposed methods is examined in simulation studies, and an application to a bladder cancer study is illustrated.     

一种对初始值稳健的单位根检验及其应用

常见单位根检验方法对初始值都做了适当的约束,而经验研究中的数据往往由于各种冲击的存在无法满足相应的假定条件。所以,有必要讨论检验功效对初始值稳健的单位根检验方法。本文在研究初始值对单位根检验功效影响的基础上,基于Fisher统计量提出了检验功效关于初始值较稳健的组合p值单位根检验方法并研究了其小样本性质。并且,对我国CPI月环比时间序列的检验发现,随着我国宏观经济调控政策的完善,CPI逐渐趋于平稳。
