神性思维是人类的超越精神和现实诉求的完整形态,以信仰为典型表现形式展示出自身的具体内容和现实外延,神性思维与法学理论构成了普遍与特殊的关系,使法学具备了同时作为信仰主体和信仰对象的二重信仰之维,并成为法学的逻辑理性的精神归属。法学的神性思维以自然法学最富代表性,形成一种独特的法学弥塞亚主义并演绎在各个法学流派中。自然法学的信仰之维提升了法学的本体论,确认了法律规则的普遍性与至上性,发展了法学的方法论,是法治得以实现的关键性要素。  相似文献

Abstract

In his oeuvre the nineteenth-century American author Herman Melville engages critically with the role of narrative taxonomies in imperial praxis, particularly as they relate to his own country's emergence as imperial nation. The relativising influence of Melville's years at sea is an important factor in shaping the ontologically indeterminate and anti-teleological character of his narratives, which both critically and parodically recall the ways in which narrative representations serve imperial ends by bridging or overwriting epistemological lacunae. Melville's lectures ‘On Traveling’ and ‘The South Seas’ provide a useful introduction to his countervailing perspective: the former, by delineating a mode of travelling that remains open to that which is other; the latter by considering critically the introduction of the Pacific into Western historiography by means of several acts of misnaming and symbolic appropriation. Melville highlights the self-deconstructive nature of such acts, yet also shows a keen understanding of how nominal appropriation and exotic refiguration foreground and enable colonisation. This recognition informs Melville's first prose fiction, Typee, in which he launches a two-pronged critique of imperialism: by his first person narrator's polemic against missionary and naval activity in the Marquesas, but also, more tellingly, by exposing this narrator's own acts of misrepresentation, which suggest a deeper complicity in the discourse of empire.  相似文献

This study analyses the changing identity of immigrant and second generation Indian Jains. Using surveys and interviews in the United States and Mumbai, India, we find that Jains, a distinctive religious minority in India, acquire an ethnic identity of ‘Indian’ in the United States despite concerted efforts to maintain a religiously based identity. Social practices developed by Jains to maintain social cohesion after domestic migration within India actually aid in the creation of ethnic identity after transnational migration to the United States. The geographic context of these immigrants in the United States, including physical settlement patterns and interactions with non‐Jain Indian immigrants, also lead this group to express greater solidarity with ‘Indians’ than with ‘Jains’.  相似文献

19世纪末20世纪初年,中国出现了严重的文化危机,其主要体现就是西方宗教文化的大举进入,极大地动摇了儒教在中国的正统地位。围绕如何处理西方宗教文化与中国本土文化尤其是儒教的关系问题,戊戌前后中国士大夫提出了取代论、融合论和并存论等应对方案,特别是提出了"保教"主张。"保教"主张的提出虽有其深刻的原因并被很多士大夫认同,但由于存在诸多局限,很快衰微,进入20世纪初年被佛教复兴和"存学"主张逐渐取而代之,文化民族主义以新的形式继续存在。  相似文献

Abstract

Social service workers' values and religious beliefs often differ greatly from those of their clients. This paper will assist helping professionals to develop a deeper understanding of the motivations behind clients' religious behaviors by describing religious participation through the lens of rational choice theory. A working definition of rational choice is provided. A graphic construct explaining the interaction of demand and supply on religious participation is presented. This model shows how a feedback loop develops to increase religious involvement. A discussion follows regarding religious participation as viewed from a demand side and supply side perspective. The paper concludes with ideas of how the information applies to social service workers and researchers.  相似文献

Asylum‐seeking unaccompanied minors contend with numerous challenges as they adjust to living in a new country. Although increasing attention has been paid to their capacity for resilience, little research has been done on the exact manner in which they cope. This paper describes some of the insights gleaned from a qualitative study undertaken with unaccompanied minors living in Ireland. Six different coping strategies are identified, namely: (1) Maintaining continuity in a changed context, (2) Adjusting by learning and changing, (3) Adopting a positive outlook, (4) Suppressing emotions and seeking distraction, (5) Acting independently, and (6) Distrusting. These are described in turn. Particular attention is paid to the role of religion in relation to the participants' coping strategies.  相似文献
